NOTES TO QUOTER:
The Government will award a firm fixed price indefinite delivery indefinite quantity commercial services contract to the responsible quoter whose quotation, conforming to the solicitation, is the Best Value.
Multiple Awards are authorized. However, USDA APHIS reserves the right to award zero, one, or more Contracts, for all, some, or none of the solicited efforts based on the offeror’s ability to perform desired work and funding fluctuations.
Quotes will be evaluated based on best value in accordance with FAR Part 13.
Price shall include all costs necessary to perform the services as described.
All Quotes must be received no later than 1200 CT on January 4, 2024.
In order to be considered for award of this contract the Contractor must submit the following:

• Information about your company’s technical capability to meet the requirements of this contract
• Information about your company’s past performance relevant to the requirements of this contract
If a contractor’s quote package doesn’t contain all of the items listed above or isn’t received by the closing date and time listed below, the quote may be considered incomplete for evaluation purposes and no further consideration will be given to the contractor’s quote, thereby making a contractor ineligible for award. Quotations that include additional terms may be excluded from consideration. Alternate Pricing Schedules will not be considered.
As part of the evaluation of technical capability, once quotes are received and comparatively evaluated for overall acceptability based on price, past performance, and documented technical capability, a pre-award on-site inspection of acceptable quoters maintenance facilities may be conducted by a USDA APHIS contract inspection team. This team is made up of the Contracting Officer and designated Airworthiness Inspector or other technical representative designated by the National Aviation Coordinator. On-site inspection will be conducted in accordance with the Pre-Award Inspection Checklist included with this RFQ. The Government will assess its level of confidence that the quoter possesses the technical capability necessary to successfully perform the contract based on compliance with the Pre-Award Checklist.

EVALUATION OF QUOTES
The Government will award a firm fixed price indefinite delivery indefinite quantity commercial services contract in accordance with FAR part 13.106 resulting from this solicitation to the responsible contractor whose quote conforming to the solicitation will be most advantageous to the Government, price, past performance, and technical capability considered. Award will be made to the quote determined to be the best value. The USDA’s comparative evaluation of contractor quotes will consider the contractor’s ability to meet the agency’s needs and the contractor’s demonstrated ability to perform the services outlined in the statement of work. The Government does not assume the duty to search for data to cure the problems it finds in the information provided by the Contractor. The burden of providing thorough and complete responses remains with the Contractor.

SCHEDULE NOTES
1) The quantities as listed in the “Schedule of Items” are estimated requirements for this contract period. The Government estimates, but does not guarantee, the volume of purchases under this contract. The USDA, APHIS attempts to be as accurate as possible when providing estimated quantities, however, actual quantities required may vary from the quantities listed.
During the period of performance of the contract, the number of aircraft may vary. Other than the minimum contract amount stated in AGAR clause 452.216-73 below, no guarantee is given as to the actual number of inspection hours, hourly labor or parts required during the term of this contract.
2) Line items (a), (b), (c), and (d) are firm fixed price indefinite delivery indefinite quantity. Line items
(e) and (f) are reimbursable only based upon the actual costs for labor hours or the parts utilized. The costs for these line items must be the contractor’s fully burdened rates. Therefore, the costs of the contractor’s parts must include their material handling costs. The pricing for the parts must vary depending on the type of part, whether it is new, overhauled, or serviceable part. NOTE: The costs for repairs and parts are separate from the line items for inspections. Line item (g) for travel is reimbursable.
3) Repairs are to be performed as firm fixed price. For any repairs the contractor must provide the
USDA, APHIS, WS program representative a firm fixed priced quote based on their assessment of the repairs to be completed. Once the quote has been reviewed and approved by the USDA, APHIS, WS program representative, the contractor can proceed with the repairs.
4) On rare occasions travel may be required to perform the services outlined in the Statement of Work if the aircraft is inoperable due to mechanical issues and cannot be flown to the Contractors facility.
Travel must be authorized in advance by the Contracting Officer Representative. If travel is authorized, travel is subject to the limitations established in Federal Travel Regulations (FTR). The Contractor must be paid for travel expenses based on actual cost but not exceeding the FTR per diem rates. Reimbursement is authorized only for lodging and M&IE per diem. 5) The Department of Labor Service Contract Act applies to this contract so the contractor must take this into consideration when developing a price quote. The contractor is responsible for obtaining https://www.gsa.gov/policy-regulations/regulations/federal-travel-regulation https://www.gsa.gov/portal/content/104877 the wage determination applicable to the location of their facility where the services will be performed as well as determining the appropriate labor categories/occupation codes under the applicable wage determination. PART 2.0 – STATEMENT OF WORK
2.0 Background
To protect U.S. agricultural and natural resources, a primary responsibility of the USDA’s Wildlife Services (WS) is to provide Federal leadership and expertise to resolve wildlife conflicts and create a balance that allows people and wildlife to coexist peacefully.
2.1 Scope of work
The United States Department of Agriculture (USDA), Animal Plant Health Inspection Service (APHIS), Wildlife Services (WS) has a requirement for the inspections, maintenance, repairs, replacement of life limited components, and installation of specialized mission equipment of their fixed wing aircraft for their base of operation in Elko, Ely and Winnemucca, Nevada and any potential transient aircraft that are flown to the facility in Elko, Ely and Winnemucca, Nevada. USDA reserves the right to add additional aircraft with prior coordination.
The respective aircraft are flown an estimated 1,090 hours annually. The requisite 100-hour inspections, annual inspection, and corresponding maintenance or repairs will be conducted during the term of this contract, depending on the actual hours flown.
All services under this contract are to be performed at the contractor’s facility. The USDA does not have a facility where these inspections, maintenance, repairs and equipment installation can be completed, nor can the services be performed in the facility where the USDA aircraft are parked or hangered.
Other than the minimum contract amount stated in AGAR clause 452.216-73 below, no guarantee is given as to the actual number of hours flown or the number and types of inspections that will be required during the term of this contract.
2.2 Contract Type and Term
The government will award a firm fixed price indefinite delivery indefinite quantity commercial services contract.
The period of performance for this contract includes five (5) ordering periods with each ordering period being twelve (12) months in duration.
2.3 Contractor Requirements
The Contractor must comply with all state statutes that pertain to aircraft repair facilities and services in the state where the work is performed.
The Contractor must specifically comply with Federal Aviation Regulations. The aircraft must be maintained and repaired in accordance with FAR parts 21, 23, 39, 43, 91 and 135 as deemed applicable by the WS Aviation Airworthiness Inspector.
The Contractor will also perform corresponding or incidental repairs related to or detected during maintenance procedures. Inspections must be completed within 5 working days from date the fixed wing aircraft is delivered to the place of performance.
The Contractor must provide technically competent aircraft maintenance personnel to perform the inspections, maintenance, and repairs of all work ordered under the contract. The Contractor must utilize a system of quality control to assure that all work performed under this contract complies with Federal Aviation Regulations.
The Contractor must provide all special tools, common hand tools, aircraft support, handling and service equipment required for work under this contract.
The Contractor must make the appropriate logbook entries for inspection and maintenance performed.
Aircraft records must be maintained in accordance with FAA Regulations or later revision.
2.4 Emergency and After-Hours Repairs
A maintenance facility mechanic must be able to be contacted by the pilot, WS Aviation Airworthiness Inspector, and/or State Director by telephone during working hours. After hours contact phone numbers must also be made available.
2.5 Facilities, Equipment and Inspection Data
The Contractor must maintain a repair facility appropriate in size and layout and properly equipped for maintenance and repairs of the respective aircraft that need service under this contract. The Contractor’s maintenance facility must be secure from unauthorized persons.
All appropriate manuals, directives and bulletins for the respective aircraft under this contract must be maintained on site by the Contractor.
Contractor must own or have available the necessary tools or be able to obtain the necessary tools so the work is completed within the required timeframes, and to ensure the level of service provided meets all Federal Aviation Administration and Federal Aviation Regulations requirements.
The Contractor MUST NOT subcontract any portion of the maintenance or repair work without the written consent of the USDA, APHIS, WS.
2.6 Accessibility
APHIS, WS reserves the right to inspect the facility, or designate representatives, for adequate maintenance capability before the contract is awarded and during the term of the contract during regular business hours.
The aircraft must be accessible to Wildlife Services personnel while it is hangered at the Contractor's maintenance facility. The aircraft maintenance logbooks must be accessible to the pilot and the WS Aviation Airworthiness Inspector. The Contractor must allow Government personnel access to the aircraft for the purpose of monitoring maintenance.
2.7 Employee Training/Qualifications
The repair facility must have at least one certified mechanic to perform the inspections, repair, and maintenance for the aircraft in order to accomplish the work of this contract within the specified timeframes indicated. It is highly preferable the facility have two certified mechanics to ensure that the aircraft will be repaired without undue down time even during after hour’s emergencies or unanticipated heavy workloads.
The certified mechanic must have an FAA Airframe and Power plant certificate. The maintenance facility will need to have personnel readily available or on staff with an A&P certificate with FAA Inspection Authorization in order to sign off annual inspections, so the work is completed within the required timeframe.
2.8 Communication
The mechanic(s) and USDA, WS pilot(s) must maintain a professional dialogue about the condition and airworthiness of the aircraft at all times.
2.9 Agency Responsibilities
The USDA, APHIS, WS will advise the Contractor at least 5 days in advance of upcoming and specified inspections based on agency usage.
The Government will provide information and records reflecting the current status of the aircraft at the time and place the aircraft is delivered for maintenance.
2.10 Delivery of Services
The aircraft will be delivered to and picked up from the Contractor’s maintenance facility by a certified APHIS, WS pilot. APHIS WS qualified pilot must perform all maintenance and test flights.
Maintenance starts and ground runs may be performed by qualified maintenance personnel.
Generally, verbal orders for scheduled maintenance services will be placed at least 5 days in advance of when the service is to begin. An appropriate work order signed by an APHIS WS employee will accompany the aircraft to the contractor’s facility. The contractor will sign the work order acknowledging the work to be completed and provide a copy of it back to the pilot delivering the airplane. The contractor must respond to requests for unscheduled maintenance as soon as mutually agreed to by the government and the contractor. If the contractor is not able to respond in a reasonable time, maintenance services may be obtained from another source. An on the spot, verbal authorization to complete the unscheduled maintenance may be given, but the written work order as described above must be completed and returned within 48 hours.
It is impractical to expect contractor to always be able provide a firm estimate upon receipt of aircraft without having the ability to determine the nature and extent of repairs required when aircraft requires disassembly. Contractor must provide a cost estimate as soon as reasonably possible to receive approval to proceed. Contractor will communicate any changes from what was approved prior to performing the work, unless approved in advance.
The Contractor must notify the Government of maintenance items that were not originally anticipated prior to beginning work on those items.
2.11 Parts
The Contractor must provide all parts, materials, and consumables. All parts or components which fail inspection or are nonconforming need to be replaced in accordance with FAR 52.212-4(a).
The Government intends to purchase most parts from the Contractor. At times the Government may provide parts and materials when it is timelier or cost effective.
2.12 Transportation Expenses
The cost of transporting the aircraft to and from the Contractor’s facility for the services to be performed must be the responsibility of the Government. It is highly advantageous to the government to have a contractor facility in close proximity to the location where the aircraft are stationed to reduce transportation and travel related costs.
2.13 Contractor Liability
The Contractor is liable for any damages, losses, or injuries to people and property which occur as a result, directly or indirectly, from work performed by the contractor’s employees and subcontractors while under contract with USDA/APHIS. The Contractor must immediately notify the Contracting Officer of any damages, losses, or injuries occurring during the performance of any contract with
USDA.
2.14 Inspection Time Frames
So as to not cause any delays, the inspections and maintenance must be completed within five (5) calendar days from the date the aircraft is delivered to place of performance. If repairs are necessary, the contractor needs to contact the USDA, WS with an estimate and come to an agreeable time frame for completion of the repairs.
2.15 Government Roles and Responsibility
The USDA, APHIS, WS must designate a Representative(s) to work with the Contractor(s) to coordinate all aspects of this contract.

Although the designated WS Program Representative must be the contractor’s main point of contact for coordinating services under this contract, other Wildlife Services personnel in Texas will be assisting in coordinating services under this contract. Their names will be provided after award. If other WS personnel have contact with the contractor, they must include the designated WS Program Representative in their communications or advise the designated WS Program Representative of any communications with the contractor.
2.16 Task Order Services
Funding will be obligated on the contract via a task order. Funding will be provided as a fixed amount for the inspection services but will be provided in a bulk not to exceed amount for hourly labor repair services and parts. Although a bulk task order will be issued, services to be provided under the task order are to be firm fixed price.
Repair services and parts will be on an as needed basis and be ordered by verbal or written orders of the COR or a designated WS person listed below. Repair services and parts may also be paid for on a government purchase/credit card.
The Contracting Officer may provide funding under this contract obligating funds for the procurement of repairs and parts prior to the Government needing delivery of said ordered quantities.
The COR or designated WS person will be allowed to coordinate services and schedule specific delivery and performance dates and quantities up to, but not exceeding, the total quantity authorized by the Contracting Officer.
The following individuals are authorized as the designated WS personnel under this contract for ordering of services against the task order. All ordering of services must be coordinated with the COR or designated WS person listed below, and the CO must be informed of all services ordered.
Additional names of personnel may be provided in writing to the Contractor as needed.

The contractor and WS personnel will be required to inform the APHIS Contracting Officer when the task order reaches 80% of the total bulk quantities.
2.17 Fair Opportunity
When the government determines specific maintenance needs, vendors with IDIQ contracts offering the desired maintenance within the nearest geographical area will be provided a fair opportunity to be considered for award. If multiple vendors are in the same geographical area the lowest price based on established schedule pricing will receive the award.
2.18 Invoices and Payment Information
The USDA, APHIS uses the Invoice Processing Platform (IPP) for electronic submission and tracking of invoices and payment information to its suppliers of goods and services. Invoices must be submitted electronically to the IPP invoicing system. The contractor must enroll at https://ipp.gov
Invoices must be prepared in accordance with 52.212-4 (g). Invoices which involve repairs under line item (d) and parts under line item (e) must provide a summation of the actual labor hours expended and a breakdown of all parts used in the repairs.
Credit card purchases are allowed under this contract. The USDA, APHIS Contracting Officer will provide authorization and the names of the individuals with authorization for credit card purchases under this contract. The authorization will be in the form of written verification via email.
2.19 Safety and Security Requirements
The Homeland Security Presidential Directive-12 (HSPD-12), dated August 27, 2004, requires the development and agency implementation of a mandatory Government-wide standard for secure and reliable forms of identification for Federal employees and contractors, including contractor employees.
As directed by HSPD-12, on February 25, 2005, the Department of Commerce issued FIPS PUB 201, which is a Federal standard for secure and reliable personal identity verification (PIV) for routine physical access to Federally controlled facilities or information systems. Office of Management and Budget (OMB) memorandum M-05-24 dated August 5, 2005, provides instructions for implementing HSPD-12 according to FIPS PUB 201, and M-08¬01, dated October 23, 2007, reminds all parties that a background investigation is required.
48 CFR 3052.204-71 requires each individual employed under a Federal contract must be a citizen of the United States of America, or a non-U.S. citizen who has been lawfully admitted for permanent residence as evidence by a Permanent Resident Card (USCIS I-551).
Contractor’s must identify in their quotes or proposals, the names and citizenship of all non-U.S.
citizens proposed to work under the contract. Any additions of deletion of non-U.S. citizens after contract award must also be reported to the CO.
All applicable contractor employees requiring routine physical access to Federally-controlled facilities and/or routine access to Federally-controlled information systems must go through the identity proofing and registration process, must have been successfully identity proofed, and have a successfully adjudicated National Agency Check with (Written) Inquiries (NACI) or Office of Personnel Management (OPM)/National Security (NS) community background investigation (BI) to serve on the contract. Contractor ID credentials will be issued after successful identity proofing of the contractor employee applicant and upon a successfully adjudicated NACI or OPM/NS BI. The contractor personnel will be required prior to starting work under this contract as well as maintaining it https://ipp.gov/ throughout the duration of the contract. If an option year is exercised, the contractors must renew their credentials at the end of their period of performance. If no option year is exercised, the contractor must turn in their ID credential at the end of the performance period or when service on the contract ends.
The procedures to be followed by contractors and contractor employees are specified in DM 4620-
002. The contractor must comply with the personal identity verification (PIV) policies and procedures established by the United States Department of Agriculture (USDA) Directives 4620-002 series which can be found at Common Identification Standard for U.S. Department of Agriculture | USDA
The contractor must appoint a representative to manage compliance with the PIV policies established by the USDA Directives 4620-002 and to maintain a list of employees eligible for a USDA LincPass required for performance of the work. Should the USDA Directives 4620-002 require the exclusion of a contractor's employee, the Contracting Officer will notify the contractor in writing.
The responsibility of maintaining a sufficient workforce remains with the contractor. Contractor employees may be barred by the Government from performance of work should they be found ineligible or to have lost eligibility for a USDA LincPass. Failure to maintain a sufficient workforce of employees eligible for a USDA LincPass may be grounds for termination of the contract.
All personnel must have a valid driver’s license or identification.
The contractor must, through their own internal background investigation protocol and pre-employment investigation, ensure that each contractor employee submitted for a federal background investigation is reasonably expected to receive a favorable adjudication of their respective investigation.
The USDA will pay for the required federal background investigation. The government must have and exercise full and complete control over granting, denying, withholding, or termination the background investigation clearance for employees.
The PIV Sponsor for this contract is a designated program point of contact, which in most cases is the COR, unless otherwise specified in this contract. The PIV Sponsor will be available to receive contractor identity information from (days and hours) to at (office address for registration). The Government will notify the contractor if there is a change in the PIV Sponsor, the office address, or the office hours for registration; however, it is the contractor's responsibility to meet all aspects of the information contained in this contract on background investigations, safety and security information.
The Contracting Officer (CO) will include the PIV Sponsor duties when issuing the designation memorandum to the COR (or other designated program/project manager).
Work under this contract may require that personnel have access to Privacy Information. Personnel must adhere to the Privacy Act, Title 4 of the U.S. Code, Section 552a and applicable agency rules and regulations. Privacy of PIV information must be maintained in accordance with the Privacy Act of 1974.
The contractor must insert this clause in all subcontracts when the subcontractor is required to have routine unaccompanied physical access to a Federally controlled facility and/or routine unaccompanied access to a Federally controlled information system.

2.20 Wage Determination and Labor Rates
The Department of Labor Service Contract Act applies to this contract. The contractor must be responsible for obtaining the wage determination applicable to the location of their facility where the services will be performed as well as determining the appropriate labor categories/occupation codes under the applicable wage determination. Task orders may specify the applicable wage determination for the ordering period.
