Questions
| Document | Page # | Section | Question/Comment | Answer |
| RFP | 2 | SF33 Block 9 | If not electronic delivery, will the Government provide additional details on delivery location and address? | Per Section L.1 of the solicitation, proposals and all correspondence associated with this solicitation shall be submitted via email to Adam Powell and Lauren Roller at adam.powell@nist.gov and lauren.roller@nist.gov, respectively. |
| RFP | 7 | B.1 | Can someone serve as the Program Manager and serve as one, or multiple, of the technical expert positions as well? | Yes. A single individual may serve as the program manager and one or more technical expert roles. NIST does not anticipate that program management will require full-time support in most cases. |
| RFP | 7 | B.1 | For labor categories that have multiple levels, can the same individual serve in multiple levels or must a unique individual be designated for each? | Yes. However, offerors should keep in mind that providing overqualified staff for lower level labor categories may impact their competitiveness for task ordering. |
As a reminder, this RFP does not require that an individual be tied to every labor category in the Schedule of Labor Categories. Specific personnel are only required for the mock task order responses, and task orders under awarded IDIQ contracts.
RFP 7 B.1 Is the Primary Track IDIQ company required to fill all labor categories, either themselves or through teaming agreements? For teaming agreements, will these be required to be identified during the IDIQ proposal process or only at each task order, if awarded? Yes, prime contractors must be able to fill all labor categories in the Schedule of Labor Categories themselves or via subcontracting. The Schedule of Labor categories will govern what labor categories can be proposed, and at what rates, for task orders against awarded IDIQ contracts.
Subcontractors are not required to be identified during the IDIQ proposal process (unless otherwise noted in the revised RFP due to providing subcontractor demonstrated prior experience), only during the task order proposal process.
| RFP | 7 | B.1 | Are vendors able to substitute advanced degrees for equivalent years of experience ? For example, could a position requiring a Ph.D and 15 years of experience be substituted for by someone with a Master's degree with 20 years of experience)? | No, substitutions are not acceptable. |
| RFP | 8 | L.4.3.1 | Does the government anticipate awarding task orders from the resulting Mock Task Orders following evaluation? If not, will the government consider removing the requirement for mock task order key personnel resumes? | No. The Government will not award any of the Mock Task Orders. |
Key personnel resumes are still required for the Mock Task Orders.
| RFP | 52 | C.1.III.D | The SOW states, "This support may require on-site personnel to ensure necessary interaction with the NIST staff." Please identify more details on requirements for on-site personnel (location, schedule, duration, number of personnel, etc.) or confirm this would be a task order specific requirement. | On-site personnel requirements will be task-order specific. |
| RFP | 54 | VIII Payment Schedule | What is the average expected approval timeline on the acceptance of deliverables by NIST? | This will depend upon the product being delivered and will be outlined in task orders. Please see the deliverables section of the mock tasks orders, which includes details on evaluation of deliverables, for sample information. |
| RFP SOW | 75 | C.4 | Is the Fires Track Mock Task Order currently being performed on another contract? If yes, will the Government identify the incumbent contract number? | No. None of the mock task orders are currently being performed. |
| RFP | 88 | G.1 | Is it anticipated that some task orders covering services for fire or earthquake specific incidents will be issued under the Primary Track or is it expected that all task orders for these subjects will be issued under the Specific Tracks only? | Task orders may be issued under any track. The Government will have sole discretion to determine which category a task order is applicable to. However, the IDIQ contract is designed with tracks reserved for small businesses because we intend to use them. |
| RFP | 88 | G.1 | Please confirm the Primary Track IDIQ company is not required to have established agreements with small businesses or to subcontract any portion of the Primary Track work to small businesses? | No, this is not correct. The Primary Track IDIQ contractor(s) are required to have small business subcontracting plans and to make their best effort to meet or exceed the negotiated goals. |
| RFP | 88 | G.1 | Can a Primary Track IDIQ proposer also serve as a subcontractor to a small business on a Specific Track IDIQ? | Yes. The small business prime contractor for a Specific IDIQ track, however, shall be in compliance with FAR 52.219-14 Limitations on Subcontracting. |
| RFP | 88 | G.1 | Is it possible to open up specific categories to contractors of all business sizes? | No. The Specific Categories are set aside only for small businesses. |
| RFP | 160 | J | For Phase Two of the Proposal Submission, we wanted to confirm that the mock scenario for which firms will respond are the scenarios listed in Section J (and there will not be other mock scenarios). Is this correct? | Yes, this is correct. The mock scenarios in Section J are the only scenarios requiring response (as applicable based on which track(s) a contractor is proposing for). |
| RFP | 165 | J - June 2024 Fake Town | Key Personnel requirements list "Program Manager" with a minimum education requirement of a PhD degree. This is in conflict with "Program Manager (Contract Level and/or Task Order Level) listed in Section B., Labor Categories (page 7). Does Section B supersede the task orders? | The mock task order key personnel requirements have been updated in the RFP. The Schedule of Labor Categories has also been updated. |
| RFP Mock Task Order Primary | 165 | Mock Task Order Primary Section G | For the mock task order, the definition of the Program Manager is different than that listed for the IDIQ. Was that intentional? Should that be updated to match the IDIQ Program Manager? Or should that key personnel be changed to Task Order Manager? | The mock task order key personnel requirements have been updated in the RFP. The Schedule of Labor Categories has also been updated. |
| RFP Mock Task Order Primary | 166 | Mock Task Order Primary Section H | Are offerors required to provide travel estimates given that a ceiling of $25,000 is provided in the SOW for the primary track mock task order? If so, will that be included in the page count? | No. The solicitation has been revised so that travel estimates are not required. |
| RFP | 213 | L.1 | Will the Government allow for 10 point font for graphics, figure text and tables? | No. All text shall be 12-point font, Times New Roman. |
| RFP | 216 | L.2, L.3 | Will there be a Q&A opportunity as part of Phase 2? | As stated in Section L.3, it is not the Government's intent to allow for any further Q&As. However, we reserve the right to conduct an additional round if necessary. It is highly unlikely we will have a separate Q&A session as part of Phase 2. |
| RFP | 216 | L.3 | Will NIST allow for an additional questions to be submitted following Advisory Notifications prior to the Phase 2 Submission deadline? | As stated in Section L.3, it is not the Government's intent to allow for any further Q&As. However, we reserve the right to conduct an additional round if necessary. It is highly unlikely we will have a separate Q&A session as part of Phase 2. |
| RFP | 216 | L.4 Proposal Instructions | Please clarify whether the proposal cover and the cover letter will be included or excluded from the Technical Volume page count. | Cover letters are not included in the page limits for submissions as cover letters are not required and will not be evaluated. |
The RFP has been revised to require one cover page each for the Phase 1 and Phase 2 submissions. Please find revised page limitations and cover page instructions in revised Section L.
RFP 217 (i) Could one of the projects included have been performed by a subcontractor on the Team without involvement from the Team's prime? Yes; the solicitation is revised to allow one of the three demonstrated prior experience examples to be from a subcontractor without involvement from the Team's prime. If subcontractor demonstrated prior experience is provided, the subcontractor's basic information shall be provided.
Please note, however, that Section M is revised to state that demonstrated prior experience from the prime contractor may provide greater confidence during evaluation than demonstrated prior experience from a subcontractor.
| RFP | 217 | L.4.1 | Please confirm that the Phase I submission should not include identification and resumes, or a write up of qualifications, for key personnel. | Yes, confirmed. In accordance with solicitation Section L.4.1, the only Phase 1 requirement is the written submission of Factor 1 - Demonstrated Prior Experience. |
| RFP | 217 | L.4.1 | In the eight pages required for the Phase 1 submission, it does not appear that a cover page/cover letter is requested or permitted (3 pages for project descriptions, 5 pages of answers to questions). Is this correct? | Cover letters are not included in the page limits for submissions as cover letters are not required and will not be evaluated. |
The RFP has been revised to require one cover page each for the Phase 1 and Phase 2 submissions. Please find revised page limitations and cover page instructions in revised Section L.
| RFP | 217 | L.4.1 | We are planning to identify the track for which we are submitting at the top of the first page of the Phase 1 submission. Is there a specific way this should be identified on the document? | Yes. The RFP has been revised to require one cover page each for the Phase 1 and Phase 2 submissions. Please find revised page limitations and cover page instructions in revised Section L. |
| RFP | 217 | L.4.1 | Should a title page, title sheet, executive summary, and/or table of contents be included with the Phase 1 technical volume submittal? | The RFP has been revised to allow one cover page each for the Phase 1 and Phase 2 submissions. The cover page shall include the offeror name, contact information, and Unique Entity Identifier (UEI). The cover page shall also identify which track(s) the proposal is submitted for. No cover letter, executive summary, or table of contents is required. |
| RFP | 217 | L.4.1 | Is the Program Manager required to be named in the Phase 1 submission? If so; where? | No, the Program Manager is not required to be named in the Phase 1 submission. |
| RFP | 217 | L.4.1 | Are specific subcontractors required to be named in the Phase 1 submission? If so; where? | Specific subcontractors shall only be named if subcontractor demonstrated prior experience is provided as part of the Phase 1 submission. |
| RFP | 217 | L.4.1 (i) | Do project descriptions need to focus on a singular project, or can they reference a contract containing multiple projects? | Yes, demonstrated prior experience examples shall be for three stand-alone awards. Each of the awards may be under a single IDIQ or BPA, however. |
| RFP | 217 | L.4.1 (i) | Is it acceptable to include a cover letter, and if so, can NIST confirm this cover letter will not count toward the 8-page limit? If the cover letter is not acceptable, can content other than the three project descriptions be included in the three pages dedicated to the project description information? | No. Cover letters are not included in the page limits for submissions as cover letters are not required and will not be evaluated. |
No. Content from other than the three examples of demonstrated prior experience may NOT be included.
| RFP Section L - Instructions, Conditions, and Notices to Offerors | 217 | L.4.1.i | The instructions state that "Projects must be during the last five years from release date of the solicitation". We interpret this to mean that the projects must have been completed or substantially completed within the last 5 years. Is that correct? | Yes, that is correct. RFP Section L has been revised to clarify. |
| RFP | 218 | L.4.1 | Can NIST please confirm that prime contractors can include subcontractor qualifications and past performance in their Phase 1 submission? | The Phase I response requirements do not include past performance; they include demonstrated prior experience. |
The solicitation is revised to allow one of the three demonstrated prior experience examples to be from a subcontractor without involvement from the Team's prime. If subcontractor demonstrated prior experience is provided, the subcontractor's basic information shall be provided.
Please note, however, that Section M is revised to state that demonstrated prior experience from the prime contractor may provide greater confidence during evaluation than demonstrated prior experience from a subcontractor.
| RFP | 218 | L.4.1 | Can a vendor submit a proposal as the prime contractor for the primary track submission and also be a sub to a small business on one of the specialized (non-primary) tracks? | Yes. |
| RFP | 218 | L.4.1 (iii) | Can NIST please confirm that respondents are permitted to reference their team’s broad corporate experience when responding to the questions in its Phase I submission, and are not limited to only referencing experience from the three projects descriptions submitted under paragraph (ii)? | No. The Phase 1 submission is limited to the required information identified in Section L.4.1 of the solicitation. |
| RFP Section L - Instructions, Conditions, and Notices to Offerors | 218 | L.4.1.iii | The instructions state that "the other five pages are for the offeror to address questions for each track under which the offer submits a proposal using experience from the three projects it submitted for paragraph ii of this section." Can the offeror include other past experience to address the questions in addition to that of the three projects for which it provides examples? | No. The Phase 1 submission is limited to the required information identified in Section L.4.1 of the solicitation. |
| RFP | 222 | L.4.3 | Should a title page, title sheet, executive summary, and/or table of contents be included with any of the 5 volumes for submittal for Phase 2? |
The RFP has been revised to require one cover page each for the Phase 1 and Phase 2 submissions. Please find revised page limitations and cover page instructions in revised Section L.
No cover letter, executive summary, or table of contents is required.
| RFP Section L - Instructions, Conditions, and Notices to Offerors | 222 | L.4.3 | In the Instructions, the table in Section L.4.3 lists the volumes for Phase 2 as Volumes 1, 2, 4, and 5. Please confirm that these should be volumes 2, 3, 4, 5 since Volume 1 is required for Phase 1. | The RFP has been revised to correct the discrepancy. A Cover Page has been added and the remaining volumes are renumbered accordingly. | |
| RFP | 222 | L.4.3.1 | Instructions state "The offeror shall submit a technical approach and key personnel for the mock task order | ||
| relevant to their chosen scope track(s)." Can you please clarify which of the 4 sample task orders is for the "primary" track? | The primary track mock task order is the one at Section J.1 on page 160 of 239. The mock task orders are identified in the table of contents. However, the RFP is now revised so that the mock task orders are more clearly identified in each document as well. | ||||
| RFP | 222 | L.4.3.1 | For Factor 2; should resumes for all key personnel for the mock task order be provided? Would these count towards the page count for Volume 1 of Phase 2? | Yes, resumes are required for all mock task order key personnel. Key personnel resumes are excluded from the page limit for Phase 2 Factor 2 - Mock Task Order Approach. Key personnel resumes are limited to two pages each. | |
| RFP | 222 | L.4.3.1 | Are offerors required to provide the six key personnel resumes for our proposal response as part of the mock task order approach? If resumes are required, will the resumes be excluded vs. included as part of page count? | Yes, resumes are required for all mock task order key personnel. Mock task order key personnel requirements have, however, been revised. |
Key personnel resumes are excluded from the page limit for Phase 2 Factor 2 - Mock Task Order Approach. Key personnel resumes are limited to two pages each.
| RFP | 222 | L.4.3.2 | Will the Government confirm that the PM resume is excluded from page count? | Yes, key personnel resumes are excluded from the Mock Task Order Approach page limitation. |
| RFP Section L - Instructions, Conditions, and Notices to Offerors | 222 | L4.3.1 | The instructions state that "the mock task order approach page limit includes key personnel resumes". Given that the page limit for this section is 6 pages and there are multiple key personnel listed, can you please reconsider such that resumes would not count against the page limit? Or is the intention for bios of key personnel to be provided instead of full resumes. | The RFP has been revised as follows: |
Key personnel resumes are excluded from the page limit for Phase 2 Factor 2 - Mock Task Order Approach.
Key personnel resumes are limited to two pages each.
| RFP Section L - Instructions, Conditions, and Notices to Offerors | 222 | L4.3.2.ii | The instructions require the proposed IDIQ Program Manager's resume to be included in the IDIQ Management Approach Volume. Will the resume will be counted against the page limit? | No, the resume will not count towards the page limit. |
| RFP | 223 | L.4.3.2(iv), Section B | Is the intent of providing a list of proposed labor categories, per Section L.4.3.2(iv), to recreate the list of labor categories shown in Section B while also adding in new labor categories at the offeror's discretion? | Yes. Offerors are not required to add new labor categories but may do so. |
| RFP | 223 | L.4.3.2(iv), Section B | If the offeror does not believe a specific labor category listed in Section B is applicable to its track (for example, Explosive Blast Engineer for the Earthquake Track) should this labor category be left out of the list of proposed labor categories? If so, how should the offeror evaluate which labor categories will be required or not? | It is anticipated that all labor categories may be needed for the primary track, but not all labor categories will be required for the earthquake, fire, and evidence preservation tracks. |
Offerors may choose to not propose labor categories that it does not believe to be relevant to the track(s) for which it is responding. However, in the event of an IDIQ contract award, the offeror would be limited to proposing labor categories in its IDIQ contract. If a task order required labor categories not in an offeror's IDIQ contract, then the offeror could not propose them.
| RFP | 223 | L.4.3.3 | The requirement to rapidly deploy a team of specialized engineers within 48 hours following a disaster event will often create a disruption to existing project work. Will NIST accept two sets of rates for relevant labor categories--one for "standard" consulting services, and one for "rapid deployment/emergency response"? | No. The labor rates submitted for the price submission shall be one standard rate for each labor category. If, at time of task ordering, an offeror decides that a rapid turn around affects any ongoing projects or availability of personnel then they should factor that into their submitted task order quote to the Government. The offeror is in charge of how much an IDIQ ceiling rate is discounted for each task order, including any requiring a 48-hour turnaround after a disaster event. |
| RFP | 223 | L.4.3.3 | Where the Instructions state "…for each proposed labor category detailed in the Offer's Technical Volume;" could you clarify? The Technical Volume submitted during Phase 1 does not require key personnel to be named. Rather is this referring to Volume 1 "Factor 2 - Mock Task Order Approach" of Phase 2 so only the ceiling fully burdened hourly labor rates for the Key Personnel required by the Mock Task Order scenario will be provided? | Yes. Section L.4.3.3 Business/Pricing Proposal (titled L.4.3.4 Business/Pricing Proposal in the revised RFP) requires ceiling fully burdened hourly labor rates for all labor categories in the proposed IDIQ Contract Schedule of Labor Categories. |
| RFP | 223 | L.4.3.4 | Is there a target small business subcontracting goal that should be met? | No, there are no specific targets. Small business subcontracting goals are expected to be reasonable, but ambitious, for the services to be provided. |
While there are no specific targets, please see Appendix B-1, page 19, in the following link to Commerce Acquisition Manual 1319.70, which shares the FY2024 Prime Contracting and Subcontracting Goals for the Department of Commerce and may be used as a general guide.
https://www.commerce.gov/sites/default/files/2024-02/CAM%201319.70%20-%20SB%20Programs%20February%202024%20%281%29.pdf RFP 223 L.4.3.4, M.5 Factor 3 The RFP appears to state that offerors who are small businesses do not need to include a small business subcontracting plan per Section L.4.3.4. In Section M.5 Factor 3 it is stated that small businesses will be evaluated on their plan to ensure that the limitations on subcontracting rules would be complied with. Instead of a small business subcontracting plan, should small businesses use this section to discuss their plan for staying in compliance with FAR 52.219-14? Small Business Subcontracting Plans (required only from Other than Small Businesses) will be evaluated but not rated per Section M.8.
Factor 3 of Section M.5 is titled "IDIQ Management Approach." The "plan" identified in the third bullet of this factor was intended as the small business offeror's approach for staying in compliance with FAR 52.219-14. The bullet has been revised to clarify the intent.
| RFP | 223 | L4.3.3 | In Section L4.3.3 it is stated to propose "ceiling" fully burdened hourly labor rates. Does "ceiling" in this context mean that these labor rates are the highest rates that would be charged for each labor category? | Yes. The ceiling rates for the IDIQ are fixed and may not be exceeded during task order competitions. However, it is common that these ceiling rates are discounted during competitive task ordering. |
| RFP | 223 | L4.3.3 | Section L4.3.3 indicates that labor rates should be provided for "on-site" and "off-site". Based on the descriptions of the work in other portions of the RFP, it seems unlikely that the contracted work would be occurring "on-site" (aka a Government Site). Is it necessary to provide both "on-site" and "off-site" labor rates? | The RFP has been revised to require only one ceiling labor rate per labor category per year. The ceiling labor rate may be discounted during task order competitions for on-site purposes. |
| RFP | 1, 215 | SF33 Block 9 and Section L.1 (v) | Will the Government clarify that submission and delivery is electronic only vs. delivery to NIST AMD Depository? | Yes. Per Section L.1 of the solicitation, proposals and all correspondence associated with this solicitation shall be submitted via email to Adam Powell and Lauren Roller at adam.powell@nist.gov and lauren.roller@nist.gov, respectively. |
| RFP | 1, 216 | SF 33 and L.2 | Will the Government allow for a 10 day extension from the time answers to questions are posted? This additional time will allow offerors to thoroughly review the solicitation and attachments, determine any impacts to their existing proposal response, and adjust their responses accordingly. | No. |
| RFP | 218, 219 | L.4.1 | Questions 2 and 5 are similar questions related to subject matter expertise and experience with field data collection. Please clarify the distinct disaster response and recovery activities meant to be addressed in the response to each question. | Question 2 is intended to address data collection performance and ability to mobilize quickly to do so. |
Question 5 is intended to address ability to determine data collection needs, as well as ability to develop the necessary tools.
The questions in Section L have been revised to clarify.
RFP 221, 222 L.4.3, L.4.3.1 Currently there are six pages allocated for the Mock Task Order approach, inclusive of the six Key Personnel resumes. Section L.4.3.1 states " L.4.3.1 Factor 2 - Mock Task Order Approach The offeror shall submit a technical approach and key personnel for the mock task order relevant to their chosen scope track(s). The offeror shall describe its approach to successfully completing the mock task order requirements and identify how its key personnel’s qualifications align with the requirements stated. The technical approach shall clearly demonstrate the offeror’s technical understanding of the mock task order requirements and identify the planned level of effort by labor category which would be provided. The mock task order approach page limit includes key personnel resumes.
Will the government allow for resumes to be excluded from page count to that offerors may use the six pages to fully address all requirements required for this section? Additionally, will the Government confirm that Key Personnel resumes for this section are limited to one page? The RFP has been revised as follows:
Key personnel resumes are excluded from the page limit for Phase 2 Factor 2 - Mock Task Order Approach.
Key personnel resumes are limited to two pages each.
| RFP | 221, 222 | L.4.3, L.4.3.1 | Will the Government remove the six key personnel resume requirement for the Mock Task Order requirement? | No. Key personnel resumes are required for the Phase 2 Factor 2 - Mock Task Order Approach response. However, the key personnel requirements have been revised. | |
| RFP | 221-222 | L.4.3 | In the table describing the volumes for Phase Two, the table lists Volume 1 (Factor 2), 2 (Factor 3), 4 (Business/Pricing proposal) and 5 (Small Business Subcontracting). Is there an additional volume that that should be included in the submission? Or should Volumes 4 and 5 be re-named to Volumes 3 and 4, respectively? | The RFP has been revised to correct the discrepancy. A Cover Page has been added and the remaining volumes are renumbered accordingly. | |
| Section L | |||||
| Section G | 7 | ||||
| 1 | L.4.2 | L.4.2 states there may be up to four awardees. | |||
| Section G IDIQ Contract Information states that the Government intends to award up to three contracts for the primary category and up to three for each of the specific categories as a result of this solicitation. Will the Government clarify the number of potential awards per category? | Per Section L.4.2, the Government intends to provide up to four offerors per track with an advisory recommendation to proceed to phase two [emphasis added]. Section L.4.2 does not make reference to the number of awardees. |
As stated in Section G, the Government intends to award up to three contracts for the primary category and up to three contracts for each of the specific categories as a result of this solicitation. The Government reserves the right to include a small business reserve in each of the specific category contracts.
RFP 7, 177 B.1, J.2.G Some of the key personnel listed in the Mock Task Order_Earthquake section (Section J.2) do not show up in the Schedule of Labor Categories (section B.1). Is it correct for offerors to expect that individual task orders may require personnel that are not listed in the Schedule of Labor Categories? Individual task orders will not require personnel that are not listed in the Schedule of Labor categories.
The RFP Schedule of Labor Categories has been updated to correct for the original discrepancy.
| RFP | N/A | N/A | Is this solicitation a follow-on to an existing contract? If yes, will the Government provide the contract number and name? | This requirement is similar to Community Resilience IDIQ multiple award contracts 1333ND19DNB730011 and 1333ND19DNB730013 but is not a follow-on; this requirement uses a different Statement of Work. |
| RFP | N/A | N/A | Is this solicitation a consolidation of work under an existing IDIQ? | No. |
| RFP | N/A | N/A | Are there current contractors supporting the existing work? | No. This requirement is similar to work performed under Community Resilience IDIQ multiple award contracts 1333ND19DNB730011 and 1333ND19DNB730013 but is not a follow-on; this requirement uses a different Statement of Work. |
| N/A | N/A | N/A | Are any estimates available on the number of task orders the Government expects to issue across each track? | The Government does not have an estimate at this time. The disaster elements that comprise this scope are often unpredictable. |
| RFP | Will the Government clarify the number of awards anticipated by track? | Per RFP Section G, the Government intends to award up to three contracts for the primary category and up to three contracts for each of the specific categories as a result of this solicitation. The Government reserves the right to include a small business reserve in each of the specific category contracts. |
