LAND BETWEEN THE LAKES (LBL)

PERFORMANCE WORK STATEMENT (PWS)

WATER/WASTEWATER OPERATION AND MAINTENANCE SERVICES

FISCAL YEAR (FY) 19

C.1 GENERAL

For the purposes of the Performance Work Statement (PWS), the United States Department of

Agriculture (USDA) Forest Service (FS) Land Between The Lakes (LBL) National Recreation

Area (NRA) shall be referred to as either LBL or the Government. The Offeror(s) for work covered by this PWS shall be referred to as the Contractor.

All work shall be in compliance with all appropriate local, State, and Federal rules, regulations, codes, laws, the Forest Service Handbook (FSH), and the Forest Plan (FP). The Contractor shall at all times observe and comply with those laws and regulations in effect at contract award, as well as new legislation and amendments that become effective during the term of this contract.

Water Operators are required to have Level B and D from both states KY and TN, they also are required to have a Wastewater Operators License from both states KY and TN. Water Operators personnel and licenses are to be included in offeror’s bid proposal. See Attachment 6, Deliverables.

C.2 FACILITIES/AREAS TO BE MAINTAINED

Information on facilities/areas to be maintained can be found below, at www.landbetweenthelakes.us and within Attachment 4, Facility Information.

C.3 WATER/WASTEWATER PLAN

The Contractor shall propose a Water/Wastewater Management Plan that includes all management, operational, and compliance requirements of the State and Federal Government. As a minimum, it shall contain a list of facilities, a schedule of maintenance, operation, and testing required and planned, required reports and their preparation schedule. The contractor shall develop a contingency plan for all systems in the event of short and long term power outages and/or acts of God, including what actions shall be taken to re-establish State and/or Federal

Regulatory compliance.

C.4 SPECIFIC TECHNICAL TASKS

The Contractor shall provide all labor, supervision, equipment, tools, and other items, resources, and services necessary to schedule and provide routine, special response, preventive, cyclical, and non-routine operations and maintenance services for water/wastewater facilities, structures, programs, activities, and lands within LBL. The Contractor shall provide all personal protective equipment (PPE), chemicals, equipment, materials, and services to perform the requirements of this contract. Such equipment and the use of that equipment shall be subject to the inspection and approval of the Contracting Officer (CO), the Contracting Officer Representative (COR), and Inspectors.

Water/wastewater tasks include, but are not limited to, maintenance and operation of water/wastewater systems, cleaning, pumping and disposal of effluent for chemical toilets, vault toilet, septic tanks, and holding tanks. Tasks include managing, operating, compliance, remediation, planning, scheduling, operating, testing, report preparation, and maintaining records and files. The Contractor shall ensure that all chemical toilets, vault toilets, septic tanks, and holding tanks are clean, reasonably free of objectionable odors, are pumped on schedule, and the effluent is disposed of in an acceptable manner in accordance with State and Federal rules, regulations, permits, and laws.

C.4.1 POTABLE WATER SYSTEMS

The Contractor shall maintain and operate the LBL potable water distribution systems, including maintaining test results. At contract award, potable water is provided by wells in 20 water systems. See Section C.12 for a list of Potable Water Systems. When test results indicate that the water is not fit for human consumption, the Contractor shall immediately restrict access to the suspected contaminated water source in accordance with State laws and regulations, and the

Contractor shall provide the CO with the results of analysis within two hours.

C.4.2 WASTEWATER SYSTEMS OPERATION AND MAINTENANCE

All wastewater systems, including the United States (US) Environmental Protection Agency

(EPA) National Pollutant Discharge Elimination System (NPDES) permitted wastewater systems, shall be inspected, operated and maintained by the Contractor in accordance with the permit and all applicable State and Federal laws and regulations. See Section C.10 for a list of

NPDES permitted systems within LBL. Copies of current NPDES permits are available from the

Government. See Section C.11 for a list of all Non-NPDES permitted systems within LBL. The

Contractor shall notify the CO in writing within 24 hours of notice of any violation(s).

C.4.3 INACTIVE SYSTEMS

There are systems throughout LBL which are inactive at contract award. The inactive systems shall not be serviced unless directed by the COR and modified on contract. The Government may choose to activate or inactivate systems at will. Costs to deactivate or re-activate systems shall be negotiated. Costs to service systems shall be at current contract costs.

C.4.4 NONCOMPLIANCE

In the event of an occurrence of noncompliance, the Contractor shall take action in accordance with the appropriate State or Federal regulations. The Contractor shall notify the CO in writing within 24 hours of occurrence, and once compliance is achieved.

C.4.5 PUMPING

The Contractor shall be responsible for the pumping of sites listed in Sections C.10 and C.11.

The Contractor shall be responsible for all disposal pumped materials.

LBL has a lagoon with wetland located adjacent to the Elk and Bison Prairie. The lagoon is available for disposal of chemical toilet waste, vault toilet waste, septic tank pumped waste, holding tank waste, and, upon prior approval of the CO, treatment plant waste sludge. If the waste is disposed of outside LBL, the Contractor shall furnish the CO and COR with documentation of the location and approval from a state approved facility for such effluent.

C.4.5.1 SEWAGE LAGOON PUMPING

The Contractor shall propose the frequency and associated cost for pumping the sewage lagoon, which was emptied of solids as of June 2012. Pumping of the lagoon will be handled by a work order as needed.

C.4.5.2 SEPTIC AND HOLDING TANK PUMPING

Septic and holding tank pumping shall be initiated by the result of testing verifying that the total tank volume is being occupied by more than 1/3 of solid matter as a calculation of sludge and scum. As a result, the intent is to remove the solids at the 90th percentile. Effluent liquids shall remain in place at the 70th percentile.

C.4.5.3 VAULT TOILET PUMPING

Vault toilet pumping shall be triggered when the tank level is more than 1/2 full. The end result shall be total tank volume at less than 5% and vault wall generally free of solid matter. The manhole gasket area on the vault toilet must be thoroughly cleaned. The manhole cover must fit with an airtight seal for the unit to function properly. Manholes shall be locked immediately after service has been performed.

C.4.5.4 CHEMICAL TOILET PUMPING

Chemical Toilet pumping shall be emptied to less than 5% of total tank volume, recharge with a holding tank deodorizer at 5% of total tank volume.

C.4.6 HAZARDOUS WASTE

The Contractor shall provide hazardous waste response, when requested by the COR. Hazardous waste response typically stems from visitor’s actions resulting in effluent on roadways. Funds for this task will be pre-obligated on contract, with a work order issued upon need.

C.4.7 TESTING

The Contractor shall perform an initial testing of all tanks and vault toilets within 60 calendar days of contract award. The Contractor shall report any incidents that result in differing site conditions immediately in writing to the CO. The Contractor shall provide the CO with a copy of the results of the initial testing, and all subsequent testing within 10 business days of testing.

When testing results in a need for pumping, the Contractor shall test after pumping and provide before and after test results to the CO within 10 business days of testing.

C.4.8 WATER/WASTEWATER PLAN

The Contractor shall maintain a comprehensive Water/Wastewater Plan, as created and submitted during the solicitation phase. An updated copy of the Contractor’s Water/Wastewater

Plan shall be provided to the CO for approval as changes occur.

C.4.9 REPORTING

The Contractor shall utilize a computer-based water and wastewater data program with the necessary software and hardware. This system shall be used to collect, store, and generate reports for compliance reporting to State and Federal agencies. The Contractor shall submit a monthly report to the CO or COR.

The Contractor shall prepare and submit all required documents regarding water/wastewater programs under this PWS to the appropriate regulatory agencies no later than established reporting deadlines. The Contractor shall prepare and submit to the CO for approval and signature all necessary permits, reports, guidance documents, manifests, and supporting documents to support proposed or existing operations subject to provisions of Federal and State regulations. The Contractor shall maintain records and all necessary documentation that comply with permit conditions/agreements in an orderly and accessible manner.

C.4.10 INSPECTIONS

The Contractor shall accompany the CO or COR during inspections conducted by Federal or

State regulatory authorities. The Contractor shall prepare responses to requests for information concerning regulatory inspections, permits, or other regulatory issues, and submit a copy to the

CO. These actions shall be at no cost to the Government.

C.4.11 SPECIAL EVENTS

The Contractor shall provide chemical toilets for special events and activities within LBL. Funds for this task will be pre-obligated on contract, with a work order issued upon need. The COR will notify the Contractor of the event at least one week in advance of the scheduled event. See

Exhibit 2 for routine and special events, which require chemical toilets.

C.4.12 CLEANING TOILETS

The Contractor shall clean the vault toilets and chemical toilets after pumping. Cleaning shall include washing and sanitizing the inside and outside of the unit; disinfecting toilet bowls, risers, urinals, and seat covers to be free of deposits on surfaces; floors shall be free of standing water;

and deodorant sprayed as needed to reduce odors. The Contractor shall report any vandalism to vault toilets and chemical toilets to the COR immediately upon discovery.

Recurring cleaning of chemical toilets and vault toilets shall be performed by the Grounds

Maintenance contractor. Coordination between the Water/Wastewater contractor and the

Grounds Maintenance contractor will be required in order to prevent duplication of effort.

C.4.13 PREVENTIVE MAINTENANCE

The contractor shall inspect filters on lift station pumping systems and change filters as needed.

C.5 INITIAL INVENTORY

The Government will make available those items listed in this PWS and Attachment 7, Government Property. The current number of Vaults, Chemical Toilets and vault toilets are shown in Exhibit 1. All toilets are Government Furnished Property (GFP). Within 20 business days of the contract award, the Contractor shall conduct an independent inventory of all GFP.

Failure of the Contractor to conduct an inventory shall require the Contractor to accept the inventory as determined by the Government.

The Contractor shall specify in their bid whether they intend to use some or all GFP available.

The Government reserves the right to use GFP, upon coordination with the Contractor. The

Government shall be responsible for repair of the GFP if it breaks during Government use. All other repairs and maintenance shall be at the Contractor’s expense.

The Contractor shall not mark or affix decals, emblems or signs portraying the Contractor’s name or logo on GFP. The Contractor shall not use GFP for purposes other than those described in this PWS. All GFP shall remain on LBL property, unless prior approval is received in writing from the CO.

The Contractor shall supply all fuel, lubricants, and spare parts, repair and maintenance as necessary to keep GFP in good operating condition. The Contractor shall notify the CO in writing as GFP becomes unusable or otherwise not needed by the Contractor. When GFP becomes unusable, it shall be replaced by the Contractor at the Contractor’s expense, if required for the performance of the Contract. Any replaced GFP shall become the property of the

Contractor and shall be removed at the termination of the Contract. GFP furnished by the

Government and not replaced shall revert to the Government at the expiration or termination of the contract.

C.5.1 INVENTORY DOCUMENTATION

The Contractor shall prepare, certify, and submit a detailed electronic copy of the Property

Inventory within 5 business days after completion of the inventory. The inventory shall be jointly approved by the Government and the Contractor. The Contractor shall maintain the inventory in a current status throughout the contract. Inventory data should include the location, asset number, condition, and description (including manufacturer, model, serial number, and

USFS ID numbers when applicable).

Government property not desired for use by the Contractor shall be identified by written notification prior to submission of the Government property inventory report. Yearly property inventory must be completed by 30 September and the final document submitted within 5 business days.

C.5.2 INVENTORY DISCREPANCIES

Throughout the term of the contract, the Contractor shall report inventory discrepancies upon discovery. Inventory discrepancies shall be forwarded to the CO within 5 business days of discovery.

C.5.3 ADDITIONS TO INVENTORY

Additional toilets, tanks, or systems may be put into service at the Government’s discretion. The cost for service for additional units shall be at the current contract rates.

C.5.4 FINAL JOINT PROPERTY INVENTORY (FJPI)

The Contractor and Government shall complete a Final Joint Property Inventory (FJPI) of all

Government Furnished Property (GFP) and Government Furnished Facilities (GFF), if applicable, not later than 30 calendar days prior to expiration or termination of the contract. See

Section C.23 for information on GFF. The Contractor shall prepare, certify, and submit a detailed electronic inventory report to the CO within 5 business days after the completion of the joint inventory.

C.6 TOILET MAINTENANCE

The Contractor shall notify the COR when vault toilets are found to be inoperable or aesthetically unappealing. The Contractor shall maintain Chemical Toilets to serviceable standards. The Contractor may be requested to remove and replace chemical toilets, via modification to the contract.

When chemical toilets become unserviceable, the Government will determine the method of replacement in consultation with the Contractor. The new toilets shall be equal to or better than the existing toilets. The Contractor may be requested to purchase toilets, with reimbursement made at cost. Purchases shall be requested via modification, which shall include the brand name, specifications, and the price to be paid for the toilet(s). The Contractor shall submit receipts to the CO. All toilets shall remain the property of the Government at the expiration or termination of this contract.

C.7 GENERAL SERVICES ADMINISTRATION (GSA)

The Contractor shall be authorized to purchase equipment and other supplies and materials for performance of work described in this PWS through General Services Administration (GSA) and other Government sources.

C.8 SCHEDULE

The schedule for pumping shall be determined by testing, as described in Section C.4.7. As a result of visitation, pumping may be required on holidays and weekends. Annual visitation can be found in Attachment 5, Visitation.

The Government may request additional service on a “Special Response” (hourly) basis.

C.9 CLEAN UP

Contractor-generated debris and rubbish shall be removed from the work site daily. The

Contractor shall not dispose of Contractor-generated debris in dumpsters located on LBL. The

Contractor may utilize dumpsters located at the Maintenance Complex, with prior permission provided by the CO. Debris and effluent shall be removed and transported in a manner to prevent spillage on the roads, parking areas, and adjacent areas. The Contractor shall notify the

CO and COR within 2 hours of any spills or leaks caused by the Contractor’s (employees or subcontractors) actions.

The Contractor is solely responsible for remediation of any and all spills or leaks which occur as a result of or are contributed to by the actions of its agents, employees, or subcontractors. The

Contractor shall remediate such spills or leaks to the satisfaction of the Government. The cost for all remediation shall be at the Contractor’s expense.

The Contractor shall be paid once per month after work has been accomplished.

C.18 PERFORMANCE STANDARDS
