About this file

This is a contract award document from Hillsborough County, Florida involving the Procurement Services Department and the Parks & Recreation Department. The file contains recommendations to award three-year Small Business Enterprise (SBE) Set-Aside contracts for ongoing and as-needed common grounds mowing services at various parks throughout the county. The work is divided into 12 geographic zones, with bids received from 19 different suppliers. The response due date was December 22, 2022, and the contract award was scheduled for board consideration on February 1, 2023 (Agenda Item A-42). The total contract value for all awards is $5,594,712.14, which includes allowances of $15,000 per vendor for unspecified services and materials that cannot be defined at the time of contract execution. The contract was designated as a Small Business Enterprise Set-Aside, making the Disadvantaged Minority/Disabled Women Business Enterprises (DM/DWBE) program requirements inapplicible.

The five awarded vendors are Mendez All Services, LLC ($1,072,801.00 for Zones 7, 8, and 12); Martinez Frank LLC ($1,190,969.00 for Zones 6, 10, and 11); Bella Luna Services LLC ($1,356,582.00 for Zones 1, 2, and 3); Ramos Top Pro-Services LLC ($625,947.00 for Zone 5); and Phinazee Construction & Consulting Services, Inc. ($1,348,413.14 for Zones 4 and 9). All recommended vendors are registered as SBE and certified DM/DWBE firms. The bid submitted by Aero Groundtek, LLC was rejected as nonresponsive because the company failed to meet the material requirement of SBE registration. The recommended award amount represents approximately 16.1% ($1,075,287.86) savings below the county's department estimate of $6,670,000. Funding is available in the Parks & Recreation Department's approved budget, and the procurement was conducted through competitive sealed bidding to achieve effective competition and transparency. All recommended pricing was determined to be fair, reasonable, and consistent with previous purchases of similar services.

Mr. Luke Blackson Aero Groundtek LLC 858 Macguire Road Ocoee, FL 34761

Subject: RFQ 23684,6 Common Grounds Mowing Services (SBE Set-Aside)

Dear Mr. Blackson, We sincerely appreciate your firm’s participation in the above-referenced procurement process. After careful consideration, your firm’s bid submission has been deemed nonresponsive for failing to provide the necessary documentation in accordance with the Contract Terms. On November 14, 2022, the County requested the Responsibility Survey to be completed and returned. In response, on November 18, 2022, your firm notified the County that your firm does not meet the specified Small Business Enterprise (SBE) requirement. Because the specified SBE requirement is material, a determination of nonresponsiveness is necessary. As a result of this determination, staff will recommend that your firm’s bid be rejected. It is important to note that no other aspects of your firm’s response were evaluated; therefore, there may be other deficiencies not described in this letter.

A responsive bidder generally means a bidder or proposer who has submitted a response to a solicitation, which conforms in all material respects to the requirements set forth in the same. When the bidder fails to meet one (1) or more material requirements of a solicitation, it must ultimately be deemed nonresponsive. Awarding a contract to a bidder whose response did not meet the bid requirements is contrary to public policy, injures the integrity of the procurement process, and irreparably damages the public’s confidence.

Should you have any concerns or objections to this finding, you are required to address them in accordance with the Protest Ordinance. You must submit your concerns, in writing, to my office no later than five (5) working days after receipt of this notice. This letter is being sent on the date above, and the five (5) day period begins on the business day following the date of this letter. Any concerns or objections expressed must also include all pertinent documents, information, and evidence necessary to support your position. If you choose to submit a rebuttal, we will give your concerns or objections our fullest consideration.

Mr. Luke Blackson December 13, 2022 Page Two (2)

Please also be reminded that a Cone of Silence remains in-effect for this particular procurement to safeguard the integrity of the procurement process. Pursuant to Section 2-574 of the Protest Ordinance, the Cone of Silence prohibits bidders/offerors from communicating with County employees, members of the Board of County Commissioners (including their aides and employees), and the Hearing Master regarding a procurement solicitation and/or its related protest. However, the Cone of Silence does not prohibit your company from communicating with me or the person(s) listed as contacts in the solicitation.
