About this file

This document is a Questions and Answers (Q&A) file for a Natural Resources Conservation Service (NRCS) solicitation for Title Search and Closing Services in South Dakota (Solicitation No. 12FPC125Q0026). The Q&A provides key clarifications about the procurement, including that it is a brand new requirement for full-service title search and closing services, with an estimated 10 properties per year primarily located east of the Missouri River. NRCS plans to issue a single award Blanket Purchase Agreement (BPA), with an estimated award date of July 15, 2025, and intends to primarily use Intra-Governmental Payment and Collection (IPP) while retaining the option to use government purchase cards for micro-purchases.

The solicitation requires quotes to consist of three volumes: Technical Narrative, Past Performance, and Price, with a 10-page limit for the technical proposal. The estimated purchase price for easements has historically been as high as $1.8 million, though the exact price varies. The government will not pre-sign the Warranty Deed (WED) and will sign after the landowner. Potential vendors should note that mailaway closings are not acceptable, and the requirement is set aside 100% for small businesses under the NAICS code 541191 with a size standard of $19.5 million.

Question # Answer 1 This is a brand new requirement.

This is an estimate provided for pricing purposes only. The estimate is not a guarantee of work or volume, rather a general forecast to assist with proposal preparation and pricing.

This requirement is for both title search and closing services per Section VI A and B of the SOW. The reference to "10" pertains to the estimated number of properties per year that will require these services.

4 Full Service - All tasks and deliverables associated with Section VI Description of Services (A and B) in the SOW.

Quotes shall consist of three volumes (1) Technical Narrative, (2) Past Performance, and (3) Price. Proposal is limited to ten (10) pages submitted on standard 8.5” by 11’’ Adobe Acrobat. Not included in limit are: table of contents and/or electronic index dividers.

6 NRCS estimates up to 10 properties.

7 No backlog of files; however, our FY 2025 WRE work would be issued.

8 No, this is a single award BPA.

NRCS plans to primarily use IPP. However, we would like to retain the option to use the Government Purchase Card for transactions that fall within the micro-purchase threshold, should the need arise in the future.

10 Unknown as it varies but has been as high as $1.8 million.

11 Mainly (99%) east of the Missouri River (east half of the state).

12 A revised Price Schedule has been provided via this amendment.

The government does not pre-sign the WED as the NRCS signature would be considered the actual closing date. The government will sign the WED after the landowner.

14 The estimated award date is by July 15, 2025.

15 No.

16 Not acceptable. Is a mailaway acceptable for closing?

Will the government pre-sign the Acceptance by Grantee page when sending the WED it prepares? If no, then when will the government sign the Acceptance by Grantee page?

When does the government hope to make an award and start the contract?

Some offices permit invoicing and payment through PayPal in lieu of payment via credit card. Is this acceptable?

There is a reference of a “credit card processing fee” referenced in the pricing schedule; will the Agency use credit card payments for invoicing or IPP.GOV exclusively?

What is the average purchase price for each easement?

In what counties have the previous easements been located for the last couple of years? We are aware that easement can be located anywhere in the state.

The pricing spreadsheet contains several items to be priced that are not addressed in the statement of work. Please provide an explanation for what is required for each line item to be priced - more specifically items shown in lines 5, 7, 8, and 15.

Are you looking for full services, or just specific sub-services?

What format would you prefer for documentation?

Does the Agency have a forecast or projection on how many prelim title commitment orders it will issue on Year 1 of the contract?

Does the Agency have a backlog of any files that would be issued immediately upon the issuance of this

BPA?

Does the Agency anticipate issuing multiple BPAs for this requirement? If so, how will Call Order be tasked?

Natural Resources Conservation Service (NRCS) Title Search and Closing Services

South Dakota Solicitation No. 12FPC125Q0026

Question/Comment/Clarification Is this a brand new contract OR is there an incumbent for this work?

Is the requirement just for 10 properties or is this the initial round, with more to follow? Would an RFP be required for each round? If so, what kind of volume are you anticipating?

The RFQ seems to cover 10 searches, but the pricing structure appears more aligned with Title closing?
