SECTION C – DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1. PROJECT

(a) BACKGROUND

The Bureau of Indian Affairs (BIA), Branch of Water Resources (BWR) of the Southwest Regional

Office (SWRO) is tasked with gathering information in the support of water rights claims primarily supported through regional surface and subsurface hydrological modeling. Wells and surface water observations points are the primary sources of data collection. The BWR constructs wells to the purpose of general aquifer observations, exploratory hydrogeological formations characterization and well production rate testing. The BWR observes, records, maintains, and constructs surface water observation points of natural or anthropogenic and ephemeral or perennial water ways and their interaction within their prospective water sheds for tribal water budgeting and surface water modeling. Regional hydrological data collection is instrumental in providing necessary data to support observed variation in hydrological and environmental stressors and localized water budgeting for water rights Adjudications proceedings.

Additionally, the BWR is involved in supporting tribal compliance and implementation of

Adjudication settlements and advising tribal Water Resource offices.

(b) DESCRIPTION

The work covered under this contract consists procurement of all plant, labor, equipment, appliances, and materials for the performance of the following operations: well drilling services to include, but not be limited to, well construction, well reconstruction, development, well head completion, daily logs, driller's reports for each site, test pumping, pump repairs and furnishing and installation of well monitoring equipment and related supplies. The purpose of the drilling service is to gather information and data on the hydrologic characteristics of aquifers, their water level fluctuations, and the quality of groundwater resources on Indian lands. Additionally, environmental data will be developed from the drilling service contract. The work shall be completed and in accordance with the following technical specifications and are subject to the terms of the contract.

(c) PROJECT LOCATION

(1) The well site is located Southwest of the Rio Grande and Jemez River confluence within an abandoned flood plain on the Pueblo of Santa Ana tribal lands. Township and Range: NW1/4 of SW1/4, Section 9, T13N, R4E.

(2) Based on localized hydrogeological, geological, and geomorphological observations and investigations of the regional formations it is estimated to consist of:

(i) Unconsolidated Formation: consisting of mostly Sands, Gravels, Clays, Silts, Cobbles, and a potential for boulders from 0’ to approximately 300’ depth estimated. Project sites surface consists of mostly uncompacted loose sands.

(ii) Potential Consolidated Formations: Below 300’ depth no localized regional data or observations where available: Noted, within 1000’ North and North West of site is a known Basaltic to Andesitic consolidated formation.

(3) Additionally, a shallow aquifer is expected within the region potentially resulting in the encountering of highly fluid sand (Flowing Sands) formations possibly compromising borehole side wall stability.

C.2. DEFINITIONS / ACROMYNS

(a) BIA - Bureau of Indian Affairs

(b) Calendar Day (CD): Each day of the calendar year including workdays, weekends, and holidays.

(c) Contracting Officer (CO): the primary authority of a given contract, who can bind the Federal

Government of the United States to a contract. Contracting Officers hold a warrant allowing them to negotiate on behalf of the United States Government. As the Government's agent only a CO may execute, modify, or terminate a contract.

(d) Contracting Officer’s Representative (COR): Government representative designated by the

Contracting Officer authorized to act within the limitations imposed under the terms of the contract and by the Contracting Officer.

(e) Government Furnished Items: Items (e.g., equipment, facilities, materials services, etc.)

provided by the Government to the Contractor for use in performance of this contract.

(f) Inspection: The examination of the Contractor's work by the Government to verify compliance of contractually designated standards and requirements will be performed by the given contracts designated COR.

(g) Non-Standard Work Hours: The period from 5:00 PM to 8:00 AM, Monday through Friday, weekends, and Federal Holidays. Non-Standard Working Hours will be considered at a general overtime hourly rate for time estimating and payment purposes.

(h) Notice to Proceed: An official document provided by the CO and signed by the Contractor acknowledging the contractor’s permission to start the awarded contractual work.

(i) Period of Performance: The allotted period for the completion of the awarded contract based on the contractual estimated completion time and starting upon the given date of the notice to proceed.

(j) Preconstruction Conference: A meeting attended by designated representatives of the

Government, Contractor and Tribe. It shall be held after contract award and prior to the start of work. The purpose of discussing all aspects of the required work and any questions or concerns regarding the contract requirements or environmental conditions needing to be addressed.

(k) Standard Work Hours: The period of 8:00 AM to 5:00 PM, Monday through Friday excluding weekends (Saturday and Sunday) and Federal holidays (New Year’s Day, Martin Luther King

Jr. Day, Presidents Day, Memorial Day, Independence Day, Labor Day, Indigenous Peoples

Day, Veterans Day, Thanksgiving Day, and Christmas Day). Standard Work Hours will be

considered at a standard hourly rate for time estimating and payment purposes.

C.3. GOVERNMENT FURNISHED PROPERTY AND SERVICES

Items such as equipment, facilities, materials services, etc. provided by the Government to the

Contractor for use in performance of this contract. If the Government provides property, equipment, or materials to be specifically used within the course of the contact, the contractor shall be informed of the specific property, equipment or materials and its intended use or function.

Ownership remains with the Government.

C.4. SCOPE OF WORK

(a) GENERAL

The Contractor shall be responsible for providing all equipment, materials, labor, tools, transportation, supervision, management and any other services or incidentals required for the successful completion of the contract. This contract is for drilling, construction, sampling and testing of three (3) exploratory water wells at the Southern Pueblo Agency (SPA) on the Pueblo of Santa Ana in central New Mexico. There will be:

- 1 each 4” observation well to 1110’

- 1 each 10” pumping well to 1110’

- 1 each 4” observation well to 410’

- Up to 3 aquifer tests with: 1 each step test not to exceed 7 hr. of pumping with up to 36 hr. of aquifer recover time.

- 1 or 2 each pump tests not to exceed 76 hr. of pumping with up to 36 hr. of stand by time for aquifer recovery or two mobilizations and pump installs and extractions.

(b) OUTLINE

The sequence of the well and task completion is as follows.

(1) Task No. 1: Drilling, Sampling and Testing of One (1) 4” Observation Well to 1110’

(i) Mobilize equipment.

(ii) Drill, sample and complete one (1), 14-3/4” diameter or suitable diameter borehole for 12” surface/conductor casing to 110’.

(iii)Furnish install and seal up to 115’ of blank steel 12” surface casing.

(iv) Drill, sample, geophysical log and complete one (1), 9-7/8” diameter or larger suitable diameter borehole for 4” casing to 1110’.

(v) Furnish and install up to 835’ of 4" blank casing and up to 280’ of 4" mill slotted casing with to 2 to 4 centralizers. (mill slot size to be determined after evaluation of borehole cuttings)

(vi) Furnish and install up to 320’ of filter pack.

(vii) Furnish and install up to 810’ of impervious annular seal for well and surface casing.

(viii) Provide air, power, fuel, and support for 24 hours of swabbing and airlifting of the screened zone.

(ix) Furnish and install 1 wellhead completion with 4 guard posts, Pad, and lockable well cap.

(x) Demobilize equipment to Completion No. 2.

(xi) Completion of line items 1 – 4 will determine the progression and or adaptation of Tasks

2 – 5 based on the findings of the initial borehole regarding formation water table elevations and lithostratigraphic units. If an adaptation of the proposed Task completion from the

SOW for Task 1 is found to be required, then the contractor shall convene with the COR to deploy either a predetermined per contract proposal contingency plan or develop a new course of action to resolve any unforeseen issues in the completion of Task 1 within the contractual requirements.

(2) Task No. 2: Drilling, Sampling and Testing of One (1) 10” Test Production Well to 1110’.

Subject to variation based on findings from geophysical logging and borehole cuttings)

(i) Mobilize equipment from Completion of No. 1.

(ii) Drill, sample, and complete one (1), 26” diameter or suitable diameter borehole for 20” surface/conductor casing to 110’

(iii) Furnish and install up to 115’ of blank steel 20” surface casing.

(iv) Drill, sample, and complete one (1), 17 1/2” diameter or larger suitable diameter borehole for 10” casing to 1110’.

(v) Furnish and install 830’ of 10" blank steel casing, and 280’ of 10” mill slotted casing with

2 to 4 centralizers.

(vi) Furnish and install up to 320’ of filter pack.

(vii) Furnish and install up to 810’ of impervious annular seal for well and surface casing.

(viii) Provide air, power, fuel and support for 72 hours of swabbing and airlifting of the 10” screened zone.

(ix) Furnish and install 1 wellhead completion with 4 guard posts, Pad and lockable well cap.

(x) Demobilize equipment to completion No. 3.

(3) Task No. 3: Drilling, Sampling and Testing of One (1) 4” Observation Well to 410’

(i) Mobilize equipment from Completion of No. 2.

(ii) Drill, sample and complete one (1), 14-3/4” diameter or suitable diameter borehole for

12” surface/conductor casing to 80’

(iii) Furnish and install up to 85’ of blank steel surface casing.

(iv) Drill, sample and complete one (1), 9-7/8” diameter or larger suitable diameter borehole for 4” casing to 410’.

(v) Furnish and install up to 290’ of 4" blank casing and 120’ of 4" mill slotted casing with

2 to 3 centralizers.

(vi) Furnish and install up to 150’ of filter pack.

(vii) Furnish and install up to 260’ of impervious annular seal for well and surface casing.

(viii) Provide air, power, fuel, and support for 24 hours of swabbing and airlifting of the screened zone.

(ix) Furnish and install 1 wellhead completion with 4 guard posts, Pad, and lockable well cap

(x) Demobilize equipment.

(4) Task No. 4: Furnish water level recorders and cables.

(i) Furnish 3 water level recorders based on field assessment specifications.

(ii) Furnish water level recorders cables based on observed depth to water measurements and pump test parameters.

(5) Task No. 5: Aquifer testing, (1) Step test up to 7 hr., (1) pump tests up to 76 hr. of pumping.

(i) Mobilize equipment to job site

(ii) Furnish, install, and remove one test pump up to 2 times.

(iii)Furnish one generator sufficient for pump operations.

(iv) Provide power, fuel, flow meter, hose/piping, and support for up to 7 hr. step test.

(v) Prepare to be on standby after step test for up to 36 hr. for aquifer recovery or demobilize and remobilize to site for next pump test depending on observed aquifer recovery.

(vi) Provide Power, fuel, flow meter, hose/piping, and support for 1 to 2 pump tests not to exceed 76 hr. of pumping and up to 36 hr. of recovery time

(vii) Take water sample for water quality, specific sample test specifications to be determined in field.

(viii) Remove any residual debris at well site accumulated through the course of the contract.

(ix) Grade well site close to original topography before commencement of drilling.

(x) Demobilize equipment.

(6) Completion of each item is dependent on the inspection and approval of the COR and subsequential approval of the CO, before moving to the next task.

(c) DESCRIPTIONS OF SCOPE OF WORK ITEMS & TASKS

(1) Equipment: The Contractor shall furnish a complete list of all equipment to accomplish the contracts completion for the specified work plan and all methods determined for the completion of each task item. Assure equipment is in good condition and the work site is kept clean. The Contractor shall furnish copies of all the standard time sheets, daily work reports, drill logs and any other documents used for the propose of determining billing charges or operation costs with cost controls for each task item. Any changes must be approved by the

COR before equipment is commissioned.

(i) Equipment licensure: The Contractor shall be responsible for providing all permits, licensure or other requirements for the transportation and operation of all necessary equipment for the work completion for the contract. Additionally, copies of each permits, licensure or other requirements shall be provided to the Government upon request.

(2) Mobilization and Demobilization: Mobilization and demobilization for each piece of equipment requested for contract completion. This includes rig transportation, except for milage costs to and from the job site, rigging up and rigging down, setting up all related equipment such as mud pumps, compressors, de-sanders, sampling areas, site preparation, and site restoration and clean up.

(3) Mileage: A cost per mile shall be paid for required equipment and support vehicles. The mileage shall be calculated as:

(i) The distance of one round trip from the contractor’s place of business to the work location.

(ii) Or the distance of one round trip upon the entrance of New Mexico state boarders from contractor’s place of business to the work location, whichever is less.

(4) Borehole Drilling: The contractor shall furnish all plant, labor, equipment, and materials and preform all operations at the specified locations to accomplish borehole services required to complete no less than 9.5 inch and not greater than 30-inch diameter boreholes as negotiated

within the contract proposal and outlined in the Scope of Work (SOW). Each borehole shall not exceed 1110 ft. in depth from ground surface level. The contractor shall drill boreholes by conventional mud hydraulic rotary methods, bottom-hole percussion tools with air rotary methods, reverse circulation rotary methods, auger methods or by any other contractor accessible and COR approved drilling method. All proposed drilling methods shall be clearly represented within the cost proposal of this contract and approved by the COR prior to contract awarding. Any variations of drilling methods deemed necessary to complete contractual requirements agreed upon within this contract must be approved by COR before commencement of the variation of drilling method.

(i) Borehole Diameters: Each monitoring well borehole shall have a minimum diameter of

5.5 inches larger than the 4-inch casing outside diameter and shall not exceed a total depth of 1110 ft. below ground surface level. Each production well borehole shall have a minimum diameter of 6.5 inches larger than 10 inches and shall not exceed a total depth of

1110 ft. below ground surface level. Each conductor/surface casing borehole shall have a minimum diameter of 3.0 inches larger than the 12 or 20-inch casings outside diameter and shall not exceed a total depth of 110 ft. below ground surface level. Depths of all wells are subject to variation dependent on findings from the initial exploratory borehole Any variations from the suggested borehole diameters from the given diameter within the SOW shall be approved by the contracts COR before work on the borehole commences.

(ii) Casing Holes: The initial exploratory monitoring well borehole will be assessed by the

COR after completion of total depth, which could vary from the described depths in the

SOW depending on encountered borehole geology and concurrent available funding (this should not affect the casing and borehole diameters). If the regional formation is determined through assessment of the initial exploratory borehole to be productive and within the required formation characteristics to provided valuable data collection within the contracts desired outcomes. Then the conditions described within the contracts SOW will commences as prescribed. Modifications to depths and or drilling methods of each borehole may be required depending on the lithological findings of the initial exploratory borehole. Casing and screen dimensions are giving within the contract’s SOW and are subject to change dependent on any contract modifications found to be necessary for contract completion. The screen type is a mill slotted screen with a slot size to be determined after evaluation of the initial boreholes’ cuttings. The position and or location of the screen might require multilabel isolated sections to isolate potentially different confined aquifer systems. The positions and or location of each screened section will be evaluated and determined after the initial exploratory borehole and geophysical logging are completed.

(i) Drilling Methods: More than one drilling method may be required to complete the described drilling within this contract. The use of a bottom hole percussion tool might be required depending on the chosen drilling method and geology of each borehole. Contactor may use any drilling method within their capabilities meeting the required conditions described in the SOW and so long as it is approved by the COR prior to commencement of drilling.

(ii) Drilling fluids: The use of drilling fluids are suggested as water based muds and to contain a weight between approximately 8.3 to 12.00 Pounds per Gallon (PPG), a Marsh funnel viscosity no greater than 60 seconds/quart, filter cake thickness equal to or less than 3/32-inch and a sand content no greater than 6%. Any required variation within drilling fluids

standards should be discussed with the Contractor, Drilling Fluids/Mud Engineer and the

COR and approved by COR before implementation. Additionally, the Contractor will be expected to employ a Drilling Fluids/Mud Engineer and preform a minimum of 2 drill fluids/mud analyses per borehole. The Contractor shall provide a Marsh funnel viscosity test using seconds/quart at a minimum of once every 18 hours of drilling, drilling fluids analysis performed by Drilling Fluids/Mud Engineer and a materials list of all used chemical and martials within the drilling fluids upon request from the Government.

(iii)Drilling standards: All boreholes will be drilled vertically to the bottom of the depths specified within the contract. Offsetting of the boreholes from the specified locations will not be permitted. The Contractor shall operate the drilling rigs such that hydraulic pressures, speeds and or air pressures ensure optimal uplift of borehole cuttings. Failure to comply with any of the given procedures shall constitute justification for the

Government to require redrilling at the Contractors’ expense of any borehole the

Government deems unsatisfactory in depth, degree of angle or any other deficiencies failing to meet contractual requirements. All boreholes not being designated for use as a monitoring or production well or the Government deems as nonfunctional shall be sealed.

(5) Borehole Cuttings Sampling: The Contractor shall collect sample borehole cuttings every 10

ft. of depth drilled. The samples will be bagged and clearly labeled with the depth interval of sample and borehole designated name. Borehole cutting samples will be set in a designated sample collection location on site and placed in a chronological order. All borehole cuttings sampling operations should be incorporated into the operational costs of the borehole drilling.

(6) Geophysical logging: After completion of the initial exploratory borehole the Contractor shall take all COR approved precautions to prevent compromising borehole sidewall stability.

Geophysical logging shall be completed within 4 days of completion of the Total Depth of initial borehole. Using a reliable and competent firm experienced in but not limited to electric resistivity, spontaneous potential, single point resistance, gamma ray, neutron, sonic and caliper logging. The Contractor shall be responsible for all arrangements and scheduling with the logging company and shall pay all related costs.

(7) Welding: All welding operations shall be performed by an experienced and American Welding

Society (AWS) certified welder using American Petroleum Institute (API) defined standards for materials. All casing joining via welding shall be beveled and joined using a flush butt joint with a minimum of a single pass of 7018 welding rod completely covering the beveled section and a fill protruding no less than equivalent to the outside of the casing diameter.

(8) Casing Installation: Installation of well casing shall consists of 2, 4-inch wells estimated to be at depths of 480 ft. and 1110 ft. using 4-inch, steel casing within API (American Petroleum

Institute) standard guidelines for side wall per depth and diameter and equivalent dimensioned

4-inch mill slotted screen with up to 1120 feet of blank casing and 400 feet of mill slotted screen for the total project. The installation of 1, 10-inch steel casing within API standard guidelines for side wall per depth and diameter and equivalent dimensioned 10-inch mill slotted screen with up to 830 feet of blank casing and 280 feet of mill slotted screen for the total project. Each well shall have a bullnose end cap and 2 to 4 centralizes approximately spaced at 1 centralizer per 250 – 280 ft. of well casing. The dimension of the mill slot for the mill slotted casing will be determined after completion of the initial exploratory borehole cutting samples have been processed. Both 4-inch wells shall have a conductor/surface casing of 12-inch blank casing with a minimum side wall of 0.3125 inches and not to exceed 200 ft.

casing with a minimum side wall of 0.3125 inches not to exceed 115 ft. for the total project.

All casing installation shall not deviate to a greater extent than 5 inches/100 ft. from a straight plumb line beginning at the exact center of the top of the well casing.

(9) Placing of Bentonite plugs: The placement of seals and plugs required for isolating specific zones, well abandonment and or well head protection. Bentonite Sealing material will be composed of 0.250 to 0.50 inches pellets formed of pure bentonite and placed using tremmie pipe or by Contractor’s suggested method approved by the COR and assures accurate and effective seals (see attachment “Placing of Bentonite Plugs Method”.

(10) Cementing: Grouting/cementing services shall be required for various potential observed aquifer formations for additional sealing, casing and or borehole stabilization and potential well abandonment. Grouting/cementing shall require abilities to pump Portland Type III cement slurries containing up to 5% pure bentonite through tremmie pipe at pressures up to

150 PSI (pounds per square inch). The grouting/cementing materials shall conform to slurry weights of approximately 115 LBS/ CU.FT. (pound per cubic foot) and given a minimum of 8

hr. of curing time.

(11) Placing Filter/Gravel pack: All filter/gravel pack to be installed for the purpose of packing a screened section shall be composed of quartzose and or similar durable well rounded particles, containing no silt, clay, organic materials, flat or elongated particles or deleterious materials. Under no circumstances will crush rock be allowed as filter pack material. A certificate of quality and gradation from a testing laboratory may be required if a question of compliance is raised by the COR. The general estimation of CU.FT. (cubic feet) of filter pack required for this project is not estimated to surpass 600 CU.FT. giving the contracts SOW defined borehole diameters. The dimensional particle size of the filter/gravel pack shall be determined after completion of the initial borehole cuttings analysis and determination of mill slotted screen slot dimensions.

(12) Well Development: Services requiring procedures for development may be done in any of

3 ways as determined by the COR for any of the wells within this contract. The 1st option for development shall be done through the air-lifting method. Using an air hose capable of blowing sufficient volume and pressure with sufficient length to reach the bottom of the wells screened section. The 2nd method will use a drill pipe as an educator the drill pipe will be fitted with a 5 to 10 ft. section of a perforated pipe Isolated by swab flanges on top and bottom. The perforated section of pipe will be lowered to the bottom of the screened area with an air hose and development will commence allowing the column to be raised and or lowered for successive screen sections while airlifting. The 3rd method of development will be by pumping using a submergible pump, the pump will be lowered to the lower section of the screen and development shall begin. The pump assembly shall be constructed to allow the pump to be moved up or down in 10 to 20 ft. sections. The configuration of pumping within each 10 to

20 ft. section shall be determined by the COR who shall be on site during all initial steps of development operations.

(13) Procurement of Water Level Recorders and Cables: The Contractor shall be responsible for all logistics of the procurement of 3 water level recorders and 3 vented cables which shall not exceed 1000 ft. per cable for operation with the recorders. The exact specifications of the recorders and lengths of the cables will be determined after completion of the initial exploratory borehole and geophysical logging and the derived data is evaluated by the COR.

These Recorders and cables will be required before any aquifer pump testing can begin.

(14) Aquifer Testing: The Contractor shall furnish a pump of sufficient power and size to

deliver specific rates from specific depth installed and removed by the Contractor. with a pump assembly, including a de-sander, sufficient flowmeter for desired pumping rates and a water sampling relief valve. Manned operations of the pumps and generators will be required for the duration of aquifer testing operations. The specific specifications of the pump and assembly shall be determined after completion of all well development processes. In some cases, the Contractor may be required to provide water level data collection or services. In case the Contractor is needed to collect water samples or water level data collection all requirements shall be clearer relayed to the job site Forman or tool pusher at site, general guidelines can be found in (iii). Allowance will be made to assure all necessary water level collection equipment is made available to the Contractor for any necessary water level data collection in accordance with section 3.D and all applicable personnel are familiar with the required data collection processes. If for any reason the pump stops or cannot be controlled accurately then the currently running aquifer test shall be stopped reset and repeated at the

Contractor’s expense.

(i) Step Testing: Step testing will consist of 3 to 5 distinct period as follows: 1) pre-pumping period of 5 to 15 minutes after pump and pump assembly are installed and ready to start step test, 2) a continuous pumping period at a discharge rate designated by the COR, 3) a period of an altered discharge rate of continuous pumping if initial continuous pumping is insufficient to adequately stress the aquifers production rates, 4) another period of an altered discharge rate of continuous pumping if 2nd continuous pumping is insufficient to adequately stress the aquifers production rates and is not to exceed a total of 7 hr. of combined pumping through the duration of step testing, 5) an aquifer recovery period restricting the extraction of pump and pump assembly for a period not to exceed 36 hours.

If after 24 hours of aquifer recovery it is determined by the COR the aquifer recovery rate will be insufficient for accurate data collection within the given 36 hours, a request from the Government may be made to leave the pump and assembly at the location for a period to be determined after observation of the initial 24-hour recovery period. If the Contractor needs to extract the pump and pump assembly prior to the new determined time frame for complete aquifer recovery the Contractor and the COR shall discuss and find an agreed upon time frame after the given 36 hr. recovery time to extract the pump. No pumping shall be required during the pre-pumping and recovery time periods.

(ii) Constant Rate Pumping Test: Constant rate pump test will consist of 3 distinct periods as follows: 1) Pre-pumping period of 5 to 15 minutes after pump and pump assembly are installed and ready to start pump test, 2) a continuous pumping period at a discharge rate designated by the COR as determined by observation of step testing, 3) an aquifer recovery period restricting the extraction of pump and pump assembly for a period not to exceed 36 hours. If after 24 hours. of aquifer recovery it is determined by the COR the aquifer recovery rate will be insufficient for accurate data collection within the given 36 hours, a request from the Government may be made to leave the pump and assembly at the location for a period to be determined after observation of the initial 24 hr. recovery period. If the

Contractor needs to extract the pump and pump assembly prior to the new determined time frame for complete aquifer recovery the Contractor and the COR shall discuss and find an agreed upon time frame after the given 36 hours recovery time to extract the pump. No pumping shall be required during the pre-pumping and recovery time periods. A 2nd mobilization and demobilization may be required to complete the aquifer testing periods.

All logistical aspects of a required 2nd mobilization and demobilization shall be discussed

and agreed upon by the Contractor and COR prior to the 1st demobilization.

(iii)Aquifer Tests Water Data Collection: The Contractor may be required to provide water collection and or to record water levels at given time increments through the course of constant rate pump testing. Any required water collection or recording of water levels shall be clearly explained to the Contractor and Job Site Foremen or Tool Pusher by the COR prior to commencement of operations. If water collection is required, then the COR shall establish a given time increment for water collection and processes. The Contractor shall take a water sample of approximately 1 quart and measure for temperature and specific conductance at the given time increment set by the COR which shall not exceed a frequency of 1 sample/hr., record the samples tested characteristics and provide a written log to the

COR. The Government shall provide equipment for temperature and specific conductance measuring in accordance with section 3.D. If the Contractor would prefer to use their own equipment they may do so after approval of equipment by the COR. If water level measurement is required, then the COR shall establish a given time increment for water level measuring. The Contractor shall use a water level meter/tape/sounder and record water level variation based on the establish time increments given by the COR in a log to be provided to the COR upon completion of the pump test. The Government shall provide equipment for water level measuring in accordance with section 3.D. If the Contractor would prefer to use their own equipment they may do so after approval of equipment by the COR and providing it is the same instrument used throughout the course of the current pump test.

(iv) Water quality sample: After a minimum of 24 hours of the pumping on the constant rate pump test the Contractor shall take a water quality sample based on the instructions given by the company procured to perform the water sample analysis. The Contractor shall be responsible for all arrangements and scheduling with the water sample analysis company and shall pay all related costs. The water sample analysis company should be competent in providing water analysis for but not limited to Metals, Anions, Coliform, Alkalinity, Specific Conductance and Total Dissolved Solids.

(15) Well Head Completion: The Contractor shall complete 3 well heads within the given parameters. A cement pad to the specifications giving by the COR not to exceed 8 inches in depth and 36 SQFT (square feet) of surface area. Each pad shall have 4 cement filled bollards exceeding conductor/surface casing height by 6 to 24 inches and be painted in yellow unless otherwise specified by the COR. A clean and deburred well and conductor/surface casing with a welded on lockable well cover/lid and painted with a COR approved color. The COR suggests competing the well head of the well being pumped in the aquifer test after the completion of aquifer testing, any damage to pads, bollards or casing and cover shall be the responsibility of the Contractor until the final inspections is completed and approved.

(16) Final Site Clean-up and Restoration: Once all well completion and testing tasks within this contract are completed the Contractor will perform a final site clean-up and any necessary grading at site. All remaining materials and debris shall be removed from the site. Any drilling fluid/mud pits on site will be filled in and compressed. If residual drilling fluids remain on site, it shall be removed or mixed with native soils depending on the COR and tribal representatives’ decision. Site will be graded back to as close as the native gradation as possible.

(17) Travel and Per Diem: Travel cost for lodging, meals, and incidental expenses are limited to the maximum GSA per diem rates in effect at the time of travel in accordance with the

Federal Travel Regulations. The New Mexico FY 21 rates are located at

(d) SERVICE DELIVERY SUMMARY

(1) Overview: The Service Delivery Summary (SDS) identifies critical success factors for the contract. It Identifies both the performance objectives for the factors and the performance thresholds required for each performance objective. The Government reserves the right to survey all service called for within this contract to determine whether the performance objectives and goals were met. The COR will develop a surveillance plan when the Contractor submits the quality control plan and finalized drilling bid schedule.

(i) Work and Safety Plans: The contractor shall complete and execute a work plan with a proposed schedule, traffic management plan, safety plan, discharge plan or any other required safety or work plans necessary for completion of each task item prior to the commencement of work on the task item.

(ii) Equipment lists: The Contractor shall furnish a complete list of all equipment to accomplish the contracts completion for the specified work plan and all methods determined for the completion of each task item. Assure equipment is in good condition and the work site is kept clean. A separate list for proposed renting or leasing of equipment shall be furnished by the Contractor

(e) OTHER GENERAL CONDITIONS

(1) Licensure: The contractor shall maintain a current and approved New Mexico water drilling license throughout the course of the contract in accordance with 14.27.4 NMAC, for the State of New Mexico. The contractor will provide the Government with proof of New Mexico drilling license at the time of offer.

(2) Supplies and Materials: New ONLY; NO remanufactured or "gray market" items. All items must be covered by the manufacturer's warranty.

(3) Payroll, Timesheets & Drill Logs: The contractor shall furnish copies of all the standard time sheets, daily work reports and any other documents used for the propose of determining billing charges or operation costs for each task item.

(4) Material Safety Data Sheets: The Contractor shall provide a copy of the Material Safety Data

Sheets (MSDS) to the COR for each of the products used to perform services defined within the contract. The MSDS must be submitted to the COR prior to use of the materials on site.

(5) Insurances: The contractor shall maintain Insurances throughout the course of the contract to include but not limited to General Liability, Business Auto, Workers Compensation, Employers Practices Liability, Commercial Property, Flow Breakout Containment, Pollution

Coverage. Proof of insurances shall be provided to the government prior to commencement of work.

(6) Confidentiality: The well drilling and related services for the exploratory boring and potential production wells will be performed for the evidentiary support of water rights cases previously identified. All information furnished or produced under this contact, including but not limited to, drills logs, daily reports, documents, and correspondences will be and remain confidential to the BIA. The contractor shall not release information to any person, group of persons, firm, or organization other than the BIA of any information relating to the work performed, research or information derived from work performed under this contract. Breach of the confidentiality

agreement shall be deemed a substantial breach of this contract and may be grounds for rescission. The contractor may not use any products produced or knowledge gained from the work on this contract, before, during or after the determination of any legal action in which

Indian water right are at issue, directly or indirectly without specific written permission of both the Regional Director, BIA, Southwestern Regional Office, and the Governing Officials of the

Tribal Land in which the work was performed.

(7) Cooperation with others: The government, tribes and/ or pueblos may have other personnel in the same area in which the work is being performed. The contactor shall in the best interest of the government provide all necessary cooperation so work being performed by other entities within the region are not to be disrupted or hindered concurrent work of other contractors working within the region. The government will determine the prevailing degree of cooperation required by the contractor with other entities working within the region and disseminate the terms of such required cooperation to the contractor.

(f) REGULATIONS

(1) Occupational Safety and Health Administration (OSHA): The contractor shall adhere to all regulations set forth in (Standard – 29 CFR 1926 for all applicable subparts and sections)

(2) 19.27.4 New Mexico Administrative Codes (NMAC): Contractor shall adhere to all applicable subparts defined in 19.27.4 NMAC regulations. Any requests for drilling data or information from the state shall be referred to the Government to establish freedom of information precedence between the Federal Government and the State.

(3) Workman’s Compensation Act: In accordance with the State of New Mexico’s workers compensation administration guidelines, to include insurance in accordance with NM Stat §

52-1-10 (2017)

(4) Other relevant Federal laws, regulations, policies, and guidance, as well as pertinent Tribal ordinances, policies/procedures

(5) All regulations, policies, procedures, and reference material are subject to periodic modifications; therefore, only the most recent regulations, policies, procedures and reference material will be used for each forest mapping project.

The BIA will not provide copies of the documents.

SECTION E – INSPECTION AND ACCEPTANCE

E.1. 52.246-12 INSPECTION OF CONSTRUCTION (AUG 1996)

(a) Definition. “Work” includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.

(b) The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The

Contractor shall maintain complete inspection records and make them available to the

Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before

acceptance to ensure strict compliance with the terms of the contract.

(c) Government inspections and tests are for the sole benefit of the Government and do not—

(1) Relieve the Contractor of responsibility for providing adequate quality control measures;

(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;

(3) Constitute or imply acceptance; or

(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) of this section.

(d) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer’s written authorization.

(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary. The

Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.

(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.

(g) If the Contractor does not promptly replace or correct rejected work, the Government may—

(1) By contract or otherwise, replace or correct the work and charge the cost to the Contractor; or

(2) Terminate for default the Contractor’s right to proceed.

(h) If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction.
