About this file

This is a Questions and Answers document for solicitation 140A2326Q0246 issued by the Bureau of Indian Education, Division of Acquisitions for a Flooring Project in Navarre.

The document addresses eight clarification questions regarding project execution and compliance requirements. Key operational details include: the period of performance is 180 calendar days from issuance of the Notice to Proceed; a site visit is permitted during the week of August 31, 2026, with coordination required through the Contracting Officer; the building will remain occupied during performance; furniture must be relocated and stored off-site as no on-site storage is available; multiple existing floor materials (primarily carpet and tile) are currently in place; no nearby material storage area exists; and no preferred installation direction is specified for the new flooring. Regarding compliance, the document clarifies that first-tier subcontractors must qualify as Indian Economic Enterprises (IEE) to be treated as "similarly situated entities" under FAR 52.219-14 and DIAR 1452.280-3; small business status alone under the assigned NAICS code is insufficient to exclude subcontractor payments from applicable subcontracting limitations. The technical evaluation criteria on page 17 has been amended to reflect the 180-calendar-day completion requirement rather than the previously stated 120 calendar days.

Questions & Answers for 140A2326Q0246 – Flooring Project Navarre

1. For purposes of compliance with FAR 52.219-14 and DIAR 1452.280-3, how should a first-tier subcontractor that qualifies as a small business under the NAICS code assigned to its subcontract, but is not an Indian Economic Enterprise (IEE), be treated?

Specifically, may payments to such a subcontractor be excluded from the applicable limitation on subcontracting as payments to a “similarly situated entity” under FAR 52.219-14, or must the subcontractor also qualify as a responsible IEE for those payments not to count toward the applicable subcontracting limitation?

The first-tier subcontractor must be IEE to be “similarly situated entity”; therefore, the subcontractor cannot be excluded from the applicable limitations on subcontracting.

2. The Statement of Work states that the period of performance is 180 calendar days from issuance of the Notice to Proceed. However, the technical evaluation criteria state that the proposed schedule must demonstrate completion within 120 calendar days. Please confirm whether the required performance period is 120 or 180 calendar days.

The period of performance is 180 calendar days from issuance of the Notice to Proceed as listed in the SOW, and other areas of the solicitation. The technical evaluation criteria listed on pg.17 is hereby changed to state, “180 calendar days”.

SOW?

Yes, the week of August 31, 2026. Please coordinate with the CO.

4. Does furniture need to be moved? If so, is there a place to store it?
