About this file
This is a compensation model pricing form for delinquent toll account recovery and management services submitted by the Harris County Toll Road Authority (HCTRA). The contract is estimated to begin on or about August 1, 2026, and will continue for two years. The scope of work is divided into two stages: Early-Stage Collection Letters and Customer Contact, and Late-Stage Administrative Hearings, Litigation, and Post-Judgment Prosecution. The early-stage services include flat fees for collection letters at $1.55 per account (500,000 estimated accounts), administrative hearings set at $0.25 per account (500,000 accounts), pre-hearing resolution and payment contingency at $500.00 per account (10,000 accounts), and post-hearing notices at $0.25 per account (500,000 accounts). Late-stage services include prosecuted or settled hearings at $10.00 per hearing (10,000 estimated hearings), lawsuits at $15.00 per lawsuit (3,000 estimated), and resolution and payment contingency at $500.00 per account (10,500 accounts).
All compensation is contingent upon collection of delinquent accounts and actual fees accrued, with respondents receiving only the amount actually accrued up to the HCTRA allowable maximum fee amounts established by Harris County Commissioners Court under the Toll Setting Policy (approved 2023). Case expenses are reimbursable to the selected firm(s) up to $50.00 per case for litigation support activities such as private servicers, skip-tracing, certified mail, and litigation filing fees. Attorney's fees must be approved by HCTRA before being pleaded in any filed case, and the selected firm(s) retains all awarded and paid attorney's fees, including post-judgment accrued fees when paid. A standing agreement between the firm(s) and HCTRA regarding the incurring and reimbursement of expenses may be established and modified at any time by HCTRA.

| 1. | Attorney’s fees: HCTRA must approve all attorney’s fees before the Firm(s) pleads them in any filed case. Firm(s) keeps all awarded and paid attorneys fees, including post judgment accrued, if any, on such fees, when paid. |
2. Case expenses: are reimbursable to the Firm(s) up to $50.00 per case, for litigation support (e.g., private servicers, skip-tracing, certified mail, and litigation filing fees). The Firm(s) and HCTRA will have a standing agreement regarding the incurring and reimbursement of these expenses. The standing agreement can be changed at any time by HCTRA.
3. HCTRA Allowable Maximum Fee Amounts: Fee sharing and accrual is subject to and limited by the maximums (or caps) established by Harris County Commissioners Court, in the Toll Setting Policy (approved 2023).
4. Contingency: Payments to the Firm(s) are contingent upon collection of the delinquent account and the actual fees accrued per account. Only accrued fees are payable through a contingency payment. For example, if an account accrues less than the HCTRA allowable maximum fee, the Firms(s) will receive only the amount actually accrued.
