About this file
This document is a Terms and Conditions file for a federal construction solicitation issued by the U.S. Coast Guard under Solicitation Number 75110PR270000104. The solicitation incorporates Federal Acquisition Regulation (FAR) and Homeland Security Acquisition Regulation (HSAR) clauses effective as of March 13, 2026, establishing the legal framework and procedural requirements governing bid submission, evaluation, and contract performance.
The work involves gas-line repair and related construction activities, requiring contractors to complete excavation, gas-line repair, gas-valve installation, testing, gravel backfill, asphalt patching, cleanup, and debris removal within 10 business days of award. Evaluation criteria prioritize technical acceptability—including proof that personnel possess required Alabama licenses for gas-line repair, valve installation, excavation, and asphalt work—followed by price evaluation on a firm-fixed-price basis covering all labor, supervision, materials, equipment, tools, transportation, disposal, permits, overhead, and profit. The Government will award the contract to the small business meeting all work requirements and offering the lowest total price. A mandatory site visit is scheduled for November 2, 2026, at 1:00 p.m. CST at Training Center Birmingham, with attendees required to provide identification documentation and be subject to background restrictions, including prohibition of personnel with felony convictions. The document incorporates numerous standard federal clauses addressing labor standards, wage requirements, safety reporting, insurance requirements, equal opportunity, and regulatory compliance, applicable to both the prime contractor and all subcontractors at any tier.

(DEVIATION 25-21)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the
Government, price and other factors considered. The following factors will be used to evaluate offers:
Quotations will be evaluated in an efficient and minimally burdensome fashion. The Government will evaluate the quotations submitted against the following evaluation criteria: The Government will award the contract to the small business that meets all work requirements and provides the lowest total price.
Technical Acceptability. To meet the work requirements, the quote must:
• State that the contractor will complete all work in the Statement of Work, including excavation, gas-line repair, gas-valve installation, testing, gravel backfill, asphalt patching, cleanup, and removal of debris;
• Include a short plan or schedule showing that all work will be completed within 10 business days after award;
• Name the project manager or on-site supervisor who will work with the Contracting Officer and
Government Technical Representative;
• Show that the people performing the work are qualified and have any Alabama licenses required for gas-line repair, valve installation, excavation, and asphalt work; and
• Agree to meet all other requirements in the Statement of Work.
A quote that does not meet every item above will not be considered further.
Price. The Government will evaluate the total firm-fixed price for the entire requirement. The total evaluated price will include all labor, supervision, materials, equipment, tools, transportation, disposal, permits, overhead, profit, and other costs necessary to perform the Statement of Work. The Government will evaluate prices for completeness and reasonableness.
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful
Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.228-1 Bid Guarantee (Sept 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier’s check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds-
(1) To unsuccessful bidders as soon as practicable after the opening of bids; and
(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.
(c) The amount of the bid guarantee shall be ______ percent of the bid price or $________, whichever is less.
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
