About this file
This is a Questions and Answers document for the 1333ND26RNB190004 CUP Modernization Solicitation, addressing clarifications on proposal submission requirements and evaluation criteria. The Phase 1 proposal due date is 1:00 pm EST on March 16, 2026, with no extensions granted due to programmatic requirements and the Government's need to ensure contract award within Fiscal Year 2026. The Government maintains a 60-page limit for proposals, with specific exclusions for Past Performance Questionnaires (PPQs) and Contractor Performance Assessment Reporting System (CPARS) documentation. Attachments such as surety letters and letters of commitment count toward the page limit, as do resumes and project data sheets. Offerors must include the executed SF1442 and all applicable amendments in their proposal submissions.
The solicitation requires $575.2 million in aggregate bonding capacity for the overall project across all phases, not a single-project requirement. Companies that prepared the Program of Requirements for Central Utility Plant Facility (Attachment B and C) and Master Planning Documents are subject to the Limitation of Future Contracting provision and are prohibited from participating in the construction contract unless expressly approved by the head of the contracting agency. The identity of the Construction Manager, engaged under a separate Government contract, is not material to offer preparation and will not be disclosed at this time. Previously completed PPQs relevant to current proposal projects may be included in submissions. Q&A responses from the previous solicitation 1333ND26RNB190001 remain applicable and will be reissued without requiring offeror resubmission.

Questions and Answers
1. We kindly request an extension to the proposal due date of two weeks (March 30, 2026).
Response: No extension will be granted for Phase 1. The proposal due date remains unchanged due to programmatic requirements and the Government’s need to ensure contract award within Fiscal Year 2026. Maintaining the current schedule is necessary to meet mission and funding timelines.
2. Are attachments (e.g., surety letter, letters of commitment, etc.) excluded from the page count?
Response: Attachments such as surety letters, letters of commitment, and similar supporting documentation shall be included in the page count, as these materials support and substantiate the Offeror’s qualifications.
3. Is there a specific location the SF1442 and amendments should be included in the proposal response?
The executed SF1442 and all applicable amendments shall be included in the proposal submission.
Offerors are responsible for ensuring these documents are completed, signed, and incorporated in accordance with the solicitation instructions.
4. Section Phase 1, Factor 3, Item 2.a.i indicates that PPQs should be included in the proposal. However, Item 2.c.i indicates PPQs should be submitted directly from the client to the Government’s Point of Contact. Please confirm how PPQs should be submitted.
Response: These are requirements for two different situations. Section L, Phase 1, Factor 3, Item 2.a.i applies when the Offeror is able to obtain and submit the Past Performance Questionnaire (PPQ) by the proposal closing date. In such cases, the PPQ shall be included within the proposal submission.
Section L, Phase 1, Factor 3, Item 2.c.i applies when the Offeror is unable to obtain the completed PPQ by the proposal closing date. In such cases, the PPQ shall be submitted directly by the client to the Government’s designated Point of Contact, as specified in the solicitation.
Offerors shall comply with the applicable provision based on their specific circumstances.
5. If PPQs are included in the proposal, are they excluded from the page count as well as CPARS?
Response: In accordance with Section L, Phase 1, Factor 3, Item 2.a.i, PPQs do not count toward the 60-page limit. Contractor Performance Assessment Reporting System (CPARS) documentation likewise does not count against the 60-page limit.
6. The previous solicitation’s Q&A document indicated that previously completed PPQs may be submitted for this response. May these be included in the proposal from the Offeror?
Response: PPQs that are available and that substantiate past performance for relevant projects identified in the proposal shall be included in the proposal submission in accordance with Section L, Phase 1, Factor 3, Item 2.a.i.
7. Should Offeror consider all Q&A responses from the previous solicitation authorized for this solicitation as well? Or do we need to resubmit clarifying questions?
Response: Responses to Q&A issued under the previous solicitation remain applicable (see note on page one (1) of the Q&A response form from the original solicitation 1333ND26RNB190001 ) to this solicitation and will be reissued in conjunction with the current solicitation responses. Offerors are not required to resubmit previously addressed questions.
8. If we need to resubmit questions from the previous solicitation period, please see the following:
Response: See the response to Question 7. Previously issued and applicable Q&A responses will be reissued; resubmission is not required. See reissued response for answers to questions 8.a, 8.b, & 8.c below.
a. Are resumes included in the page count?
Response: Yes.
b. Are project data sheets included in the page count?
Response: Yes.
c. May previously submitted PPQs be used in this response? If so, may they be included in the Offeror’s proposal response?
Response: Previously completed PPQs may be used, provided they are relevant to the projects identified in the current proposal. When available, such PPQs shall be included in the Offeror’s proposal submission in accordance with Section L, Phase 1, Factor 3, Item 2.a.i.
9. Current due date for Phase I submissions is 1:00 pm EST on March 16, 2026, which is only fifteen calendar days from the initial solicitation date. Given the requirements of the submission, which include but are not limited to, surety letter, detailed approach narratives, and PPQs for project examples that don't have a CPARS, CCASS, or ACASS we respectfully request the submission deadline be extended to a minimum of 1:00 pm EST on April 6, 2026.
Response: See Response to Question 1.
10. Please provide clarity on the $575.2M bonding capacity required for Phase I, Factor 1. Is this a single project capacity requirement or an aggregate requirement for all project phases? Our interpretation, based on this project being executed in parts, assumes this is the aggregate requirement; also, given the previous iteration of the request explicitly requested a $150M single project requirement.
Response: The $575.2 million bonding capacity referenced under Phase I, Factor 1 represents the aggregate bonding capacity requirement for the overall project. It is not a single-project bonding capacity requirement.
Offerors are advised to rely solely on the requirements as stated in the current solicitation, as prior versions of the solicitation are superseded by the present issuance.
11. Specification Section 011000-Summary, Subsection 1.3 PROJECT INFORMATION, Item D.
Construction Manager, Subitem 1. states:
• “Construction Manager has been engaged for this Project to serve as an advisor to the Government and to provide assistance in administering the Contract for construction between
• the Government and Contractor, according to a separate contract between the Government and Construction Manager.”. Can the Government please provide the name of the Construction Manager?
Response: The Government acknowledges the referenced provision. The Construction Manager referenced in Section 011000 is engaged under a separate contract with the Government.
At this time, the identity of the Construction Manager is considered part of a separate contractual arrangement and is not material to offer preparation under this solicitation. The Construction Manager does not have contractual authority over the Contractor and will not perform construction work under this procurement. All contractual direction will be issued solely by the Government’s Contracting Officer.
Accordingly, no additional information is required for purposes of proposal submission. Should the Government determine that disclosure of the Construction Manager’s identity is necessary, such information will be provided by formal amendment.
In addition, the contract for Construction Management is not currently awarded. The name of the Construction Manager cannot be provided.
12. Page 167 of 208 in the document entitled 1333ND26RNB190004+CUP+Modernization+Solicitation+ states:
Limitation of Future Contracting:
“No contract for the construction of this project shall be awarded to the firm that prepared the project design, or to any of its subsidiaries, affiliates, or entities under common control, except where such award is expressly approved by the head of the contracting agency or an authorized designee. Architect-Engineering (A-E) firms responsible for preparing the performance requirements, design criteria, or other foundational design documents for this procurement are prohibited from participating, whether directly or indirectly, in any capacity under this construction contract. This prohibition extends to parent companies, subsidiaries, affiliates, joint venture partners, consultants, subcontractors, and any other firms or individuals who participated in the development of the project’s performance requirements.” Please confirm that the companies that prepared Attachment C_CUP+POR+APP (“Program of Requirements for Central Utility Plant Facility” dated June 2024) and the Master Planning Documents for this project are prohibited from performing on this contract?
Response: The companies the prepared Attachment B CUP POR & Attachment C CUP POR APP are subject to the Limitation of Future Contracting and are prohibited from performing on this contract.
The Limitation of Future Contracting provision set forth in the solicitation governs eligibility for award and participation in this construction contract. As stated, firms that prepared the project design, performance requirements, design criteria, or other foundational design documents for this procurement—and their parent companies, subsidiaries, affiliates, entities under common control, joint venture partners, consultants, and subcontractors involved in such preparation—are prohibited from participating in this construction contract unless an exception is expressly approved by the head of the contracting agency or an authorized designee.
To the extent that any firm prepared Attachment C_CUP+POR+APP (“Program of Requirements for Central Utility Plant Facility,” dated June 2024) or the Master Planning Documents and such work constitutes preparation of performance requirements, design criteria, or other foundational design documents for this procurement, those firms and related entities would be subject to the Limitation of Future Contracting provision.
13. Please advise if this is possible to allow us (and our competition) to present you with the best product possible.
Response: See response to Question 1. No extension will be granted for Phase 1. The proposal due date remains unchanged due to programmatic requirements and the Government’s need to ensure contract award within Fiscal Year 2026. Maintaining the current schedule is necessary to meet mission and funding timelines.
