About this file
This document is an Amendment 01 for a federal solicitation (1333ND25QNB030154) issued by the National Institute of Standards and Technology (NIST) for an X-ray Photoelectron Spectroscopy (XPS) System. The amendment provides clarifications on two key vendor questions: tariff considerations and specimen holder usage. For tariffs, NIST instructs vendors to include a separate line item with a Not-To-Exceed amount covering potential tariff costs, requiring clear identification of country of origin, tariff percentages, and associated total costs.
Regarding the XPS system's specimen holders, NIST clarified that while three large specimen holders (60 mm diameter) are specified, only one will be used in the analysis chamber at a time. The additional holders are intended for sample preparation in other laboratory spaces or for sample transfer between vessels. The solicitation seeks a comprehensive XPS system with specific technical requirements, and vendors must carefully address both the technical specifications and potential tariff implications when preparing their quotes.

Amendment 01: Combined Synopsis/Solicitation 1333ND25QNB030154 XPS System June 13, 2025
The purpose of this amendment is to provide a consolidated list of responses to all questions received in response to this solicitation. See below for all Questions (Q) and Answers (A):
Q1. Is this project exempt from tariffs since it is a semiconductor tool?
A1. How a product is classified in the Harmonized Tariff Schedule of the United States (HTSUS), which can be found at https://hts.usitc.gov/, is determined by customs, so NIST cannot verify whether your product would fall under the exemption for semiconductors. Below contains a list of headings and subheadings of the HTSUS, which would qualify under the semiconductor exemption:
https://www.whitehouse.gov/presidential-actions/2025/04/clarification-of-exceptions-under-executive-order-14257-of-april-2-2025-as-amended/ In your price quote, include a separate line item with a Not-To-Exceed (NTE) amount to cover up to the potential tariff amount. This amount must only apply to the total value of the goods identified for customs processing. It shall only include the country of origin and the tariff percentage currently in place or the expected amount at time of delivery for that country. Price quotes shall clearly identify the relevant tariffs in terms of percentage and total cost. If there are multiple countries of origins and associated tariffs, identify each separately.
Q2. Reference Section 1.3.2.5 Three large specimen holders to be used in conjunction with the auxiliary chamber/transfer vessels outlined in section 1.14. Do you need all three of these holders to be in the instrument at the same time for analysis or are these extra holders and your intention would be one at a time?
A2. The large specimen holders are the same sample holders (60 mm diameter; 1.14.1.1) referenced in 1.14 for use in the 2 transfer vessels (1.14.1) and the auxiliary chamber (1.14.2). For analysis/data acquisition, NIST only envisions one of these holders being within the XPS system’s analysis chamber at a time. As suggested in the question, the extras would be for sample preparation in other laboratory spaces, or for use in transferring samples in one of the transfer vessels.
