About this file

This document is a Notice of Intent to Award a Contract Without Competition issued by the Utah Public Procurement Place, specifically the Division of Purchasing. The notice, numbered VD17035SS, seeks to procure explosive devices for depredation purposes, classified under commodity code 12130 for explosive materials. The solicitation was released on 8/13/2016, opened on 8/15/2016, and scheduled to close on 8/24/2016 at 2:00 PM MST. The procurement is being pursued as a sole source procurement, meaning the state believes there may be only one potential vendor capable of meeting their specific requirements.

The notice invites alternative vendors to challenge the sole source designation by submitting detailed documentation proving they can provide comparable or equivalent explosive devices that meet the specifications. Potential challengers must provide their company name, a comprehensive explanation of their challenge, and evidence of their capability to supply the procurement item. If no valid challenges are received during the public notice period, the Division of Purchasing may award the contract to the identified vendor without competitive bidding. The contact for this procurement is Vinessa Dudley, and interested parties are explicitly instructed not to contact the Conducting Procurement Unit directly but to route all inquiries through the Division of Purchasing during the publication period.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS

The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that:

there is only one source for the procurement item;

transitional costs are a significant consideration in selecting a procurement item; or the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit.

In the Buyer Attachments section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process.

Determination of Other Interested Vendors The intent of this notice is to determine if there are any other interested and qualified vendors that meet the specifications of this notice. Any such vendors must submit the following information:

The name of the contesting person; and A detailed explanation of the challenge, including documentation showing that there are other competing sources for the procurement item.

Documentation that your firm can provide a comparable or better procurement item that meets or exceeds the specifications;

Documentation that your firm can also provide the same proprietary procurement item or an equivalent procurement item; and

Explosive devices for depredation Explosives for depredation purposes.
