B.2 SCHEDULE NOTES

a) Items labeled as optional are not required to be exercised by the government. If exercised, the contractor will be required to perform the optional work in accordance with the terms and conditions of this contract.

b) One award will be made from this solicitation, contractors must submit pricing for all items.

DIVISION 150 PROJECT REQUIREMENTS

1) Pay Item 151(01) Mobilization covers movement of personnel, equipment, supplies, and incidentals to or from the project area and to locations within the project area.

Requirements and provisions shall follow Section 151 in the FP-14 specifications.

Separate mobilization Pay Item for equipment anticipated under the contract are shown in the Schedule of Items under Pay Items 151(02) Mobilization of equipment if work requires specific equipment rental with operator.

Permits, insurance, and bonding costs, if applicable, shall be included in the Pay Item

151(01) Mobilization costs under. Bonding costs will be reimbursement in accordance with FAR 52.232-1 after receipt of payment is submitted and approved by the Contracting Officer.

2) Pay Items 157(05) and 157(06) Soil Erosion and Sediment Control (wattles and hay bales) structures shall be installed at locations designated by the Engineer and in according to FP-14 Section 157 and as SHOWN ON THE DRAWINGS.

DIVISION 200 EARTHWORK

3) Pay Item 201(01) Clearing and Grubbing shall consist of clearing, grubbing, trimming, removing, and disposing or treatment of timber, construction slash, and debris as SHOWN ON THE DRAWINGS. Log’s meeting utilization standards shall be limbed and decked at locations designated by the engineer. Bid prices for clearing and grubbing shall be Task Order specific depending on construction slash treatment identified in the Schedule of Items. Quantities will be the number of acres within the clearing limits regardless of the amount of work required.

4) Pay Items 201(05) Roadside Brushing shall be performed according to FP-14 Section 201 and as SHOWN ON THE DRAWINGS.

5) Pay Items 202(20) Removal, Individual Tree assume trees removed shall be limbed, with an on-site lop-and-scatter slash disposal method. Log’s meeting utilization standards shall be limbed and decked at locations designated by the engineer. Work under these Pay Items shall include grubbing of stumps if located within the clearing limits with scatter disposal method. Stumps located outside the clearing limits can remain and shall not extend more then 6 inches above the original ground.

6) Pay Item 203(01) Removal of Pipe Culvert shall include the excavation, removal and legal disposal of culverts designated for removal, and backfilling the resulting trenches, holes, and pits.

7) Pay Item 203(02) Removal of Fences shall include the excavation, removal and legal disposal of fence and fence materials designated for removal, and backfilling the resulting trenches, holes, and pits.

8) Pay Items 204(18) Embankment Construction, Drainage Rolling Dips (Construct and Reconstruct) shall be constructed according to FP-14 Section 204 and as SHOWN ON THE

DRAWINGS.

9) Pay Item 204(25) Ditch Excavation, Type Lead-out shall be constructed according to FP- 14 Section 204 and as SHOWN ON THE DRAWINGS.

10) Pay Item 207(01) Earthwork Geotextile shall consist of furnishing and installing designated geotextile function and type shown in the Schedule of Items. Geotextile shall be placed according to FP-14 Section 207, as SHOWN ON THE DRAWINGS, and in accordance with the manufacturer’s recommendation. Overlapping material shall not be included in the measurement. Bid prices for geotextile shall be Task Order specific depending on type of geotextile identified in the Schedule of Items.

11) Pay Item 211(03) Roadway Obliteration, Method 1 shall be performed according to Supplemental Specification 211. The intent of this pay item is to scarify ground to a 12” depth and construct water bars as necessary to drain water from the road

12) Pay Item 211(03) Roadway Obliteration, Method 2 shall be performed according to Supplemental Specification 211. The intent of this pay item is to reshape and outslope existing roadbed to drain, construct water bars as necessary to drain water from the road, and to “pit” the reshaped roadbed to promote better establishment of vegetation.

13) Pay Item 211(03) Roadway Obliteration, Method 3 shall be performed according to Supplemental Specification 211. The intent of this pay item is to fully re-contour to match original/existing round contour. “Pitting” will be required on slopes greater than 6% and within site distance of the intersection of the road.

14) Pay Item 212(02) Linear Grading, Construction of Road. Construction of new roads or road sections, including clearing and grubbing, excavation of the roadway, compaction, installation of drainage structures including ditches (rolling dips and sediment basins are paid for separately) and finishing of the road. The road alignment will be determined and staked by the FS. Bid prices for Linear Grading,

15) Pay Item 212(02) Linear Grading, Reconstruction of Road. Re-Construction of existing roads. Includes roadside brushing, the installation of new ditches, curve widening, minor re-alignments of the road and re-finishing the road surface. ( rolling dips, sediment basins are paid for separately) Bid prices for Linear Grading, DIVISION 250 SLOPE REINFORCEMENT AND RETAINING WALLS

16) Pay Item 251(02) Placed Rip Rap, Class <type> shall consist of furnishing, hauling, and placement of rip rap class material shown in the Schedule of Items. Pay Item shall be installed according to FP-14 Section 251 and as SHOWN ON THE DRAWINGS. Bid prices for rip rap shall be Task Order specific depending on class of rip rap and quantity identified in the Schedule of Items and haul distance to the project site.

17) Pay Item 251(25) Placed Rip Rap, Boulder shall consist of furnishing, hauling, and placement of boulder rock material shown in the Schedule of Items. Pay Item shall be installed according to FP-14 Section 251 and as SHOWN ON THE DRAWINGS.

DIVISION 300 AGGREGATE AND BASE COURSES

18) Pay Items 303(01) Aggregate Base shall consist of furnishing, hauling, and placement of aggregate base material shown in the Schedule of Items. Pay Items shall be installed according to FP-14 Section 303 and as SHOWN ON THE DRAWINGS. Bid prices for aggregate shall be Task Order specific depending on aggregate class, compaction method identified in the Schedule of Items and haul distance to the project site. If compaction method B is used in the Pay Item, then a vibratory compactor and any necessary water shall be included in the Pay Item.

19) Pay Item 303(04) Road Reconditioning shall consist of reconditioning the traveled way

Solicitation No: 1240LT22Q0138 Page 12 of 56 and shoulders of an existing road; cleaning ditches, culvert inlets and outlets, and rolling dips; removing slide material; scarifying and shaping the traveled way and shoulders, parking areas, turnouts, and approach road connections. Work shall be in according to FP-14 Section 303 and as SHOWN ON THE DRAWINGS.

DIVISION 600 INCIDENTAL CONSTRUCTION

20) Pay Items 602(01) Pipe Culvert shall consist of furnishing and installing metal pipe and pipe appurtenances, including all bedding and backfilling required to complete the work. The term pipe culvert refers to aluminum and steel. Pay Items shall be installed according to FP-14 Section 602 and as SHOWN ON THE DRAWINGS. Catch basin and/or outlet ditch construction shall be incidental to each item. Riprap to line catch basins and/or outlet ditches shall be paid under a 251(02) Pay Item or negotiated and covered separately if local material is available.

21) Pay Items 602(10) End Section for Pipe Culvert shall consist of furnishing and installing metal pipe end section, including all bedding, and backfilling required to complete the work. The term end section refers to aluminum and steel. Pay Items shall be installed according to FP-14 Section 602 and as SHOWN ON THE DRAWINGS.

22) Pay Item 607(04) Cleaning Culvert In-Place shall consist of cleaning and repairing existing drainage and appurtenant structures. Pay Item shall be in accordance with FP-14 Section 607.

23) Pay Item 619(01) Fence Barb Wire shall consist of furnishing and installing barb wire fences. Pay Item shall be installed according to FP-14 Section 619 and as SHOWN ON

THE DRAWINGS.

24) Pay Items 619(02)

- Contractor Furnished gate: Metal Gate shall consist of furnishing and installing gates. Pay Items shall be installed according to FP-14 Section 619 and as SHOWN ON THE DRAWINGS. Bid prices for Metal Gate

- GGovernment Furnished Gate: Government furnished gate shall only include the metal gate and gate hinge hardware. Retro-reflective signs SHOWN ON THE DRAWINGS, gate posts and lock open posts shall be provided by the contractor and are incidental to gate installation.

Contractor shall prime and paint all field welds and any other areas of exposed metal resulting from installation.

25) Pay Item 619(02) Gate, Barb Wire, 5 Strand shall consist of furnishing and installing barb wire fence gate. Pay Item shall be installed according to FP-14 Section 619 and as SHOWN ON THE DRAWINGS.

26) Pay Item 619(03) Cattleguard shall consist of furnishing and installing cattleguards.

DRAWINGS. Retro-reflective signs SHOWN ON THE DRAWINGS shall be provided by the contractor and are incidental to cattleguard installation. Barb Wire Gate shall be paid under a 619(02) Pay Item. Specify load rating HS-20

27) Pay Items 633(08) Object Marker Gate shall consist of removal, furnishing and installing of object markers on existing gates. Pay Items shall be installed according to FP-14 Section 633 and as SHOWN ON THE DRAWINGS.

28) Pay Items 635(02) Temporary Traffic Control shall consist of furnishing, installing, maintaining, relocating, and removing temporary traffic control devices. Temporary traffic control barricades shall only be used for long term traffic control such as long-term road closure or long-term hazard warning. Pay Items shall be installed according to FP-14 Section 635 and as SHOWN ON THE DRAWINGS. Temporary traffic control associated with controlling and protecting public traffic during and until project acceptance shall be considered incidental.

DIVISION 622 EQUIPMENT

29) Pay Item 151(02) Mobilization for equipment shall be for one time per job. Mobilization will not be paid for the return trip to the base of operations, or for multiple mobilization to locations within the same project (e.g., multiple equipment hauling to locations of work within the same task order, equipment taken back to the base of operations for the weekend, poor project planning, demobilization prior to final inspection and acceptance) unless agreed to in advance by the Contracting Officer. Payment will be made at the accepted rates shown on the bid schedule for each corresponding piece of equipment, as applicable. This should be a per mile pay item.

30) Mobilization of equipment for which a separate mobilization pay item is not shown on the Schedule of Items shall be considered incidental to the work pay item requiring that equipment. Pickup trucks, chase vehicles, haul vehicles, etc. shall be considered incidental to the pay items shown in the Bid Schedule, and no separate payment will be made for their use. If the Contracting Officer agrees that the equipment needed is a major part of the work, it may be negotiated and added to the Schedule of Items.

31) Pay Items 622(01) are hourly unit rates for equipment and an operator. All hours worked under a pay item as "on-shift" in performance of actual work necessary for the performance of pay item. Hours do not include "off-shift" time allowed for transportation to the worksite, breaks, or any time equipment sits idle on site. The minimum computation time allowance is increments of 15 minutes. Rates will be in accordance with the applicable pay item in the schedule. I would like to add a daily rate for equipment as well.

MISCELLANEOUS

32) Traffic Control Devices shall be in accordance with the Manual on Uniform Traffic Control Devices (2012 Edition) and the Forest Service Sign Installation Guide, Publication No. 1071 2812P. The Sign Installation Guide can be downloaded from http://www.fs.fed.us/t-d/pubs/.

33) The Contractor is required to call Digger’s Hotline to obtain a utility line locate before any ground disturbance on any task order. The Forest Service will try to provide as much information about any utilities known but it is the Contractor’s responsibility to locate all utility lines.

SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 SCOPE OF CONTRACT

The purpose of this project is to complete road maintenance on various National Forest Service Roads within the Sulphur Ranger District and Clear Creek Ranger District. Road work items may include road reconditioning, construction of rolling dips, installation of culverts, roadside brushing, grading, aggregate placement, etc.

A work list and pay time description will be provided prior to mobilization of each individual site. The contractor will work with the appropriate Forest Service Zone Engineer to outline the exact locations of the work items for each site. The Forest Service Zone Engineer will provide the Contractor a map and a kmz file with the work outlined for their use. If work items need to be added or removed, a change order to the contract must be issued and approved by the Contracting Officer.

Optional road work items may be awarded if the need is agreed upon before work starts and the funding is approved by the Contracting Officer.

An onsite prework meeting will be completed with the contactor to clarify location and type of work that is expected for each site prior to construction. The location of each work item will be provided via GPS and staking.

C.2 PROJECT LOCATON

The Project Area is located within the Arapahoe and Roosevelt National Forest within the Clear Creek Ranger District and the Sulphur Ranger District.

C.3 MAGNITUDE OF CONSTRUCTION PROJECT

Between $100,000 and $250,000

C.4 Period of Performance The contract period is 60 calendar days after the Notice to Proceed effective date. The anticipated period of performance is September 15, 2022, through November 15, 2022.

C.5 Security Contractor is responsible for the Contractor’s equipment and building materials supplied to the sites.

All work shall be conducted in a safe and expedient manner and in conformance with the specifications referenced in Section J and each Task Order. Safety should be a priority and OSHA compliance shall be applied on every task order. When applicable, traffic control shall be in accordance with standards set forth in the most current edition of the Manual on Uniform Traffic Control Devices (MUTCD). All work shall be conducted by personnel fully qualified to perform the tasks assigned and shall be supervised by a designated Contractor’s Representative.

C.7 Equipment All equipment shall be in good repair, and capable of accomplishing assigned tasks in a safe and environmentally acceptable manner. Where applicable, all equipment shall be fitted with approved spark arrestors. All equipment shall be cleaned of earthen and vegetative materials that may contain weed seed prior to delivery onto National Forest Lands. If using equipment on multiple Task Orders at one time or if there are long mobilization distances between sites on the same Task Order, the Contracting Officer may require cleaning of equipment between the project sites.

C.8 Equipment and Materials Storage and Staging Upon concurrence from the Contracting Officer, certain areas on the National Forests may be used on a case-by- case basis for storage of equipment and/or materials during active maintenance periods. The Contractor shall be responsible for protection of items stored on Government property and shall ensure adequate safety measures are maintained at such sites.

All repairs to equipment under this contract shall be made and paid for by the Contractor. Camping is permitted on National Forest Lands and within Campgrounds, extension permissions may be grant by the Contracting Officer and proper permits may be obtained at the local Ranger District.

C.9 Standard Specifications “Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects, FP-14”, U.S. Customary Units, is applicable for this project, and is included by reference only. The requirements contained in these Standard Specifications are hereby made a part of this solicitation and any resulting work. The Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects (FP-14) and MUTCD are applicable and included in this contract by Reference here.

C.11 BIOBASED PRODUCT UTILIZATION

The Contractor must comply with the Agricultural Act of 2014; the Food, Conservation and Energy Act of 2008 (FCEA), 7 U.S.C. 8102; the Farm Security and Rural Investment Act of 2002 (FSRIA), 7 U.S.C. 8102; the Federal Acquisition Regulation; Executive Order (EO) 13514, “Federal Leadership in Environmental, Energy and Economic Performance,” dated October 5, 2009; EO 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” dated January 24, 2007; and Presidential Memorandum, “Driving Innovation and Creating Jobs in Rural America through Biobased and Sustainable Product Procurement,” dated February 2012, to provide biobased products.

The Contractor shall utilize products and material made from biobased materials to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer’s Representative (COR).

The following is an example list of products that may be used in this contract for which biobased products are available. The list is not all inclusive. It is desirable that Contractors be able to supply the greatest number of biobased products listed meeting the health and environmental specifications.

Biobased products that are designated for preferred procurement under USDA’s Biopreferred Program must meet the required minimum biobased content as stated in the USDA Final Rule available at www.biopreferred.gov. The Contractor should provide data for their biobased products such as biobased content and source of biobased material.

In addition to the biobased products designated by the U.S. Department of Agriculture in the Biopreferred Program, the Contractor is encouraged to use other commercially available biobased products.

Additionally, the winning Contractor on each anniversary date of the contract shall compile a complete list of biobased products, including the information above, purchased to carry out the contract requirements. The Contractor shall list volume to be used and total cost for each individual product. This information will be used for reporting purposes (see Section I, FAR Clause 52.223-2).

A demonstration of proper use, an effective training program, and technical assistance are essential to the success of the purchase and use of some biobased products that may function differently than a conventional product.

452.211-72 Statement of Work/Specifications (FEB 1988) The Contractor shall furnish the necessary personnel, material, equipment, services and facilities (except as otherwise specified), to perform the Statement of Work/Specifications referenced in Section J.

SECTION H--SPECIAL CONTRACT REQUIREMENTS

H.1 CLAUSES

452.237-74 Key Personnel (FEB 1988)

(a) The Contractor shall assign to this contract the following key personnel: On Site Supervisor

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below.

After the initial 90-day period, the Contractor shall submit the information required by paragraph

(c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

452.236-72 USE OF PREMISES (NOV 1996)

(a) Before any camp, quarry, borrow pit, storage, detour, or bypass site, other than shown on the drawings, is opened or operated on USDA land or lands administered by the USDA, the Contractor shall obtain written permission from the Contracting Officer. A camp is interpreted to include a campsite or trailer parking area of any employee working on the project for the Contractor.

(b) Unless excepted elsewhere in the contract, the Contractor shall (i) provide and maintain sanitation facilities for the work force at the site and (ii) dispose of solid waste in accordance with applicable Federal, State and local regulations.

452.236-73 ARCHAEOLOGICAL OR HISTORIC SITES (FEB 1988)

If a previously unidentified archaeological or historic site(s) is encountered, the Contractor shall discontinue work in the general area of the site(s) and notify the Contracting Officer immediately.

452.236-74 CONTROL OF EROSION, SEDIMENTATION, AND POLLUTION (NOV 1996)

(a) Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.).

(b) Pollutants such as fuels, lubricants, bitumens, raw sewage, and other harmful materials shall not be discharged on the ground; into or nearby rivers, streams, or impoundments; or into natural or man-made channels. Wash water or waste from concrete or aggregate operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.

(c) Mechanized equipment shall not be operated in flowing streams without written approval by the Contracting Officer.

452.228-71 INSURANCE COVERAGE (NOV 1996)

Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(b) General Liability. (1) The Contractor shall have bodily injury liability coverage written on a comprehensive form of policy of at least $500,000 per occurrence.

(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.

(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

H.2 NOXIOUS WEEDS PREVENTION AND EQUIPMENT CLEANING

Cleaning of Off-Road Equipment used by the Contractor for contract work shall be conducted outside the boundary of any National Forest Service land prior to moving each piece of equipment onto the project. The Contractor shall notify the Forest Service prior to moving each piece of equipment onto the project. Upon request from the Forest Service, arrangement will be made for Forest Service to inspect each piece of equipment prior to it being placed into service.

The Contractor shall use cleaning methods necessary to ensure equipment is free of all attached mud, dirt, and plant parts. If noxious weeds are present at a project site, cleaning may also be required before moving between locations within the same project. These measures will assist to prevent the introduction/spread of the seeds of noxious weeds onto National Forest land. The Contractor shall certify in writing, compliance with the above requirements. "Off-road Equipment" includes all machinery other than log trucks, chip vans, pickup trucks or vehicles used to transport personnel on a daily basis.

H.3 LANDSCAPE PRESERVATION

The Contractor shall confine operations to within the clearing limits or other areas designated in contract documents, and prevent the depositing of rocks, excavated materials, stumps, or other debris outside of these limits. Material which falls outside of these limits shall be retrieved, disposed of, or incorporated in the work as directed by the Contracting Officer, and damage to vegetation or structures outside the clearing limits shall be repaired as directed by the Contracting Officer.

Operation shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.).

Prevention of Oil Spills -If the Contractor maintains storage facilities for oil or oil products on Project Area, appropriate preventive measures shall be taken to insure that any spill of such oil or oil products does not enter any stream or other waters of the United States or any of the individual States.

If the total oil or oil products storage exceeds 1320 gallons or if any single container exceeds a capacity of 660 gallons, the Contractor shall prepare a Spill Prevention Control and Countermeasures (SPCC) Plan. Such plan shall meet applicable EPA requirements (40 CFR 112) including certification by a Registered professional engineer.
