Violation Notice
Failure to Monitor or Timely Report FLUORIDE Result(s) from April 1, 2018 to June 30, 2018
According to the Colorado Department of Public Health and Environment (“Department”) records, SHADOW MOUNTAIN VILLAGE (“Supplier”) was required to collect and test FLUORIDE sample(s) from
April 1, 2018 to June 30, 2018 at Facility ID 005 (WATER TREATMENT FACILITY). One or more test results have not been received by the Department. Failure to monitor or timely report test results is a violation of Section 11.19 of the Colorado Primary Drinking Water Regulations (“Regulation 11”), 5 CCR
1002-11.
As a result of the violation, please be advised of the following public notice requirements:
1. The Supplier must provide Tier 3 public notification as soon as possible, but no later than August 1, 2019 to the persons served by the Supplier.
2. Within 10 calendar days of completing the public notification requirement, the Supplier must submit a certification of delivery along with a representative copy of each distributed notice to the Department. Public notification forms and templates are located at colorado.gov/cdphe/pnrule.
If the required monitoring was completed, please submit the test results to the Department immediately via the Portal at http://wqcdcompliance.com/login, or fax 303.758.1398. Receipt of valid test results will resolve the monitoring, but not the reporting part of this violation and public notice requirements will still apply. Monitoring requirements for the Supplier may be found online at http://wqcdcompliance.com/schedules.
This Violation Notice does not constitute an Enforcement Order and is not subject to appeal. The
Department may pursue formal enforcement action with penalties concerning the above violation(s), including issuing the Supplier an Enforcement Order or amending a current order.
