REQUIREMENTS/STATEMENT OF WORK
JANITORIAL SERVICES – SANDIA RANGER DISTRICT
SCOPE OF CONTRACT
Furnish all the necessary labor, supervision, materials, supplies (except Government-Furnished property), transportation, a method of communication, and all incidentals to perform the janitorial services at the Sandia Ranger District Office and the Warehouse at the back of the property, including offices, lunchroom, elevator, conference rooms, entrance ways, corridors, lobbies, restrooms, showers and closets in accordance with the terms, conditions and specifications of this quotation.
Service shall be performed in a professional and satisfactory manner at the frequencies and during the times specified.
LOCATION OF WORK
The Sandia Ranger District is located south of Tijeras, New Mexico at 11776 Hwy 337 Tijeras NM 87059.
Traveling from Albuquerque, New Mexico proceed East on I-40 30 miles to Tijeras, New Mexico. Take exit 175 to Tijeras/Cedar Crest. Proceed south on Hwy 337 0.7 miles to Sandia District Ranger Station and turn left into parking lot.
Sandia District office is approximately 9,980 square feet.
Sandia District Warehouse bathrooms/ offices are approximately 1,000 square feet.
CONTRACT TIME
The period of performance (estimated) Base Year: December 15, 2025- December 14, 2026 with four (4) option years.
The Government reserves the right not to exercise the option year(s).
PRE-AWARD SITE VISIT
Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award. Nor shall failure to inspect the site constitute grounds for delay in the start of work on the required start of Period of Performance.
Prior to the Request for Quotation (RFQ) closing date, the bidder may contract the Sandia Ranger District Office at 505-281-3304 or the COR, Taylon Chesser at 505-504-4217 and request a site visit to be arranged.
PRE-WORK CONFERENCE
After award, but prior to the start of work, there will be a conference with the Contractor and the Contracting Officer and/or the Contracting Officer’s Representative.
At that time, there will be open discussion concerning the contract, questions, and clarifications.
CONTRACTING OFFICER’S REPRESENTATIVE
The Contracting Officer will designate a representative herein after referred to as the Contracting Officer’s Representative (COR). The COR will provide on-the-ground administration of the contract. Prior to the start of work, the Contracting Officer will provide the name, address and telephone number of the COR to the Contractor.
WAGE RATES
The Provisions of the Service Contract Act of 1965 apply to this solicitation. If the current wage determination by the Department of Labor is received prior to closing date, an amendment to this RFQ will be issued indicating a minimum hourly wage.
SUBCONTRACTING
The Contractor shall NOT subcontract or have individuals under the age of 16 perform duties in connection with all and/or part of this contract without prior written approval of the Contracting Officer.
Any resultant contract will be subject to the Service Contract Act. Any employees hired in performance of this contract are entitled to compensation of the wage determination attached.
GOVERNMENT FURNISHED PROPERTY
The Government shall provide a lockable closet for storage of Contractors products and equipment. As well as consumable products i.e. Toilet Tissue and Paper Towels.
CONTRACTOR-FURNISHED PROPERTY
The Contractor will furnish the following items:
Vacuum cleaner-commercial quality
Toilet deodorant cakes Toilet seat protectors Biodegradable/ antibacterial hand soap
Use only biodegradable/green detergents and cleansers
Furniture polish Floor wax Floor wax remover
Mops Mop buckets Paper towels for rest rooms (remove)
Liners for sanitary product containers
Biodegradable garbage bags
Toilet tissue (remove) Brooms Window cleaner (green product)
Wood oil for wood desks and paneling
Biodegradable office waste basket liners
CONTRACTOR RESPONSIBILITIES
The contractor shall be available during normal business hours by telephone, cell phone or pager. A number shall be provided when quotation is submitted.
The work shall be performed Sunday between 5:00 am and 7:00 pm. Service is to be rendered on the above stated days. If weather prevents the service from being performed, it also shall be performed the following day.
The Contractor shall turn off all lights, close all windows and lock, lock doors, and insure that the building is secure upon completion of work. Failure to comply with locking all exterior doors and windows will be cause for termination of the contract.
The bulk of the cleaning operations shall be accomplished after occupant’s normal duty hours, except as otherwise stipulated in these specifications.
WORK PERFORMANCE
Service to be Performed Per (1) Time a Week
a. Sweep restrooms, kitchen, hallways, stairs, closet floors, front lobby areas, under front desk and all areas behind the front desk counter, the main lobby entry area and south entry of the building. Mop all mentioned areas with disinfectant solution.
b. Vacuum all carpet even in closed offices, elevator, upstairs, downstairs, and conference room
c. Dust with a treated cloth all furniture, office equipment, windowsills and all tops of filing cabinets (this includes the front desk area)
d. Empty all wastebaskets, and other waste receptacles, including those in lavatories, restrooms (includes sanitary product containers), offices, front desk, on back porch, and conference room and outside porch area. All waste and trash collected shall be removed from the building and taken to the covered trash containers furnished by the Government and located in the upper parking lot near the Maintenance Shop.
e. Clean, polish, and disinfect all wash basins, toilets, urinals, and utility sink (including faucet connections).
f. Wash all mirrors in restrooms.
g. Clean all cobwebs from ceiling areas, baseboards, windowsills, walls, and behind doors.
h. Clean countertops and tables in basement area.
i. Polish all entry door glass and windows in the main front entry, back door behind front desk, and south entry.
j. Clean all wash basins, toilets, urinals, and utility sink including faucet connections, with suitable scale remover, germicides, and deodorant.
k. Sweep all five outside porch areas free from debris such as cobwebs, leaves, bugs, etc.
l. Clean maintenance shop restrooms, showers, floors, and countertops and replace toilet paper and paper towels. Sweep and mop floors with disinfectant cleaner.
Services to be performed Four (4) Times per Year (Quarterly).
a. Clean all district windows inside and out. This includes the high windows. Clean cobwebs from inside pull-open windows. As well as cleaning the blinds.
b. Buff all the floor tiles in the restrooms, lobby, and kitchen.
c. Perform high cleaning, such as dusting exposed pipes, tops of partitions, hanging displays in lobby and tops of storage cabinets.
d. Wash wooden and metal windowsills and door frames.
e. Clean and wash the drinking fountains.
Services to be performed Two (2) Times per Year (September & March).
a. Remove spots from carpet with carpet cleaner, water, or mild detergent.
b. strip and re-wax tile floors.
c. Polish all wood paneling with wood oil.
d. Clean all carpets with approved carpet cleaning equipment. Spot clean stains as needed.
INSPECTION AND ACCEPTANCE
The Contracting Officer’s Representative (COR) shall perform periodic inspections. The Contractor shall return to any area that does not meet specifications and bring the work up to specifications within two (2) days of written notification. If the deficiencies are not brought up to the contract specifications, it will be grounds for termination of the contract.
52.246-4 Inspection of Services - Fixed-Price. (Aug 1996)
(a) Definition."Services," as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.
(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.
(c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.
(d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.
(e) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may-
(1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and
(2) Reduce the contract price to reflect the reduced value of the services performed.
(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may-
(1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or
(2) Terminate the contract for default.

452.246-70 Inspection and Acceptance (Feb 1988)
(a) The Contracting Officer or the Contracting Officer's duly authorized representative will inspect and accept the supplies and/or services to be provided under this contract.
(b) The COR or a designated inspector will make periodic inspections as work progresses. The contractor may observe the inspection while it is being made.
(c) Acceptance of the work will be determined by 100% visual inspection and will be based on adherence to the specifications.
(d) Non-conformance with any of the specifications will classify the work as unsatisfactory and rework may be required to bring the work up to standard.

SUPERINTENDENT BY CONTRACTOR
At all times during performance of this contract until the work is completed and accepted, the Contractor shall directly supervise the work or assign and have on the job a competent superintendent who is satisfactory to the Contracting Officer and has authority to act for the Contractor.
WORK PERFORMANCE
The work shall be performed pursuant to the frequency schedules described below in all areas between the hours of 5:00 p.m. and 6:00 a.m. on weekdays and weekends, Saturday or Sunday. After Labor Day weekend through the winter until May 1st, the contractor may work Saturdays after 1 p.m. or all day on Sundays, except legal holidays and days when the office is closed due to weather or unforeseen circumstances. Work may also be performed at any time on the weekends. In the event services are not provided because the Facility is closed due to inclement weather, unanticipated holidays declared by the President, etc., the Contracting Officer shall either:
a) Direct the Contractor to perform the work contractually specified over a number of immediately subsequent day(s) equal to the duration of the shutdown, or
b) Reschedule the work on day(s) satisfactory to both parties. Except as noted in the schedule of work, work shall not be required on the following holidays:

QUALITY ASSURANCE
- The government COR will inspect and evaluate the contractor’s performance in accordance with the contract statement of work. In the event that the contractor cannot clean on a scheduled day it shall be made up the next day of the same week. A missed cleaning cannot be made up the following week. If the day is not made up the day will be deducted from the invoice.
PROTECTION OF GOVERNMENT BUILDINGS, EQUIPMENT, VEGETATION
The contractor shall use reasonable care to avoid damaging buildings, equipment, and vegetation on the Government installation. If the Contractor’s failure to use reasonable care causes damage to any of this property, the contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contractor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.
CONTRACTOR’S KEY PERSONNEL
(a) The Contractor shall assign to this contract the following key personnel:

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.
(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer.
Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.
SECURITY REQUIREMENTS
Supervisory Personnel. The Contractor shall designate an on-site supervisor who shall be responsible for maintaining satisfactory standards of employee competency, conduct, appearance, and integrity, and shall be responsible for performance of work. An equally qualified alternate supervisor shall be provided to act on behalf of the supervisor during his/her absence. The supervisor and alternate shall be designated as key personnel and be able to read, write, speak/understand English and have full authority to act for the Contractor. The Contractor shall provide the telephone number of the supervisor and alternate to the CO with the list of key personnel.
The Contractor shall immediately notify the Contracting Officer’s Representative (COR) and CO in writing when a decision to terminate an employee has been made. The Contracting Officer may, in writing, require the Contractor to remove from the worksite any employee who the Contracting Officer deems incompetent, careless or otherwise objectionable, or for theft, possession and/or removal of materials, supplies, equipment or Government owned property. No one other than approved personnel shall be allowed on premises after hours or during performance of duties. The Forest Service Office is a non-smoking building. The Contractor shall ensure his/her employees do not smoke inside the building.
Janitor Personnel. Janitorial personnel shall have a minimum of 6-months of work experience. Their resume shall include references and experience of similar types of work previously performed. The personnel shall sign a letter of commitment after solicitation but before time of award. If award is made and the Janitor referenced in the quotation does perform under initial contact award, consideration will be given to contract termination.
Background Investigation. A Background check shall be conducted on contractor personnel who has access to the facility, and contractor will be required to obtain a PIV-A card for identification purposes when accessing the facility. A person model sponsor will be identified and require a background check. Upon request, a social security number shall be provided to the Person Model Sponsor.
The Contractor must provide security sufficient to prevent illegal entry into or loitering on the premises; to prevent loss by pilferage or theft; and to admit to the space during off-duty hours only those who are authorized to enter. In the event keys are lost, the Contractor is required to report the lost key to the CO or COR immediately. The Contractor will be required to reimburse the Government for lock replacement or rekeying of the locks.
Building Security. The Contractor shall protect Government property, buildings, equipment, materials, records, and data against unauthorized access, loss, or damage.
The Contractor shall announce their arrival and departure to employees who may be occupying the building.
Doors shall be left locked unless otherwise instructed.
The Contractor shall ensure that all keys issued by the Government are kept secure and not used by unauthorized persons. Government-issued keys shall not be duplicated. The Contractor shall reimburse the Government for replacement of locks or re-keying as a result of Contractor loss or negligence.
Only the Contractor’s employees are allowed in the building or on the job site. The Contractor is prohibited from opening locked areas to permit entrance of persons other than the Contractor’s employees.
The Contractor shall not attempt to reconnect or re-plug any computer wiring disconnected or disturbed during the performance of this contract. The Contractor shall leave written notification on the COR’s desk of any computer equipment accidentally disconnected.
All work under this contract shall be performed in a skillful and workman like manner. The Contracting officer may, in writing, require the Contractor to remove from work any employee the Contracting Officer deems incompetent, careless, or otherwise objectionable or for theft, possession and/or removal of materials, supplies, equipment or any Government owned property.
The Contractor shall not disturb papers on desks, counters, equipment or bulletin boards nor shall the Contractor use Government telephones or other equipment except for emergency use. The Contractor shall use caution not to damage Government owned property while executing items under this contract. The Contractor shall be held liable for any damage incurred to property during the performance of work. All damage by Contractor to property (including personal property of employees) due to performance of any activity under this contract shall be repaired/replaced by the Contractor at no additional cost to the Government. Repairs shall be made in a timely manner, in no case more than two weeks, unless agreed to in writing.
The contractor shall provide sufficient supervision of all work required by this contract. The Contractor shall be responsible for maintaining satisfactory standards of employee competency, conduct, appearance and integrity, and shall be responsible for taking such disciplinary action with respect to his/her employee as may be necessary.
Unclear items may be referred to the COR for clarification.
Key Control. No Keys or security access codes will be issued until personnel complete the Gov't sponsored background investigation. No keys shall be duplicated unless authorized in writing by the COR. The supervisor shall issue keys to Contractor employees and be responsible for their return. The Contractor shall report the occurrence of a lost key immediately to the COR. The Contractor shall be required to replace or to reimburse the Government for replacement as a result of the Contractor losing keys. The Contractor shall prohibit the use of keys and access codes issued by the Government by any persons other than the Contractor’s employees. The Contractor’s employees shall prohibit entrance to the building by other than Contract employees engaged in the performance of contract related.

PERFORMANCE REQUIREMENT MEASURES
Services performed annually and quarterly shall be scheduled in advance a minimum of two weeks to clear the floor areas of minor furniture items that may be in the way. Heavy furniture: i.e. bookcases, file cabinets, desks, etc., shall not be moved.
The contractor shall have sufficient staffing to be responsive to cleaning requirements. The determination of the total daily productive labor-hour requirements for the performance of all services herein specified is the sole responsibility of the contractor. Nothing in this provision should be construed as being contrary to the contractor's responsibility.
The Contractor shall be responsible for all damage to property and to persons, including third parties that occur as a result of his or his agent’s or employee’s fault or negligence. The term “third parties” is constructed to include employees of the Government. This includes damage to duplex outlets, corner base molding and knocking parts off cubicle furniture. At their own expense, Contractor shall repair any damage, returning damaged item to original condition.

Contract Administration
AGAR 452.215-73 Post Award Conference (NOV 1996) A post award conference with the successful offeror is required. It will be scheduled at a mutually agreed upon time and date. The conference will be held VIA Teleconference with the Contracting Officer, the COR, and the successful offeror.
Designation of Contracting Officer’s Representative
The Contracting Officer upon award will designate in writing a Contracting Officer’s Representative (COR).
The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract is effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.
The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government, which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract.)
On all matters that pertain to the contract terms the Contractor shall communicate with the Contracting Officer.
Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.
Notification of Subcontracting
The Contractor shall promptly the Contracting Officer upon entering any subcontract arrangement. The notification shall include as a minimum:
1. The name, address, and telephone number of the subcontractor.
2. The date upon which the subcontract was entered into and its duration.
3. A detailed description of the work being subcontracted including a listing of contract items, units, etc., as appropriate.
Use of Premises
The Contractor shall comply with the regulations governing the operation of premises which are occupied and shall perform the contract in such a manner as not to interrupt or interfere with the conduct of Government business.
Public Officials not Personally Liable
There shall be no personal liability upon the Contracting Officer or officer in charge, their agents or employees, for any act performed in the discharge of any duty imposed or the exercise of any power or authority conferred upon them, by, or within the scope of the contract, it being understood that in all such matters they act solely as agents and representatives of the Government.
Basis for Payment
Payment will be based monthly, in arrears, for all work satisfactorily inspected and accepted at the unit prices on the Schedule of Items. All invoices are to be submitted via the electronic Invoice Processing Platform. SPECIAL CONTRACT REQUIREMENTS
Material Safety
The Contractor shall not use or apply any chemicals that may be hazardous or have environmental concerns, without prior approval of the COR. Examples of chemicals: insecticides, pesticides, and harsh cleaning agents. Contractor shall have on site, MSDS (Material Safety Data Sheets) sheets for all chemical products utilized.
USE OF RECOVERED MATERIALS AND BIOBASED PRODUCTS
The Contractor must comply with Section 9002 of the Farm Security and Rural Investment Act of 2002 (FSRIA), Executive Order (EO) 13423, “Strengthening Federal Environmental, Energy, and Transportation Management, “and the Federal Acquisition Regulation to provide bio-based products. The Contractor shall utilize products and material made from bio-based materials to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered of the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal Specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer’s Representative. Additionally, the Contractor shall use recovered materials to the maximum extent possible.
The following is an example list of products that may be used in this contract for which bio-based products or recovered materials are available. The list is not all inclusive. It is desirable that vendors be able to supply the greatest number of bio-based products listed meeting the health and environmental specifications.

EVALUATION CRITIERIA
BASIS OF AWARD
52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. Past Performance
2. Technical capability
3. Price
Past Performance: The offeror must demonstrate performance of similar type, scope, and magnitude to that detailed in this solicitation. Offeror shall provide Past Performance where the Offeror has performed similar janitorial services within the past three (3) years. Include clients name, description of building, square footage, and contact information to include telephone numbers and email addresses.
When evaluating past performance, the contracting officer will consider:
(1). The offerors record of past performance, and to what extent the performance has been satisfactory.
(2). The timeliness of performance.
(3). The Government will also consider personal knowledge and data obtained from other sources when evaluating past performance.
Technical Capability: In 3 pages or less, offerors are instructed to demonstrate capability to perform janitorial services, including quality control.
Price: Technical and past performance, when combined, are of equal importance when compared to price in accordance with FAR 13.106-2. As non-price factors become more equal, Price will become substantially more important.
1. The degree of importance of the price will increase with the degree of equality of the proposals in relation to the other factors on which selection is to be based, or when the price is so significantly high as to diminish the value of the technical superiority to the Government.
2. The Government may award a contract on the basis of initial offers received, without discussions. Therefore, each initial offer should contain the offeror’s best terms from a cost or price and technical standpoint. However, if considered necessary by the Contracting Officer, discussions will be conducted with only those offerors determined to have a reasonable chance for award.
3. The Government reserves the right to make an award to other than the lowest-priced offeror or to the offeror with the highest non-price evaluation if the Contracting Officer determines that to do so would result in the greatest value to the Government.

52.204-29 Federal Acquisition Supply Chain Security Act Orders—Representation and Disclosures.
(DEC 2023)
(a) Definitions. As used in this provision, Covered article, FASCSA order, Intelligence community, National security system, Reasonable inquiry, Sensitive compartmented information, Sensitive compartmented information system, and Source have the meaning provided in the clause 52.204-30, Federal Acquisition Supply Chain Security Act Orders—Prohibition.
(b) Prohibition. Contractors are prohibited from providing or using as part of the performance of the contract any covered article, or any products or services produced or provided by a source, if the prohibition is set out in an applicable Federal Acquisition Supply Chain Security Act (FASCSA) order, as described in paragraph (b)(1) of FAR 52.204-30, Federal Acquisition Supply Chain Security Act Orders—Prohibition.
(c) Procedures.
(1) The Offeror shall search for the phrase “FASCSA order” in the System for Award Management (SAM)( https://www.sam.gov) for any covered article, or any products or services produced or provided by a source, if there is an applicable FASCSA order described in paragraph (b)(1) of FAR 52.204-30, Federal Acquisition Supply Chain Security Act Orders—Prohibition.
(2) The Offeror shall review the solicitation for any FASCSA orders that are not in SAM, but are effective and do apply to the solicitation and resultant contract (see FAR 4.2303(c)(2)).
(3) FASCSA orders issued after the date of solicitation do not apply unless added by an amendment to the solicitation.
(d) Representation. By submission of this offer, the offeror represents that it has conducted a reasonable inquiry, and that the offeror does not propose to provide or use in response to this solicitation any covered article, or any products or services produced or provided by a source, if the covered article or the source is prohibited by an applicable FASCSA order in effect on the date the solicitation was issued, except as waived by the solicitation, or as disclosed in paragraph (e).
(e) Disclosures. The purpose for this disclosure is so the Government may decide whether to issue a waiver. For any covered article, or any products or services produced or provided by a source, if the covered article or the source is subject to an applicable FASCSA order, and the Offeror is unable to represent compliance, then the Offeror shall provide the following information as part of the offer:
(1) Name of the product or service provided to the Government;
(2) Name of the covered article or source subject to a FASCSA order;
(3) If applicable, name of the vendor, including the Commercial and Government Entity code and unique entity identifier (if known), that supplied the covered article or the product or service to the Offeror;
(4) Brand;
(5) Model number (original equipment manufacturer number, manufacturer part number, or wholesaler number);

(f) Executive agency review of disclosures. The contracting officer will review disclosures provided in paragraph (e) to determine if any waiver may be sought. (a) Definitions. As used in this provision—
"Covered telecommunications equipment or services" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
Forced or indentured child labor means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
Inverted domestic corporation, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
