This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

This solicitation is issued as an RFQ. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-05.

This procurement is set aside for Small Business. The NAICS code is 212321 and the Small Business Size Standard is 500 Employees.

DESCRIPTION OF REQUIREMENT:

JACK CREEK AGGREGATE CRUSHING

C.1 – GENERAL REQUIREMENTS

C.1.1 - SCOPE OF WORK

The contractor shall furnish all labor, equipment, materials and incidentals necessary to produce and stockpile crushed gravel in the locations, quantities, quality and gradations specified. The work will be performed at the Jack Creek quarry located on U.S. Forest Service land. The project location map, and quarry site plan is located in Technical Exhibits 1 and 2 within this solicitation.

The aggregate gradation specification is located in Technical Exhibit 4. The required quantities will be specified in the Schedule of Items as awarded.

Crushing activities shall be coordinated with the Forest Service and other users of the pit area.

The contractor shall maintain access roads to the quarry locations.

The contractor is responsible for loading, transporting, and blending of filler material if needed.

The contractor is responsible for reclaiming/regrading all ground surface disturbed by operations.

C.1.2 – TIMING REQUIREMENTS

It is expected that this contract will start in the spring or summer of 2020.

C.1.3 – IDENTIFICATION OF WORK AREAS

The Jack Creek pit is located in the northern Sierra Madre range of the Medicine Bow National Forest near Saratoga, Wyoming.

C.1.4 – CONTRACTOR’S WORK SCHEDULE

Prior to commencing work, the contractor shall provide and maintain an accurate schedule of work to allow timely government quality assurance inspections.

C.1.5 – QUALITY CONTROL PLAN (QCP)

The contractor shall prepare and submit a quality control plan delineating the contractor's quality control program/inspection system to monitor and control the performance of services required in order to meet the requirements of the contract. The government will review this plan after award of the contract and will monitor the contractor's adherence to this plan as part of the government's quality assurance activities.

C.1.6 – DAILY PRODUCTION LOGS

The contractor shall keep a daily production log that records, at a minimum, the production of aggregate, the number of samples taken for testing, the results of the testing of previous samples received that day from the testing facility, and a notes section for important occurrences that day, especially problems encountered that could have affected the quality or measurement of the aggregate. These logs shall be submitted to the Contracting Officer's Representative at the beginning of each week for the previous week's work and shall become the property of the government. No payments shall be made prior to receipt of these records. A sample production log is shown in the technical exhibits. The contactor can use the sample or develop a different log that includes the same information. These logs will be reviewed by the government as part of the Quality Assurance Plan for this contract.

C.1.7 – PIT DEVELOPMENT PLAN

The contractor shall submit a pit development plan to the Contracting Officer's Representative at least five working days prior to development. After approval of the plans, all development shall conform to the requirements of those plans unless otherwise agreed to by the Contracting Officer's Representative.

C.1.8 – STORM WATER PERMIT FOR CONSTRUCTION ACTIVITY

The contractor shall comply with state and local storm water permit requirements. The approximate size of the pit is 5 acres.

C.2 – DEFINITIONS

Acceptable Quality Level (AQL) The maximum allowable deviation from perfect performance that may occur before the government will invoke payment deduction. An AQL does not allow a contractor knowingly to offer defective service, but limits reduced payment to circumstances in which defective performance results in a measurable reduction in the value of services rendered.

Performance Requirements Summary (PRS) The PRS summarizes the service tasks of the contract as well as their respective quality standards, acceptable quality levels, measurement method and incentives/disincentives.

Quality Control Plan (QCP)

A written plan outlining the contractor's quality control program/inspection system to monitor and control the performance of services required in order to meet the requirements of the contract.

Quality Assurance (QA) Those actions taken by the government to assure services meet the requirements of the contract.

Quality Assurance Plan (QASP) A written plan outlining the methods the government intends to use to perform Quality Assurance.

Contacting Officer's Representative (COR) A government person appointed by the contracting officer to help the contracting officer with contract administration and surveillance.

Government Inspector A government person responsible for surveillance of contractor performance.

Quality Control (QC) Those actions taken by a contractor to control the performance of services so that they meet the requirements of the PWS.

C.3 – GOVERNMENT FURNISHED MATERIAL

SOURCE MATERIALS - Crushing sites and source materials are provided by the government. The contractor is relieved of any obligations in obtaining the right to remove material there from and of any responsibility for the quantity of acceptable material therein. Should it develop that the source contains insufficient material, as determined by the government, to meet the contract needs, the government will provide another source, in which event an equitable adjustment will be made in payment for materials produced from the new source and in contract time.

C.4 – CONTRACTOR FURNISHED MATERIAL

Except for those items or services specifically stated to be government furnished in section C.3., the contractor shall furnish everything required to perform this work.

C.5 – TASK STATEMENT AND QUALITY STANDARDS

The task statement applicable for the performance of this work is summarized in C.5.1. The detailed task description including the applicable quality standard is included as Technical Exhibit 3.

C.5.1 – PB 100 GRAVEL CRUSHING

The contractor shall furnish all labor, equipment, materials, and incidentals necessary to produce and stockpile crushed gravel at the designated locations, in the quantities, quality, and gradations specified.

C.6 – BLASTING

In the event explosives are to be used, the contractor is required to notify the Contracting Officer's Representative 24 hours prior to detonation.

The blasting area shall be properly signed, and the contractor shall provide sufficient warning personnel to insure public safety during blasting operations. Signs shall be posted on all roads and trails leading into the area with "CAUTION - BLASTING AHEAD, TURN OFF RADIO TRANSMITTERS", or similar wording. These signs shall be place according to applicable safety rules.

Blasting, storage, and handling of explosives shall be in accordance with requirements of Bureau of Alcohol, Tobacco, Firearms and Explosives and Mine Safety and Health Administration and other authorities which have jurisdiction.

The contractor shall identify all property, structures, and persons which may be affected by blasting and shall take all safety precautions and protective measures to prevent damage or injury to the same. All personal injury or damage to persons or property of any nature, whether in the work area or appurtenant to it, shall be the responsibility of the contractor.

C.7 – POLLUTION AND EROSION CONTROL

The contractor's operation shall be conducted so as to prevent siltation of streams, irrigation systems, lakes and reservoirs.

Pollutants such as fuels, lubricants, bitumen, sewage and any other harmful material shall not be discharged onto National Forest Service lands. Should a petroleum product spill or leak occur on the site, the contractor will notify the CO promptly regardless of spill mount and the Wyoming Department of Environmental Quality in accordance with State regulations. The Contractor shall remove the contaminated soil and dispose of it in an approved disposal site in accordance with instruction from the Forest Service and appropriate State agencies.

Mechanized equipment shall not be operated in live streams without written approval by the Contracting Officer.

C.8 – WASHING EQUIPMENT – WEEDS

To help stop the spread of weeds, this work will require the contractor to wash his equipment, off forest, prior to bringing it on the job site and each time it is removed and returned to the job site unless otherwise agreed. The equipment shall be washed with a pressure washer that is capable of producing enough water force to thoroughly remove all organic and mineral debris, including excess grease, from the machine.

C.9 – SAFETY

The contractor shall provide, erect and maintain all necessary barricades, suitable and sufficient warning lights, danger signals and warning signs. The contractor shall operate all equipment with driving/operating lights and warning flashers, or strobe lights on at all times to increase visibility. All necessary precautions shall be taken for the protection of the work and safety of the public. All signs and devices remain the property and responsibility of the contractor. All signs and sign operations shall conform to the latest version of the Manual of Uniform Traffic Control Devices

(MUTCD).

Warning signs shall be positioned such that they are readily visible and legible and define the work area to the traveling public. Signs shall be posted only when machinery is in operation.

"Trucks Hauling" signs, W20-1, black on orange, 36"x36" size, shall be posted along all haul routes in accordance with MUTCD.

All work conducted under this contract shall be in accordance with the applicable portions of the Mine Safety and Health Administration (MSHA) regulations and Occupational Safety and Health Administration (OSHA) regulations as stated in Section I (Contract Clauses), FAR52.236-13.

The contractor shall conduct MSHA-required Site-Specific Hazard Awareness for all personnel accessing the site, including the CO, COR, and contract inspectors. Such training shall be documented in, files kept on site, with copies submitted to the CO.

The contractor shall submit for approval, at least 10 days prior to beginning on-site work, a written Safety Plan. The Contracting Officer (CO) will review the proposed Safety Plan for compliance with MSHA and OSHA and project requirements. If the Safety Plan requires any revisions or corrections, the contractor shall resubmit the Safety Plan within 10 days of notification by the CO.

No crushing, excavating, drilling, or blasting work shall be performed until the Contractor's Safety Plan has been submitted and approved by the CO. No progress payments will be processed until the Safety Plan has been received and approved.

l. The Safety Plan shall include:

a. Name of responsible supervisor to carry out the program.

b. Documentation or schedule of weekly and monthly safety meetings.

c. Training, both initial and continuing.

d. First aid procedures.

e. Outline each phase of the work, hazards associated with each major phase and the methods proposed to ensure property protection and safety of the public, government personnel, and the Contractor's employees. Identify the work included under each phase by reference to

SPECIFICATION SECTION.

f. Emergency Response: Planning for possible emergency situations, such as accidents, floods, fires, cave-ins, slides, explosions, power outages and storms. Such planning shall take into consideration the nature of construction, site conditions, degree of exposure of persons and property arid evacuation procedures and shall include emergency contact name(s) and phone numbers and route(s) to the nearest emergency response facility.

g. Certificates: Provide certificates from a mechanic that all mechanical equipment has been inspected and meets MSHA/OSHA requirements.

Upon request by the CO, the Contractor shall submit a brief report of safety meetings, of safety inspections, and/or proof of employees' qualifications to perform assigned duties in a safe manner.

C.10 - EQUIPMENT SPECIFICATIONS

All equipment shall be in good working condition and suitable for the work required. Operators shall be competent and experienced in the work required. Equipment shall have safety signing and appurtenances required by MSHA/OSHA, such as Rollover Protection (ROPS), fire suppression devices, lights and slow-moving vehicle signs. Equipment will be inspected by the Contracting Officer's Representative prior to use.

C.11 – SAMPLING AND TESTING

Acceptance tests shall be performed on samples of materials being produced. The samples are to be taken by the Contractor at the crushing or screening plants after addition of any necessary blending materials. The contractor shall perform a minimum of one gradation test with Atterberg limits per 1300 Ton and furnish the Contracting Officer's Representative a copy of the test results within 24 hours of taking the sample. If any test fails to meet the contract requirements, the Contracting Officer's Representative shall be notified immediately, and immediate re-sampling and testing shall be performed. If two successive tests fail to meet contract requirements, all of the material represented by the samples shall be rejected. All sampling and testing shall be performed in accordance with the appropriate ASSHTO test procedures.

The sampling shall not be considered a final acceptance and shall not preclude later sampling and testing after final processing of the material.

C.12 – RECLAMATION

The contractor shall give attention to the effect of contract operations upon the landscape and shall take care to maintain natural surroundings undamaged.

The contractor shall not remove, deface, injure, or destroy trees, shrubs, lawns, or natural features unless specifically authorized by the Contracting Officer's Representative. All existing facilities, public or private, including but not limited to, signs, cattleguards, culverts, and drainage structures, damaged by the contractor shall be replaced or repaired by the contractor at no additional cost to the government. The Contracting Officer's Representative will determine if the damage is too great to be satisfactorily repaired and must be replaced.

The contractor shall leave no refuse from operations, including rocks, reject piles, or timber on or adjacent to the pit areas.

All temporary roads or trails required for access to pit/quarry or borrow sites shall be closed when the project for which they were required is completed. The ditches shall be filled and the roadway rough graded to restore approximately the original contour of the ground or produce a pleasing appearance by forming natural-looking, rounded slopes.

The contractor is responsible for reclaiming all ground surface disturbed in the execution of this contract. To enhance public safety and minimize erosion, no created or substantially modified slope shall be left steeper than 2:1.

Erosion control measures, such as rock energy dissipaters, check dams, sediment basins, etc.

shall be implemented to minimize erosion from the disturbed surface areas and to keep sediment from migrating off site as approved by the CO.

C.13 – SEEDING OF DISTURBED AREAS

The contractor shall provide all labor and materials to see all disrobed area. Seeding shall be done in early spring or fall when temperature and moisture conditions are favorable for germination, as approved by the Contracting Officer’s Representative. A product certification for the seed mix shall be required. The kinds of seed to be furnished and the amounts to be applied, in terms of pure live seed, at the Jack Creek Pit shall be as follows:

C.14 – SITE OPERATIONS

The Contractor shall maintain all roads accessing the quarry in the same or better condition as exists at start of Contract.

For safety and security reasons, the contractor shall install a lock on the site closure gate and lock the gate when no activities are occurring in the quarry. The gate shall remain unlocked during operations at the quarry to allow entrance for emergency vehicles if needed.

Solid waste generated at the site, such as broken equipment, scrap metal, trash, garbage, etc. will be promptly disposed of at an off-site approved facility. Storage of equipment and associated supplies at the quarry is only approved for equipment required for the execution of this contract.

Sanitary waste -Shall be handled in accordance with MSHA regulations.

C.15 – STOCKPILING

The stockpile site shall be cleaned and leveled to a uniform section prior to any stockpiling.

Stockpiles shall be neat and regular in form. Care shall be taken to avoid contamination, degradation and segregation of materials. Contractor shall document material handling procedures to be used during stockpiling to prevent segregation. The documentation shall be approved by the Contracting Officer's Representative prior to crushing operations.

C.16 – INSPECTION AND ACCEPTANCE

Inspection of material for conformance to specifications may be performed at the pit site. These inspections may include, but are not limited to, sampling and testing for conformance to gradation specifications and inspection of the material for unreasonable contamination, degradation, and segregation.

C.17 – FIRE PREVENTION

To prevent wildfire, all internal or external combustion engines will be required to have approved spark arrestors which meet either (I) Department of Agriculture, Forest Service Standard 51001-IA;

or (2) the 80% efficiency level determined according to the appropriate Society of Automotive Engineers (SAT) Recommended Practice 1335 and J350 (36 CFR 261.52(])).

Biobased Product Utilization

The Contractor must comply with the Agricultural Act of 2014; the Food, Conservation and Energy Act of 2008 (FCEA), 7 U.S.C. 8102; the Farm Security and Rural Investment Act of 2002 (FSRIA), 7 U.S.C.

8102; the Federal Acquisition Regulation; Executive Order (EO) 13514, “Federal Leadership in Environmental, Energy and Economic Performance,” dated October 5, 2009; EO 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” dated January 24, 2007; and Presidential Memorandum, “Driving Innovation and Creating Jobs in Rural America through Biobased and Sustainable Product Procurement,” dated February 2012, to provide biobased products.

The Contractor shall utilize products and material made from biobased materials to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer’s Representative (COR).

The following is an example list of products that may be used in this contract for which biobased products are available. The list is not all inclusive. It is desirable that Contractors be able to supply the greatest number of biobased products listed meeting the health and environmental specifications.

Biobased products that are designated for preferred procurement under USDA’s Biopreferred Program must meet the required minimum biobased content as stated in the USDA Final Rule available at www.biopreferred.gov. The Contractor should provide data for their biobased products such as biobased content and source of biobased material.

In addition to the biobased products designated by the U.S. Department of Agriculture in the Biopreferred Program, the Contractor is encouraged to use other commercially available biobased products.

The Contractor shall comply with the provision at FAR 52.223-1, Biobased Product Certification.

The Contractor shall comply with the clause at FAR 52.223-2, Affirmative Procurement of Biobased Products Under Service and Construction Contracts.

The Contractor shall submit with the initial proposal a complete list of biobased products, indicating the name of the manufacturer, cost of each material, and the intended use of each of the materials that are to be used in carrying out the requirements of this contract (see Offeror Submission Information, page 34.

Additionally, the winning Contractor on each anniversary date of the contract shall compile a complete list of biobased products, including the information above, purchased to carry out the contract requirements. The Contractor shall list volume to be used and total cost for each individual product.

This information will be used for reporting purposes (see FAR Clause 52.223-2).
