STATEMENT OF WORK
Sandia Ranger District Carbaryl Spray Project
Introduction The U.S. Department of Agriculture Forest Service seeks a qualified Contractor with expertise in applying insecticide to prevent tree mortality from insects. This works consists of applying insecticide to white fir to prevent tree mortality from bark beetles in developed recreation areas. Insecticide applications will be applied from the ground as a cover spray application to the main stem.
Background A Douglas-fir tussock moth outbreak began in 2016 in white fir, Abies concolor,-dominated stands along the Crest Highway on the Sandia Ranger District of the Cibola National Forest. Douglas-fir tussock moth, Orgyia pseudostugata, populations reached high levels in 2017, causing severe levels of defoliation to white fir and low levels of tree mortality to the same species. Fall egg mass surveys conducted in September 2017 predicted the outbreak would continue during the summer of 2018, leading to additional defoliation and greater levels of tree mortality. Tree stress and injury caused by Douglas-fir tussock moth feeding can lead to subsequent attack from fir engraver bark beetles, Scolytus ventralis. Cover spray applications of carbaryl (Sevin XLR plus, Bayer) are needed to prevent tree mortality from bark beetles within the outbreak.
Project Area The Sandia Ranger District Carbaryl Spray Project includes three developed recreation sites (Balsam Glade Picnic Area, Capulin Picnic Area, and Capulin Snow Play Area), which are located in Bernalillo and Sandoval Counties, New Mexico on the Cibola National Forest, Sandia Ranger District. The sites are along the Crest Highway (State Highway 536) in Township 11 N., R 5 E (Balsam Glade Picnic Area, Capulin Picnic Area) and Township 12 N., R 5 E (Capulin Snow Play Area) (Figure 1).
Tasks This statement of work is for tasks associated with applying a registered insecticide to prevent tree mortality from bark beetles.
Task 1 – Work Plan A pre-work meeting is required with the Contracting Officer's Representative (COR) to develop the work plan and review the necessary documents. The contractor shall also include a timeline for completion of all work and safety precautions used during the application. The plan shall be submitted to the COR for approval 2 weeks prior to commencing the insecticide application.
Task 2 – Application of Insecticide The contractor will apply cover spray applications of carbaryl to 106 designated trees at three recreation sites along the Crest Highway (State Highway 536) of the Sandia Ranger District. Insecticide applications of carbaryl will be applied only to white fir, Abies concolor, following all insecticide label restrictions. Treatment trees were tagged with numbered metal tags and latitude and longitude coordinates were recorded for each tree (Table 1). Treatments must be completed prior to 15 May 2018.
Technical Requirements A. Government Responsibilities The COR for liaison with the contractor as to the conduct and quality of work is Tom W. Coleman, Zone Leader/Entomologist, 333 Broadway Blvd SE, Albuquerque, NM 87102, 505-842-3286, twcoleman@fs.fed.us. The COR may issue written or oral instructions to clarify the Statement of Work. The Government will:
1. Furnish the applicable documents and provide information for signage;
2. Close the three recreation sites (Balsam Glade Picnic Area, Capulin Picnic Area, and Capulin Snow Play Area) prior to treatment applications.
3. Review all material submitted by the contractor;
mailto:twcoleman@fs.fed.us
4. Answer or address technical questions;
5. Provide a t-bar or other device so that the contractor’s lock and Forest Service lock can be be on the gate to allow both parties to access the Capulin Picnic Area and Capulin Snow Play Area;
6. Advise the contractor of all meetings, presentations, etc. for which attendance is mandatory
B. Professional Qualifications The contractor must be a New Mexico certified pesticide applicator with a forestry permit.
(http://www.nmda.nmsu.edu/pesticides/)
C. Work Requirements In conducting the work, the contractor shall coordinate with the COR and:
1. Hang signage of site closure and application of insecticide treatments 24 hours prior to application.
2. Apply carbaryl (Sevin XLR plus, Bayer) to the designated treatment trees at the maximum label rate for bark beetles (1 gallon of spray per 50 sq ft of bark). The application should cover the entire portion of the main stem from all sides. Treatments should cover the main stem until the trunk diameter is less than five inches.
3. Apply insecticide applications with a hydraulic sprayer or compressed sprayer (e.g., skid sprayer). Sprayer should be capable of achieving >150 PSI and be equipped with at least a 200 ft hose.
4. A bucket truck, boom lift, or man lift will be required to apply insecticides to the upper parts of the main stem of some of the taller treatment trees. Use of a bucket truck or boom lift may increase the application time for a single tree and the time to move between designated treatment trees, but will also cut down on spray drift. To reduce risk of injury to applicators, treatment trees are located on mostly level ground in the recreation areas.
5. Applications will be applied when the wind is calm to further limit spray drift.
6. Water for use with the insecticide will be provided by the Contractor. There is no water access at these developed sites.
7. Samples from the tank mix will be provided to the COR after the insecticide has been mixed.
8. Stop applications immediately if the public enters the treatment area and only continue applications once the individuals have vacated the area.
9. Applicators will wear proper personal protective equipment (PPE) required by the insecticide label and follow state regulations for PPE. Appropriate spill kits and first aid kits will be required for the applications.
10. Treatments will be applied only during the days of Monday to Friday. No insecticide application may occur during the weekend (Saturday and Sunday). The treatments should be applied prior to the flight of bark beetles, approximately the 15 of May 2018.
11. All picnic tables, barbeques, garbage receptacles, and bathrooms within the recreation site should be covered with plastic sheeting during applications and washed with soap and water to remove any insecticide residue when the applications are complete at that site.
12. The site must be closed to the public until 12 hours following the completion of the final application at a site. After the applications are completed, signs explaining that insecticides have recently been applied, what the chemical is, who to contact with questions, and when the area will be opened again will be posted.
13. Provide a lock on the gate at Capulin Picnic Area and Capulin Snow Play Area;
Deliverables and Schedule The contractor will complete the services required under this Statement of Work and submit the required forms and related documentation in accordance with the following schedule, exclusive of Government review time:
1. Return t-bar or other device to the COR once the applications and work have been completed at Capulin Picnic Area and Capulin Snow Play Area.
2. Final Submission. Thirty days following the completion of the application, submit one hard copy of the completed treatment tree form (Table 1) that notes the application date for each tagged treatment tree, when tank mixes occurred, and any additional comments.
Inspection and Acceptance The Government will perform inspection of the deliverables and services received from the Contractor. The Government has the right to perform periodic surveillance of the Contractor to ensure that the Contractor’s work http://www.nmda.nmsu.edu/pesticides/ products and quality control processes are in compliance with the contract requirements. The Government and the Contractor will coordinate Government surveillance in a manner that will not unduly delay or disrupt the Contractor’s performance of the contract.
The COR will have five (5) business days to review draft deliverables and make comments. The Contractor will have five (5) business days to make corrections. Upon receipt of the final deliverables, the COR/designee will have five (5) business days for final review prior to acceptance or providing documented reasons for non-acceptance.
Should the Government fail to complete the review within the review period the deliverable will become acceptable by default.
The COR will have the right to reject or require correction of any deficiencies found in the deliverables that are contrary to the information contained in the Contractor’s accepted proposal. In the event of a rejected deliverable, the Contractor will be notified in writing by the COR/designee of the specific reasons for rejection. The Contractor shall have five (5) workdays to correct the rejected deliverable and return it per delivery instructions.
Contract Time The contract period shall be 90 calendar days, starting from the day the Contract is awarded and all associated deliverables shall be submitted to the Forest Service COR.

(4) ___ Have, ___ have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.
(i) Taxes are considered delinquent if both of the following criteria apply:
(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) Examples. (A) The taxpayer has received a statutory notice of deficiency, under I.R.C. § 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. § 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. § 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
