(ix) FAR 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021) (Provision)

(a) The Government will award a Purchase Order resulting from this solicitation to the responsible, technically acceptable quoter whose quote, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor 1 – Equipment – The Government will evaluate the quoter’s equipment they propose to use to determine if the quoter fully understands the technical requirements of this project and would be able to satisfactorily complete those requirements using their proposed equipment.

Factor 2 – Technical Experience – The Government will evaluate the technical experience of the quoter and/or the quoter’s proposed subcontractor(s) to determine if the quoter/subcontractor(s) has successfully performed services that are the same or similar to the requirements of this project.

Factor 3 – Price – The quoter’s proposed price will be evaluated for reasonableness and affordability. Price analysis techniques will be employed to determine price reasonableness.

(b) Factor 1 - Equipment and Factor 2 – Technical Experience, when combined, are equal in importance to Price.

(c) Technical acceptability of Technical Proposal submittals will be evaluated using the below Technical Acceptability Rating table:

Technical Acceptability

Rating Definition Acceptable Submittal in response to the Technical Evaluation Factor meets the requirements of the solicitation.

Unacceptable Submittal in response to the Technical Evaluation Factor does not meet the requirements of the solicitation.

(d) The Government may perform a comparative evaluation (comparing offers to each other) to select the contractor that provides the best value, considering the evaluation factors in this solicitation.

(e) The Government may engage in negotiations/discussions with a quoter(s) as authorized by FAR 12.203(a) for commercial services. (f) The Government will evaluate quotes for award purposes by adding the total price for all line items to come to the total proposed price quote. The proposed unit price will be multiplied by the line item quantities if there is no Total Extended Price provided for the line item or if there are computation errors.

(g) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding Purchase Order without further action by either party.
