About this file
This document contains an amendment to a solicitation for a federal construction contract. The United States Department of Agriculture Agricultural Research Service is seeking to install a swing-type flood gate at the Children's Nutrition Research Center facility in Houston, Texas. The project involves cutting concrete curb and pavers to accommodate the new gate, which must be made of metal with a finished appearance and no painting required. The amendment provides responses to vendor questions, clarifying that permits are not required but due diligence in obtaining them is expected, only one phase is included, and the experience of subcontractors is acceptable for meeting past performance requirements. The total value of the contract is estimated between $500,000 and $1,000,000. The solicitation is a 100% small business set-aside for NAICS code 236220.

1. Does the flood gate or any of its components need to be painted?
A: No, the intention is to have a metal finish on the flood gate and components.
2. Is this a federal property or a leased space from the federal government? The SOW mentions permits but if it is a federal building, permits may not apply.
A: Property is Federally owned. Federal Law (ref. 116 STAT. 1166 PUBLIC LAW 107-217—AUG.
21, 2002) does not allow the Federal Government or its Contractor to pay a fee for any permit except for environmental permits. Contractor is responsible for performing due diligence in attempting to obtain the necessary permits from State or Local jurisdictions working within this limitation.
3. Is the owner open to other forms of flood gates?
A: No, gate must be swing type.

A: There are no known utilities in or beneath the curb or pavers.
6. Does the owner have any attic stock of the granite to be cut out?

A: It should be part of the proposal

A: Yes.
11. Technical factor 2 mentions that a price for both phases should be provided. What are the phases?
A: That was an error. There is only one phase.
