About this file
This document is an amendment to a federal government solicitation for water vapor sensors for commercial aircraft. The amendment provides responses to vendor questions, updates the provisions and clauses attachment, and clarifies that civil aviation authority approval in addition to or instead of FAA approval would be acceptable for meeting requirements. It also states that a letter of intent from a partner airline would satisfy the subcontracting plan requirement. Services funded by the federal government are generally required to use U.S. flag air carriers, but the Trade Agreements Act would permit a Canadian airline partner if other criteria are met. Except for these specified changes, all other terms, conditions and provisions of the original solicitation remain in effect.

1) Solicitation Amendment 0001 is issued to provide vendor questions and government responses.
a. Vendor Question: Will any applicable Civil Aviation Authority Approval work? Ie will the legally required STC for the airline we partner with be acceptable or do we have to have FAA approval?
Government Response: Yes, any applicable Civil Aviation Authority Approval that includes the legally required Supplemental Type Certificate for the airline/airframe with whom the contractor partners will be acceptable.
b. Vendor Question: This work requires a subcontract with an airline, do we need to provide a subcontracting plan?
Would a letter of intent from the partner airline be acceptable?
Government Response: Letter of intent will be acceptable.
c. Vendor Question: Would there be any problems contracting with a Canadian Airline if it meets requirement
2.3.1 for coverage and route structure over the West Coast of the continental US and central tropical Pacific?
Government Response: Services funded by the federal government are required to use a "U.S. flag" air carrier service. However, the Trade Agreement Act implements several international trade agreements that guarantee that the product and services of signatory countries and other eligible countries receive nondiscriminatory treatment for Trade Agreement Act-covered procurements. The Trade Agreement Act is applicable to this procurement. A firm that is providing the goods and/or services must be established in the United States or a designated country (see 48 C.F.R. § 25.402, FAR clause 52.225-5, Trade Agreements and provision 52.225-6 Trade Agreement Certificate included in the solicitation).
2) Additionally, Attachment A – Provisions and Clauses is updated to reflect incorporate provision FAR 52.225-6, Trade Agreements Certificate (FEB 2021) in full text.

The Government will consider for https://www.acquisition.gov/far/part-25#FAR_Part_25 award only offers of U.S.-made or designated country end products unless the Contracting Officer determines that there are no offers for such products or that the offers for those products are insufficient to fulfill the requirements of this solicitation.
