The RFP appears to be mute on requirements around the Department of
Labor’s (DOL) prevailing wages for government contracts. Does this RFP require the Contractor to pay Davis-Bacon Act and/or McNamara-O’Hara Service
Contract Act (SCA) Department of Labor’s Wage Determinations, when applicable, as they may relate to this RFP, and if so, can the USDA please provide the applicable DOL prevailing wages?
Please see Section IV- Contract Clauses, FAR 52.212-3 Offeror Representations and Certifications - Commercial Items (Nov 2021) regarding exemptions from the application of the Service Contract Labor Standards.
13 Attachment E Uncontested and Contested Foreclosures Attachment E
All foreclosures start out as uncontested and then move to contested once it is known that the borrower is contesting. How did the USDA compile the quantity figures for uncontested vs. contested?
USDA utilized historical data to quantify figures for uncontested vs. contested.
PWS 6.9.3 and 6.9.4. 6.9.3 Item 27 and

Under Property Preservation Services in
6.9.3. and 6.9.4. REO Over and Above Work, it mentions "not limited to" the following, but does not mention Vacant Property Registration. Is this something the
Contractor will be expected to do, when required by local jurisdiction, and if so, would this fall under section 6.9.4. REO Over and Above Work? It appears it is not mentioned in HB 3550-1 either.
Yes, the Contractor will be expected to register vacant properies in jurisdictions where it is required. Yes, if applicable, this work would fall under PWS Section 6.9.4 REO Over and Above.
PWS 6.3.5. Foreclosure Over and Above All Bullets
The PWS section 6.3.5. appears to intermingle items that would be considered
"Title Curative" with what would be considered regular "Property Preservation" functions, which appear to be invoiced at different times. For instance, obtaining lien releases, HOA payments and paying past due taxes, differ from the other items that would be considered "property preservation" in nature. Are all of these items in section 6.3.5., once approved, able to be invoiced monthly? If not, please explain what can be.
Services provided under PWS 6.3.5 Foreclosure Over and Above, once approved in accordance with the Over and Above Work Clause in Section III of the contract and work completed, it should be invoiced per the invoicing instructions in the RFP section 8. Invoice and Payment Instructions.

Should the Contractor expect that loans referred for foreclosure will be prepared to proceed immediately, or will there be any pre-foreclosure activities (loss mitigation, demand/pre-foreclosure notice/statutory letter, etc.) that should be completed first? If any such activities will need to be completed, will the vendor be responsible for completing any of them?
Yes, the Contractor should prepared to proceed immediately.
If, any of the actions listed except loss mitigation are required by State Law then the Contractor shall perform the actions necessary to complete the task.

While we understand the USDA has revised the RFP to allow monthly invoicing on everything accept foreclosure, given that some states take over two years to complete a foreclosure, and contested cases will drive up the fees, will the USDA consider a more frequent billing cycle, such as quarterly, or bi-annually, or would the USDA consider leveraging Fannie Mae's 2019 schedule of when foreclosure fees are deemed "earned"?
Carrying costs would be significant, if the Contractor must wait two or more years to invoice.

Foreclosure volumes and REO have been historically low for the past year. The USDA has used some type of historical data to populate and estimate quantities by service/product type. Can the USDA provide a break down of foreclosure volumes by state for contested vs uncontested, as well as appraisal requests by state, inspections by state and preservation initial services, and recurring services by state, for the past 12 months?
No. USDA will provide a list of the estimated quantities of contested vs.uncontested by location for the entire NDMS period of performance.

Can you please confirm that the whole of HB 1-3555 applies to the NDMS program?
The HB -1-3550 applies to all origination through servicing to include housing qualifications/areas, applicant qualifications, income qualifications and underwriting. The HB -1-3550 does not include state laws that affect NDMS to include, but are not limited to Foreclosure proceedings, Mediation requirements, Bankruptcy laws, Vacant Property Registration, etc.
