52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021) (Provision)
Evaluation will be completed as follows:
The Government will review proposals received to determine if they are responsive to the requirements. A responsive proposal is one that meets all of the terms, conditions and specifications in the solicitation. The Offeror must provide all documents listed and comply with all proposal instructions in order for their proposal to be considered “responsive” to this solicitation. Only responsive proposals will be evaluated for award.
In accordance with the LPTA process, technical tradeoffs will not be made and no additional credit will be given for exceeding acceptability. Award will be made to the Acceptable Offeror with the lowest Total Evaluated Price (TEP) whose proposal is evaluated as acceptable under both Factors I Technical and Factor II Past Performance, and which is deemed responsible in accordance with the Federal Acquisition Regulation (FAR). The Government reserves the right to award without discussions. Therefore, each initial offer should contain the Offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if determined to be in the Government’s best interest.
EVALUATION CRITERIA
Only those Offerors determined to be technically acceptable with an acceptable past performance rating, either initially or as a result of discussions, will be considered for award. An award will be made to the lowest priced Offeror with an Acceptable Factor I – Technical and Acceptable Factor II
- Past Performance rating.
The Government will evaluate the following factors:
Factor I – Technical – Experience/Key Personnel
Subfactor 1 – Minimum 1 year experience
Subfactor 2 – Minimum 3 Recent and Relevant Projects performed in the last 3 years
Subfactor 3 – Projects similar in size and scope of this solicitation.
Subfactor 4 – Ability to execute multiple orders at various location at one time
Factor II – Past Performance
Subfactor 1 – Recency
Subfactor 2 - Relevance
Factor III - Price
Factor I – Technical – Experience/Key Personnel. The Technical Acceptability evaluation provides an assessment of the offeror’s capability to satisfy the Government’s requirement. The evaluation will focus on whether the offeror’s proposal meets or does not meet the Government’s requirements. The Technical Acceptability factor will receive one of the adjectival ratings defined below in Table 1. Sub-factors will not be rated separately, rather they will be evaluated together in order to derive an overall Technical Acceptability factor rating. Offerors must receive an “Acceptable” rating for the Technical Acceptability factor in order to be considered for award.
Table 1 - Technical Acceptable/Unacceptable Ratings Rating Description
Acceptable Quote clearly meets the minimum requirements of the solicitation.
Unacceptable Quote does not clearly meet the minimum requirements of the solicitation.
Initially, the Government technical evaluation team will evaluate the technical proposals using ratings of “Acceptable,” or “Unacceptable.” Failure to meet all requirements may result in an offer being determined technically unacceptable. The technical proposal shall be evaluated against the following sub factors, and address the following:
Subfactor 1 – Minimum 1 year experience
Subfactor 2 – Minimum 3 Recent and Relevant Projects performed in the last 3 years
Subfactor 3 – Projects similar in size and scope of this solicitation.
Subfactor 4 – Ability to execute multiple task orders at various location at one time
NOTE:
“Recent past performance” is defined as active or completed efforts performed within the past three
(3) years from the issuance date of this solicitation.
“Relevant past performance” is defined as Relevant Experience in a similar type setting, competence in the type of cleaning required for a multi building, office, laboratory and test floor setting.
Factor II – Past Performance. Past performance will be evaluated on the basis of the following sub-factors of equal importance:
Subfactor 1 – Recency
Subfactor 2 - Relevance
Recency Assessment. An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past three (3) years from the solicitation issuance date. Recent past performance is defined as not more than 3 years from the RFQ release date; relevant in terms of similar nature of work, size and complexity.
Relevancy Assessment. To be relevant, the effort must be similar in nature of work, size, and complexity. The Government will conduct an in-depth evaluation of all recent performance information obtained to determine if it is the same or similar in nature of work, size, and complexity to the services being procured under this solicitation.
Assigning Rating. The Past Performance Factor will be assigned one of the ratings defined below.
Table 2 - Past Performance Evaluation Ratings
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
The evaluation team will perform a Factor II Past Performance evaluation on each offerors proposal. The Government will use past performance information from Government databases such as the Contractor Performance Assessment Reporting System (CPARS) Database and Contractor Responsibility Assessment, etc., which is available using the Offerors DUNS number submitted with 52.212-1 Instructions to Offerors. An offer will be determined to be acceptable under Factor II Past Performance in accordance with the following procedures:
1) The Government will use your past three (3) years performance which is derived from CPARS for that assessment.
2) For the Offeror to receive an acceptable Past Performance Ranking, their CPARS ratings must be equal to or greater than “Satisfactory” in at least half of all proposals evaluated.
3) If the Offeror does not have at least three (3) CPARS records, the Offeror will be required to provide three (3) but no more than five (5) recent and relevant, in magnitude and scope, Past Performance Questionnaires. The Offeror will be required to have these sent to the Contracting Officer directly from the organization completing the questionnaire.
4) Offerors without a record of relevant past performance or for whom information on past performance is not available or so sparse that there is no meaningful past performance rating can be reasonably assigned; the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable
Once all offerors are evaluated under both Factor I Technical and Factor II Past Performance award will be made to the Offeror who has the lowest price with acceptable ratings in both Factor I Technical and Factor II Past Performance.
Factor III – Price.
(1) Price evaluation will be performed on all Offerors Pricing Proposals in accordance with 52.212- 1 Instructions to Offerors. Proposals will be ranked from lowest to highest price based on the Total Evaluated Price (TEP). The TEP is the total of the base year and all option years including the option to extend IAW FAR 52.217-8.
(2) Reasonableness: Prices are reasonable in comparison to estimates, prior prices paid, and competition and can be supported by suitable estimating techniques. If a price is unreasonably low to realistically perform the work for the proposed price, the offer will be not considered in the competitive range and will not be considered for contract award.
(3) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
