About this file

This document is Amendment #2 to Request for Quote (RFQ) #140A0126Q0043 for Phase I Environmental Site Assessment (ESA) services for the Great Plains Regional Office (GPRO) of the Bureau of Indian Affairs (BIA). The amendment includes questions and answers addressing offeror inquiries regarding the solicitation.

The RFQ requires Phase I ESA services for eight properties located in North Dakota and South Dakota, with eight Contract Line Item Numbers (CLINs): Charles Fettig (CLIN 00010), Howard Fettig (CLIN 00020), Gladue (CLIN 00030), Bear Butte Tract (CLIN 00040), Leiseth I (CLIN 00050), Leiseth II (CLIN 00060), Johnson (CLIN 00070), and an unnamed eighth property (CLIN 00080). All assessments must follow ASTM E1527-21 standards and be conducted in individual reports for each site, with site visits available immediately upon award and BIA coordination of access. The due date for quotations was extended from September 3, 2026 to September 8, 2026 at 5:00 PM PT. The period of performance is one year, with all deliverables due by September 30, 2027. Contractors may submit invoices per line item upon delivery and acceptance of each individual Phase I ESA report. No TERO (Tribal Employment Rights Office) requirements apply. BIA will provide government escort for site access if needed and will coordinate with associated Tribes as required. The solicitation is a firm-fixed-price contract administered by BIA Pacific, with offerors required to acknowledge receipt of this amendment by completing blocks 8 and 15A-C of the Standard Form 30 and returning the completed page 1 with their quotation.

Phase I Environmental Site Assessment for GPRO

Amendment #2 Questions & Answers

1. The aerials provided for Attachment 2 C Fettig and Attachment 3 H Fettig appear to be the same. No, they are not the same. Please see the revised Attachment 3, map for HFettig.

2. General question across all 8 sites: are there any buildings on these properties? If so, which properties are developed and which are undeveloped land? BIA has no information about what is located on each site.

3. If the properties are developed, are they developed for residential, commercial, or industrial uses? (i.e., any gas stations associated with these properties?) BIA has no information about what is located on each site.

4. On the Bear Butte Tract, the aerial shows areas highlighted in purple and red. Can you confirm that we would be performing the Phase I ESA on the purple parcels? Both parcels are included, as shown by the legal description on the map provided.

5. Would the BIA like our Phase I ESA to include chain of title search and/or environmental lien search? No

6. Are there 3 parcels associated with Leiseth 1? If so, can BIA provide where the parcel on page 2 of Attachment 6 in located in relation to the two on Page 1? We are trying to determine if they are close enough to perform a single Phase I ESA report that covers all three parcels.

The maps have the legal description that identifies the parcel location. Although the parcels are not contiguous, they may be addressed in a single report.

7. Can BIA provide aerial maps for Attachment 4 Gladue and Attachment 8 Johnson? All currently available files have been provided.

8. Item No. 00010 and 00020: The figures for CFettig-Attachment 2 and HFettig-Attachment 3 show the same legal description for Charles Fettig. Please provide an updated figure for HFettig. See revised attachment.

9. Item No. 00030: No legal description or figure was provided for Gladue. Please provide a legal description along with a figure outlining the 65 acres. See revised attachment.

10. Item No. 00030 and 00060: For Gladue and Leiseth II, the description under Supplies/Services states, "inspect for hazardous materials." Please confirm whether any structures on these properties require a hazardous materials survey for asbestos, lead paint, and other typical materials inspected for during a Hazardous Materials Survey. It is unknown what structures are on the properties. The requirement to “inspect for hazardous materials” applies to all sites and refers to the standard Phase I Environmental Site Assessment (ESA) reconnaissance, which includes identifying potential environmental concerns.

11. Item No. 00070: No legal description or figure was provided for Johnson. Please provide a legal description along with a figure outlining the 487.68 acres. See revised attachment.

12. Can the Government provide shapefiles or KMZ files for the parcels? Contractor responsible for creating shape or KMZ files.

13. Will BIA coordinate access and escort to the parcels for the site reconnaissance phase of the site assessment? Yes

14. In the SAM listing, the map for Charles Fettig (CLIN 10) is the same as the Howard Fettig (CLIN 20) map and does not align with the legal description of the parcels. Is a map available that shows the Howard Fettig parcels of interest? Please provide relevant locational information (e.g., map, township, range, etc.). See attachments.

15. Maps are not presented for the Gladue (CLIN 30) and Johnson (CLIN 70) parcels. Are maps available for the Gladue and Johnson parcels? See attachments.

Amendment #2 Questions & Answers

16. Site questionnaires are provided for some parcels. Are completed questionnaires available for all eight parcels? If so, please provide. Also, will the Government provide updated “Questionnaire for Interview” responses? The responses provided are over 1 year old. All files currently available have been provided.

17. Have any of these sites had prior Phase ESAs? No

18. If so, will these reports be provided? No

19. Will the Government provide copies of available records noted in the Land Description and

Validation checklists? All files currently available have been provided.

20. Will Activity and Use Limitations (AULs) and Environmental Liens searches back to 1980 be required? All files currently available have been provided.

21. Will the Government provide available chain-of-ownership records for all properties? All files currently available have been provided.

22. The Howard F. Fettig line item is described as an undivided 24.97% mineral interest with no accompanying surface interest. Does the Government intend for the contractor to conduct surface site reconnaissance on this parcel? Yes

23. and if so, can BIA facilitate coordination with the surface estate owner? Contractor responsible for identifying and locating these individuals.

24. Section 1.5 and Amendment 0001 state a single Period of Performance of 09/24/2026 to 09/30/2027, but the SF-1449 schedule shows a Delivery date of 09/30/2027 for line items 00010–00030 and 09/30/2028 for line items 00040–00080. Can BIA clarify the correct delivery schedule for each line item? The period of performance is 1 year. All lines will end 9/30/27 on the final award.

25. Does BIA have current landowner and/or occupant contact information for each of the eight parcels to support the interview component of the assessment? Contractor responsible for identifying and locating these individuals.

26. Are there any access limitations that will need to be considered? None

27. Will all on-site structures be accessible? Yes with Government escort? If needed.

28. Is the Government able to provide TAAMS legal description printouts and any prior environmental investigation records (if they exist) for these parcels as government-furnished information, or is the contractor expected to obtain these independently? All files currently available have been provided.

29. Does BIA require a separate Phase I ESA Report for each of the eight parcels, or may parcels located in the same county be combined into a single report where appropriate? Individual report for each site listed in contract.

30. Does BIA have a preferred report template or format, or should the contractor prepare each report using its own ASTM E1527-21-compliant template? ASTM E1527-21-compliant template.

31. The SOW references "the current applicable ASTM standard" while the SF-1449 schedule specifies ASTM E1527-21. Please confirm E1527-21 is the applicable standard for this requirement. ASTM E1527-21 is the current applicable standard for this requirement.

32. Will a single BIA Technical POC be assigned for coordination across all eight sites, or will points of contact vary by parcel or by state (ND/SD)? Both are correct. There will be a POC at the Regional Office and POC’s at the agencies.

33. Will any direct coordination or consultation with the associated Tribes be required? Yes

Amendment #2 Questions & Answers

34. Will work in any of these project areas be subject to TERO requirements? If so, please identify applicable sites/locations/Tribes and provide the applicable TERO office contact information for each location. This project is not subject to TERO.

35. Given the requirement to price each line item individually, may the contractor submit invoices per line item upon delivery and acceptance of each individual Phase I ESA report, or is a single consolidated invoice required after all eight reports are accepted? The contractor may submit invoices per line item, upon delivery and acceptance of each individual Phase I ESA report.

36. We kindly request an extension to 9/10/26 to allow offerors adequate time to review the Government's responses and incorporate additional information into a complete and accurate quote. The RFQ is hereby extended to 9/8, 5pm PT

37. Issue 1 — SF-1449 pricing block instructions conflict

• Section 6.3 says: “Complete Block 20, on pages (2)-(4) of the SF-1449, for line item

00010-00080, reflecting the Firm-Fixed-Price.”

• But Block 20 is the Schedule of Supplies/Services description column, while the SF-1449 identifies:

• Block/column 23 = Unit Price

• Block/column 24 = Amount

• and the SF-1449 face says the offeror should complete Blocks 12, 17, 23, 24, and 30.

• Question to ask: Should offerors enter the FFP for CLINs 00010–00080 in Columns 23 and 24, rather than “Block 20” as stated in Section 6.3?

Yes, use blocks 23 and 24

38. Issue 2 — “Pages 2–4” do not contain all eight CLINs Section 6.3 says price CLINs 00010–00080 on pages 2–4.

But:

• 00010 begins page 2

• 00020–00030 are page 3

• 00040–00060 begin page 4

• 00060 continues onto page 5

• 00070 and 00080 are on page 5

• 00080 continues onto page 6.

Question to ask: Should the Section 6.3 reference to pages 2–4 read pages 2–6?

Yes, completed and return pages 2-6

39. Issue 3 — Period of performance / delivery dates conflict

• Amendment 0001 says: 09/24/2026–09/30/2027.

• The solicitation also describes the tentative performance period as award through 09/30/2027.

• However, several CLIN entries in the SF-1449 show Delivery: 09/30/2028, including later line items.

• That is a discrepancy.

Please confirm whether the final completion/delivery date for all CLINs 00010– 00080 is September 30, 2027, consistent with Amendment 0001, or whether any CLINs actually extend through September 30, 2028.

The period of performance is 1 year. All lines will end 9/30/27 on the final award.

Amendment #2 Questions & Answers

40. Issue 4 — Legal description or map is missing from Gladue Property

• Only provided information is the Realty Land Description Review Form and the questionnaire.

Question to ask: Where is the Gladue Property located? Is there a map or legal description available?

Map is attached, with legal description

41. Issue 5 — CLINs 00010 and 00020 are for the same property (Fettig); just for different proportions of surface or mineral rights. Yes

42. Are separate Phase 1 ESAs required for the Charles Fettig and Howard Fettig property? Yes

43. Will all sites be available for site visits immediately upon award? Yes Or would site visits need to be staggered over the period of performance? Not necessary

44. Will BIA coordinate site access permissions? Yes

45. Phase I Environmental Site Assessments are valid for 180 days prior to property transaction.

When are the property transactions scheduled? Transactions are scheduled after all Permit to Operate objections are cleared Will property transactions be staggered or all at the same general timeframe? Unknown what is being asked.
