STATEMENT OF WORK (SOW)
Vessel Monitoring System (VMS) Transceiver Service
1.0 GENERAL
The Pacific Islands Division (PID) of the Office of Law Enforcement (OLE), National Marine Fisheries Service
(NMFS), National Oceanic and Atmospheric Administration (NOAA), Department of Commerce (DOC), is a government agency charged with the mission of enforcing laws, regulations and conservation measures supporting stewardship for living marine resources.
1.1 BACKGROUND
PID provides administrative and technical support to operate the Pacific region portion of the national Vessel
Monitoring System (VMS) used to track commercial fishing and other vessels required by Federal Regulations for the purpose of fisheries enforcement. PID is required by 50 CFR § 665.19 and 50 CFR § 300.219 to procure, install, maintain, repair, and replace VMS transceivers for Hawaii and American Samoa Longline Limited Entry permit holders. A critical component of this task is to conduct reasonable, regular, sustainable, life-cycle installation, maintenance, repair, and replacement of VMS hardware.
1.2 SCOPE
The scope of this Statement of Work is limited to services related to the installation, troubleshooting, repair, and replacement of VMS units on vessels that fall under PID’s responsibilities.
1.3 OBJECTIVE
The objective of this procurement is to ensure the continued operational efficiency and effectiveness of the
VMS program. Achieving this objective will resolve current VMS maintenance, operational, and fiscal challenges, and ensure the regulated commercial fishing fleets' compliance with relevant VMS federal regulations without disrupting their legitimate commerce and livelihoods.
2.0 SPECIFIC REQUIREMENTS/TASKS
PID personnel will direct the Contractor as required to service VMS units on specified vessels in accordance with regulations stated above. The requirements to meet our objectives will include the following (all work performed on vessels at piers in Honolulu, the vendor’s facility, and / or as otherwise mutually agreed, unless specified otherwise):
2.1 VMS Unit Installation
2.1.1 The Contractor shall professionally install new NMFS-OLE-type-approved VMS units, provided by PID, on vessels as directed by authorized PID staff. Specific VMS vendors and MTU types are Skymate m1600 VMS, Woods Hole Group - Triton Advanced, and the Woods Hole Group - Thorium LEO A2.0.
2.1.2 The Contractor shall coordinate with PID VMS staff, and if necessary, the manufacturer of newly-installed units, to ensure that the units are properly activated and operationally performing in accordance with PID requirements.
2.2 VMS Unit Removal
The Contractor shall remove existing VMS units from vessels as directed by PID staff.
2.3 VMS Unit Services
2.3.1 The Contractor shall perform warranty assessments (covered by manufacturer’s warranty or not) as requested by PID. PID personnel will track and provide details on warranty timeframe for the VMS transceiver to the Contractor.
2.3.2 The Contractor shall perform other assessments, maintenance, repair, or replacement labor, and when specifically required by PID, provide materials sufficient to service VMS units on specified vessels.
2.3.3 The Contractor shall return any previously-installed (i.e., “replaced”) government-owned VMS unit (and if requested, associated cabling / equipment) to OLE PID (or make available for pick-up by PID) at no additional charge.
2.4 Coordination and Communication
2.4.1 The Contractor shall establish and maintain a working relationship with manufacturers of the type-approved VMS units installed and operating on vessels whose VMS is managed by PID.
2.4.2 The Contractor shall coordinate with PID VMS staff for outside-of-warranty service, including responding to service requests, queries, and facilitating government payment.
2.4.3 The Contractor shall coordinate directly with hardware manufacturers for warranty-covered units, to establish warranty standards and payment protocols.
2.5 Response Standards
2.5.1 The Contractor shall verbally respond to PID phone calls requesting service the same day if the call is before noon, or by noon the following day if the call is made after noon, during PID’s normal duty hours (Monday – Friday, 8:00 AM – 4:30 PM Hawaii Standard Time).
2.5.2 The Contractor shall respond by email or phone to emailed service requests within 24 hours of the email being sent by PID.
2.6 Performance Standards
2.6.1 For vessels new to the fishery, VMS unit installation (installed and operational on the designated fishing vessel with position reports being verifiably received by OLE PID) shall be completed within 8 working days of notification by OLE PID.
2.6.2 For vessels requiring replacement of an existing VMS unit, installation shall be completed within 3 working days, but not to exceed 5 working days, of notification by OLE PID.
2.6.3 All other service shall be completed within a mutually-agreeable time frame, not to exceed 8 working days of notification by OLE PID.
3.0 CONTRACTOR PERSONNEL
3.1 Qualified Personnel
The Contractor shall provide qualified personnel to perform all requirements specified in this SOW.
3.2 Certifications
The contractor's personnel performing VMS installations, repairs, troubleshooting, and maintenance must be certified technicians. The most commonly utilized manufacturers are Woods Hole Group and Skymate. The contractor must have a signed agreement with Woods Hole Group in order to work on their systems (See FAR Provisions 52.212-1 and 52.212-2 in the RFP for more details). The contractor will not need a contractor certification for Skymate systems, the units will just need to be installed in accordance with the quick start guide.
4.0 OTHER APPLICABLE CONDITIONS
4.1 Place of Performance
Work will be primarily be performed on vessels at piers in Honolulu, HI. However, in some special cases work will be performed on vessels at other mutually agreed upon locations on the Island of O’ahu.
4.2 Hours of Operation
4.2.1 Contractor employees shall perform work during normal duty hours of Monday – Friday, 8:00 AM
– 4:30 PM Hawaii Standard Time.
4.2.2 Work completed outside normal duty hours shall be approved at least 24 hours in advance by the
TPOC.
4.2.3 The TPOC is responsible for the overall scheduling of the project activity, and the Contractor is responsible for scheduling the work to be done each day, within the work schedule of the PID staff.
4.2.4 The Contractor is not authorized to perform duties under this contract on days when the facility is closed (i.e., Government Furlough, inclement weather, power outages, legal and federal holidays, etc.), unless otherwise noted. These will be considered non-working (non-pay) days. In the event of Federal dismissal or facility closure during normal work hours, the Contractor will be notified directly by the NOAA Facility Manager/TPOC to depart from the facility.
4.3 Federal Holidays
4.3.1 The Contractor shall observe all Federal Holidays and any other day off work designated by Federal Statute, Executive Order, or Presidential Proclamation as outlined by the Office of Personnel Management (OPM).

4.3.3 If any of the holidays outlined by OPM fall on one of the regularly scheduled work days, the office manager has the discretion to determine whether an "in-lieu-of" work day will be scheduled. If the work day is not rescheduled, the invoice will be reduced to reflect the day(s) not worked.
4.4 Points of Contact
4.4.1 The primary PID point of contact (TPOC) is NOAA OLE PID VMS Technician.
4.4.2 The TPOC (or designee) will accept delivery, perform inspection and installation as required.
