Except as provided herein, all terms and conditions of the document referenced in Item 9 A or 10A, as heretofore changed, remains unchanged and in full force and effect .
The purpose of this amendment is to answer the following questions:
1. Was there an archaeological survey report that was completed that we could see the recommendations and previously found resources?
Answer: Patricia Mattingly, Regional Director, Department of the Interior, Bureau of Indian Affairs (BIA), in a letter dated January 4th, 2022, addressed to Jeff Pappas, PhD., New Mexico State Historic Preservation Officer, Historic Preservation Division, Department of Cultural Affairs, sought to receive concurrence regarding the BIA's approach to the site (BIE Greenhouse Construction Project), her letter states "Although no archeological surveys have been performed within the area of potential effect (APE), there is a low potential for discovery of unidentified sites because the proposed construction is located within an area previously disturbed by the construction of multiple building foundations, structural foundations, and driveways. The existing buildings and structures do not meet the 50-year minimum age for eligibility consideration under the NRHP. That an Ancestral Puebloan site was discovered within 300m of the APE, indicates there is a possibility that subsurface remains may be encountered at approximately 0.3 bgs. Based on these findings, the BIA recommends the implementation of an archaeological monitor during ground-disturbing activities. With this precaution in place, the BIA determines there will be no historic properties affected by the construction of the SIPI Greenhouse/Headhouse."
Concurrence was then received from the New Mexico State Historic Preservation Officer (SHPO), Richard Reycraft, PhD., on January 11, 2022, responding by letter, stating, "The SHPO concurs with the BIA recommendations. Specifically, we concur with the BIA recommendation that, with the implementation of an archaeological monitor during ground-disturbing activities, this project will have no adverse effect on cultural resources listed on, or eligible for, the National Register of Historic Places or the State Register of Cultural Properties."
2. Is there an existing Programmatic agreement or Memorandum of Understanding in effect for what to do if resources are found?
Answer: The Government is unaware of any program agreement or Memorandum of Understanding in effect if resources are found.
3. If resources are found, how do we factor that into our pricing? Or will work stop and a new contract negotiated if further work is needed?
Answer: If resources are found, the contractor shall notify the COR immediately. The likely result is a stop work.
