About this file

This document is a USDA solicitation template for commercial products and services incorporating FAR clauses and AGAR provisions. The solicitation invites offers from concerns with expertise to provide items in accordance with a Performance Work Statement, Technical Specifications, and Maps. Contractors must furnish a Certificate of Conformance per FAR clause 52.246-15. The document specifies that clauses and provisions incorporated by reference have the same force and effect as if stated in full text, with all terms and conditions applicable to any resulting order.

The template includes comprehensive mandatory FAR clauses covering commercial products and services, employment standards, labor compliance, security requirements, anti-discrimination and diversity certifications, small business utilization, payment procedures, and protest procedures. For contracts under $9 million, evaluation uses FAR 12.203 criteria focusing on technical approach, schedule compliance, price, and past performance, with award to the highest technically rated offeror if pricing is fair and reasonable and past performance is acceptable or neutral. For contracts over $9 million, FAR 52.212-2 applies with evaluation factors in order of importance. AGAR provisions include anti-discrimination and DEI compliance certification (452.203-71), personal identity verification requirements (452.204-71), contract closeout procedures (452.204-70), brand name or equal provisions (452.211-70), and quantity variation limits (452.211-71 and 452.211-72). Questions must be submitted by November 15, 2025, at 12:00 PM Pacific Time. The USDA Ombudsman Program provides informal and formal protest resolution mechanisms with a 35-calendar-day resolution goal, requiring submission to SPE.inquiry@usda.gov.
