About this file

This is an amendment to a federal solicitation clarifying evaluation criteria for a Food Delivery and Courier Service contract (Solicitation No. 140A2326Q0010, Amd 0003).

The amendment revises four technical evaluation factors. For Technical Proposal evaluation, offerors must demonstrate understanding of the requirement, adequacy of approach to performing the two primary tasks outlined in the Statement of Work, and relevant technical experience with similar size, scope, and complexity work. Proposals failing to address both key tasks may be deemed non-conforming. For Key Personnel evaluation, the Courier is designated as the only Key Personnel position. Candidates must meet all SOW requirements and submit: a current résumé demonstrating minimum two years of experience in food delivery, courier services, or related field with food safety protocol familiarity; a current valid driver's license; a current Food Handler Card or food safety certification (ServSafe or equivalent) or documented food safety training; and proof of a criminal background check passed within the past 12 months or willingness to undergo one prior to service start. The Courier is the only authorized labor category for billing. Past Performance evaluation requires submission of three references for contracts or purchase orders similar in size, scope, and complexity, each including contract number, title, customer name, period of performance, contract value, point of contact information, summary of work performed and its relevance, and description of performance outcomes including reliability, communication, and logistical support. The Government reserves the right to obtain past performance information from CPARS, other databases, and direct customer interviews. For Pricing evaluation, offerors must submit fully supported pricing separated into Labor Costs (fully burdened fixed hourly rates for all proposed labor categories) and Helicopter Costs (projected actual costs obtained directly from Havasupai Tribe's designated Helicopter Point of Contact). Documentation from the Havasupai Tribe verifying offeror contact, actual cost per helicopter sling load with weight limitations and anticipated quantities, and confirmation of Tribe-authorized helicopter provider use is required; submissions lacking this verification are non-conforming. All pricing remains valid for 120 calendar days after solicitation closure. The Government will evaluate price for reasonableness and cost realism, with non-price factors combined being approximately equal to price, and reserves the right to award to other than the lowest-priced offeror if superior technical merit or reduced performance risk justifies the premium.

Clarification to Section 52.212-2 -- Evaluation

TECHNICAL EVLUATION FACTOR I. TECHNICAL PROPOSAL

Current Language:

i. Technical. The contractor will be evaluated based upon

• their understanding the scope of work by providing contractor’s (same/similar) work experience, and

• their understanding and ability to perform as it relates to this requirement.

Clarification Proposed Revised Language: Technical.

Technical. The Offeror shall submit a Technical Proposal that demonstrates a clear understanding of the requirement and the ability to successfully perform the two primary tasks outlined in the Statement of Work.

The Government will evaluate the Technical Proposal based on the following elements:

• Understanding of the Requirement: The extent to which the Offeror demonstrates an understanding of the scope, objectives, operating environment, and logistical considerations associated with performing the required services.

• Approach to Performing the Work: The adequacy and feasibility of the Offeror’s proposed approach for carrying out each key task, meeting required deliverables, and managing logistical and communication needs.

• Relevant Technical Experience: The degree to which the Offeror’s described experience reflects capability to perform work of similar size, scope, and complexity.

Proposals that do not demonstrate an understanding of the requirement or fail to address both key tasks may be deemed non-conforming.

TECHNICAL EVALUATION FACTOR II. KEY PERSONNEL

ii. Key personnel: The contractor will be evaluated based upon their key personnel and qualifications and experience of their key personnel. A deviation from the above key personnel requirement shall be considered as a non-conforming and shall be considered non-responsive. At a minimum, key personnel must meet the requirements as identified in the statement of work.

• Propose candidate’s resume, driver’s license and certification, if applicable.

Clarification Proposed Revised Language: Key Personnel.

Key Personnel. The offeror will be evaluated on the qualifications, experience, and suitability of their proposed Key Personnel. The Courier is the only position designated as Key Personnel under the SOW. Minimally, the proposal must identify the individual by name who will serve in the Key Personnel position. The candidate shall meet all requirements identified in the Statement of Work. The offeror must attach the following documentation for the proposed candidate(s).

• A complete and current résumé demonstrates a minimum of two (2) years of experience in food delivery, courier services, or a related field. The resume must reflect the individual’s familiarity with food safety protocols and temperature-sensitive deliveries.

• A copy of a current/valid driver’s license of the individual.

• A copy of a current/active Food Handler Card or food safety certification (e.g., ServSafe or equivalent), or documented training in food safety and hygiene practices. A copy of the certificate or training record must be submitted as proof of documentation.

• Proof of having passed a criminal background check within the past 12 months, or willingness to undergo and pass a background check prior to the start of services. Documentation must be provided as proof of compliance.

Failure to provide a copy of required documents for the Key Personnel will result in the proposal being deemed non-conforming.

The Courier is the only labor category authorized for billing under this contract and the billing structure should reflect this. The contractor must ensure the proposed candidate(s) identified for the key personnel position is available to perform end-to-end food delivery and related package delivery - courier services described in the Statement of Work. This understanding must be clearly demonstrated and reflected in the offeror’s technical approach for key personnel.

TECHNICAL EVALUATION FACTOR III. PAST PERFORMANCE

iii. Past Performance: The Offeror will provide three (3) past performance references. A deviation from past performance reference format shall be considered as a non-conforming and shall be considered nonresponsive.

Past performance is evaluated; the past performance information will be used in determining the level of risk or successful performance based upon the contractor’s actions under previously awarded purchase order or contracts and the ability to provide reliable and logistical communication for similar or complex experience.

The Government may utilize the Contractor Performance Assessment Reporting System (CPARS), or other databases, as well as interviews POC references, Program Mangers/Customers, Contracting Officers, Contracting Officer Representative (CORs), or Business Technicians, data submitted by the offeror or other known programs as part of the past performance file and any other information available regarding vender’s past performance.

Clarification Proposed Revised Language: Past Performance.

Past performance. The offeror will be evaluated to determine the Government’s level of confidence in the Offeror’s ability to successfully perform the requirements. The evaluation will consider the Offeror’s demonstrated performance on similar or complex efforts, including reliability, quality of work, timeliness, and effectiveness of communication and logistical coordination.

The Government may obtain and evaluate past performance information from multiple sources, which may include but are not limited to:

• Contractor Performance Assessment Reporting System (CPARS)

• Other Government or commercial databases

• Interviews with references listed by the Offeror

• Information obtained from Contracting Officers, CORs, Program Managers, Business Technicians, or other customers

• Past performance information otherwise known to the Government

The Offeror shall submit three (3) past performance references for contracts or purchase orders that are similar in size, scope, and complexity to the requirements of this solicitation. Each past performance reference must include the following information in the format provided in the solicitation:

• Contract or Purchase Order Number

• Contract Title / Description of Work

• Customer/Agency Name

• Period of Performance (start and end dates)

• Contract Value

• Point of Contact (name, title, phone number, email)

• Summary of Work Performed and How It Relates to This Requirement

• Description of Performance Outcomes, Including Reliability, Communication, and Logistical Support

Provided

A deviation from the required past performance reference format, or failure to provide all required information for each of the three references, will be considered non-conforming and may result in the Offeror being deemed nonresponsive.

The Government reserves the right to use any available past performance data, whether or not provided by the Offeror.

TECHNICAL EVALUATION FACTOR IV. PRICING

iv. Price. Price will be evaluated for price reasonableness and cost realism. Complete pricing schedule Section B, provide an expanded pricing and state quote shall remain effective for 120 calendar days after close of solicitation.

All evaluation factors other than cost or price, when combined, are approximately equal to cost or price.

Contractors will be evaluated on their technical capabilities, key personnel, past performance and price, as outlined above.

Best Value-Trade Offs: The Government reserves the right to make an award to other than the low priced quoter if another superior technical submission, or a submission indicating a reduced performance risk, warrants paying a premium. As non-price factors are evaluated closer to one another between quotes, price will become more significant. Furthermore, the Government reserves the right to award no order at all, depending on the quality of the quotes, the availability of funding and the continued existence of the requirement.

Clarification Proposed Revised Language: Price.

Price. The Offeror shall submit a complete and fully supported pricing package in accordance with Section B.

Pricing shall be clearly separated into the following two components:

• Labor Costs (Fully Burdened Fixed Hourly Rates) o Provide fully burdened, fixed hourly rates for all proposed labor categories.

o Identify each labor category, the number of hours proposed, and the corresponding fixed hourly rate.

o Labor pricing shall include all direct and indirect costs and must conform to the Offeror’s established accounting practices. This should include any associated costs for the Food Delivery and the Package Delivery & Courier Services.

• Helicopter Costs (Projected Actual Costs) o Propose helicopter transportation costs on an actual cost basis only.

o All helicopter pricing must be obtained directly from the Havasupai Tribe’s designated Helicopter Point of Contact.

o The Havasupai Tribe is the only authorized entity permitted to approve helicopter operations into the

Grand Canyon and to coordinate the use of associated airspace. Third-party helicopter companies are not authorized to provide pricing or coordinate access.

o The Offeror shall include documentation from the Havasupai Tribe verifying:

That the Offeror contacted the Tribe to obtain helicopter pricing;

The actual cost per helicopter sling load, including weight limitations and anticipated annual quantities;

Confirmation that the Tribe’s authorized helicopter provider will be used for all required services.

Pricing submissions that do not include this verification will be deemed non-conforming.

Quote Validity: All proposed pricing shall remain valid for 120 calendar days after the solicitation closing date and shall be stated on the pricing schedule.

Price Evaluation: The Government will evaluate price for:

• Price Reasonableness – whether pricing is fair and reasonable when compared to other quotes, historical data, or other relevant information.

• Cost Realism – whether proposed costs, particularly helicopter costs, are realistic and reflect a clear understanding of the requirement.

All evaluation factors other than price, when combined, are approximately equal to price.

(Conti) TECHNICAL EVALUATION FACTOR IV. PRICING

Contractors will be evaluated on their technical capabilities, key personnel, past performance and price, as outlined above.

Best Value – Tradeoff: The Government reserves the right to make an award to other than the lowest-priced Offeror if a higher-priced quote demonstrates superior technical merit or reduced performance risk. As non-price factors become more equal among Offerors, price will become more significant. The Government reserves the right to make no award, to not award due to the quality of the quotes, funding limitations/availability, or to discontinue the requirement.
