Amendment # 1 140A0524Q0001, Kotzebue Remediation:

1. Should we include backfill material and backfilling of the excavation in our bid?

Yes, any excavated areas need to be returned to grade.

2. Are there any specifications for compaction of the backfill material?

All applicable tribal, local, state or federal; rules, codes, regulations, statutes and/or laws must be followed. If none apply to soil compaction densities, industry standard operating procedures will be used.

3. Should we place a liner in the excavation prior to backfilling?

Yes

4. Should we assume the excavation will extend to groundwater?

For planning, most likely, at least to the interface. Generally, GWD is roughly 4-6 ft.

5. Should we assume the landfarm will need a new bottom liner, top liner, and berms?

The last documented landfarm maintenance was conducted in 2020. Some or all of these components may require replacement or refurbishment.

6. Will the excavation limits be pre-determined, or will it be guided by field conditions?

Previous work indicates a general area for excavation; however, field conditions will dictate the specific area/volume of soil above applicable DEC cleanup levels on the site and able/possible to remove.

7. Will the excavation cease at 200 cubic yards, even if additional contamination is encountered; or will the excavation continue until all contamination has been removed?

Yes, the excavation will cease at 200 cubic yards, even if additional contamination is encountered; however, if contamination above applicable DEC cleanup levels does exceed 200 cy, this will be delineated.

8. The response to #7 it indicates that if contamination exceeds 200 cubic yards, the excavation will stop at 200 cubic yards but the remaining contamination will be delineated.

Would the standard confirmation sampling from the base and sidewalls of the excavation satisfy this delineation requirement, or would we need to excavate additional test pits beyond the limits of the excavation to determine how far the contamination extends?

Yes, excavation will stop at 200 cubic yards but the remaining contamination will be delineated. Standard confirmation sampling from the base and sidewalls of the excavation may satisfy this delineation requirement if they indicate that these are below cleanup levels. If not soil sampling would need to be extended, until below cleanup levels are encountered in order to determine the full extent of contamination above cleanup levels. This is the primary objective and shall be included in the award amount

9. The previous report suggests the existing landfarm is at capacity following previous excavations. Is there an existing landfarm with capacity to accommodate excavated soils?

The landfarm property is owned and operated by Kikiktagruk Inupiat Corporation (KIC) and is located off of Base Road in Kotzebue, POC: Thomas Baker, KIC Construction Operations Manager. It is the responsibility of the contractor to make contact with KIC as necessary.

10. Is the contractor responsible for backfilling the excavation? If so, can the excavation be backfilled prior to the receipt of analytical results?

Yes, any excavated areas need to be returned to grade. Yes, based on field screening results and consultation with AK DEC.

Amendment # 1 140A0524Q0001, Kotzebue Remediation:

11. Should the bidder include costs for backfill material or will this be provided by the village or other entity?

Yes, the bidder shall include costs for the backfill material.

12. Task 2 states the groundwater monitoring is to be completed in the fall of 2023, please confirm this is a typo and that the sampling is to be performed in 2024. Also, is the monitoring still required to be performed in the fall?

GWM will be conducted in the spring of 2024.

Sampling will be conducted in the spring/summer of 2024 after the melt/thaw when conditions allow. Sampling will not be conducted in the fall.

13. The period of performance is stated as being both six months from the initial contract award and as one year. Please confirm the period of performance.

The period of performance will be (1) year from the date of award.

14. Does the 200 cy include clean soils that may be encountered in surface soils, or is this limited to contaminated soils above maximum allowable concentrations?

Clean overburden, based on field screening and AK DEC consultations, can be segregated and replaced during return to grade.

15. Is there a maximum amount of soil to be excavated including both clean and contaminated?

If the contamination is confined to a thin layer a significant area and large volumes of clean soil would have to be excavated to remove 200 cy of contaminated soils.

Based on previous reports, BIA’s expectation is that any remaining and accessible contaminated soil is in two limited areas extending to permafrost (or the ground water interface) with some clean overburden. The potential maximum of contaminated soil removed is expected to be 200 cy or less.

16. In prior excavations liner was placed around the perimeter to delineate the excavation. Will this be required again and should the bidder include costs for a liner?

Yes, a perimeter liner to delineate the excavation is required and costs shall be included.
