About this file

This document is an Amendment (Amendment #1) to the Region 4/Intermountain Region Prescribed Fire and Support Indefinite Delivery/Indefinite Quantity (IDIQ) contract. The amendment makes three key changes: 1) Increases the NAICS 115310 size standard from $11.5M to $34.0M, 2) Adds a detailed Timekeeping and Payment Section, and 3) Adds a Government-Furnished Property and Services Section. The timekeeping section specifies complex payment rates based on work hours, including minimum, daily, median, full, and maximum daily rates ranging from under 8 hours to 14-16 hours. The government will pay contractors based on daily rates, with variations for contingency availability, prescribed fire duties, and specific conditions like partial work periods or cancellations. The government-furnished property section outlines the materials and services the government will provide, such as project maps, unit prescriptions, access roads, burn plans, communication frequencies, and fuel supplies.

Previous edition unusable

Except as provided herein, all terms and conditions of the document referenced in Item 9 A or 10A, as heretofore changed, remains unchanged and in full force and effect .

Timekeeping and Payment Contractor will submit daily to the COR/Government Technical Monitor on site daily crew time reports, OF-288’s and/or Emergency Equipment Shift Tickets (exhibit 15,18, and 21 examples) with the actual number of hours of service provided by Contractor, as documented on daily use records. When agreed upon, Contractor and Government shall each sign the Daily Time Report. When work is ordered by the Acre or the mile, this unit will be measured using a GPS as the system of measure, a string box or similar device may also be utilized to measure distance. These rates excludes meal breaks.

Minimum Daily Rate- This daily rate will be for anything under 8 hours and will be paid at 50% of the Daily Rate.

Daily Rate- This daily rate will be for work between 8-10 hours.

Median Daily Rate- This daily rate will be for work >10-12 HOURS

Full Daily Rate- This full daily rate will be for work between 10-14 hours

Maximum Daily Rate- This maximum daily rate will be for work between 14-16 hours.

Contingency Availability – When the Government orders the Contractor for contingency availability, payment shall be made at 75% of the daily rate offered in the work schedule (daily rate, full daily rate or maximum daily rate) if on-site (on the prescribed fire) or off-site (within 30 minutes) but will be staged on the Forest/District. The Government will designate the start time for contingency availability and the anticipated availability period.

Contingency availability normally shall be 8-10 hours per day. The Contractor must be available for immediate mobilization throughout the contingency availability period (work shifts will be identified in each individual task order).

The Government may unilaterally cancel contingency availability prior to the designated start time, or at any time during the contingency availability period. The Government will verbally notify the Contractor of contingency cancellation. If cancelled at any time during the planned contingency date, the Minimum Daily Rate (50% of the Daily Rate) will be paid for the hours accrued. In the event the Government, through reasonable effort, cannot contact the Contractor, no payment will be made.

If during the contingency availability period, the Government requires the Contractor to perform operational duties, the Contractor shall proceed immediately to a location designated by the Government (normally the prescribed fire work site). Payment at the daily rate as offered in the Schedule shall commence when the Contractor arrives at the prescribed fire work site.

Prescribed Fire Duties - Payment for all prescribed fire duties will be made at the daily rate specified in the individual task order and in the schedule of items. The Contractor shall prepare a daily time report for approval by the COR or Technical Monitor at the end of each shift. The daily time report shall be the Crew Time Report SF-261 (5/78) and/or OF- 288’s for prescribed fire crews, or the Emergency Equipment Shift Ticket OF-297 (7-90) for prescribed fire engine, water tender, excavator, Skidgens, Pumpercats, and dozer with transports. The Contractor and Government shall each sign the Daily Time Report.

If the pre-operational briefing is completed but the operation is delayed or cancelled by the Government and the prescribed fire resource is released, the Contractor shall be paid the minimum daily rate (50% of the daily rate). When unanticipated conditions make work impracticable, or if wind, fire danger, unusual wet periods, or other environmental conditions make work impractical or unsafe, the contractor will be paid the minimum daily rate.

In the event of accident or illness to a prescribed fire crew member(s), the contractor must replace that individual(s) to ensure that the contractor meets the minimum staffing as outlined in the PMS 310-1 and the 5109.17. Non-working status does not include Contractor personnel who are performing first aid procedures. If the accident or illness results in the loss of the Contractor’s

Representative, CRWB/FIRB, WTOP or EQOP, and a qualified replacement is not immediately available, the Government shall release the Contractor and payment will cease. Payment shall be made for hours worked and associated travel times.

Order Cancellations/Enroute- If the order is cancelled after the resource order has been confirmed, and the resource is enroute, the resource is considered mobilized. Payment will be made by the US Forest Service in accordance in this time keeping and payments section.

The time under hire shall start at the time the resource begins traveling to the incident after being ordered by the Government, and end at the estimated time of arrival back to the point of hire after being released, please read the exception to all resources section.

Heavy Equipment Transports- The time under hire shall start at the time the resource begins traveling to the incident after being ordered by the Government, and end at the estimated time of arrival back to the point of hire after being released. Please read the exception section for this paragraph.

Transport - ONE OPERATOR FOR BOTH TRANSPORT AND HEAVY EQUIPMENT.

(1) MINIMUM DAILY GUARANTEE AND MILEAGE - Minimum guarantee for transports is reduced to 65%; the mileage rate is not reduced. For time under hire for 8 hours or more, the government will pay 65% of the minimum daily guarantee or mileage rate, whichever is greater. If a resource is under hire for less than 8 hours on the first or last day, the amount paid for that day will be 32.5% of the minimum daily guarantee or mileage rate, whichever is greater.

Transport is considered released once the heavy equipment is delivered and unloaded at the incident, unless one of the following exceptions apply:

• If approved by the government, the contractor may keep the transport at the incident, after it has been released, at no additional cost to the government.

• Incident may retain transport under hire for the sole purpose of transporting the heavy equipment that was originally ordered; the mileage rate or 65% of the minimum daily guarantee, whichever is greater will be paid until the transport is released. The decision to retain the transport must be documented on the shift ticket.

When the transport operator and heavy equipment operator are the same, payment calculation will be for the transport mileage to the incident and, at time of heavy equipment release, the transport mileage back to the point of hire.

MINIMUM DAILY GUARANTEE AND MILEAGE - For time under hire for 8 hours or more, the government will pay the minimum daily guarantee or mileage rate, whichever is greater. If a resource is under hire for less than 8 hours on the first or last day, the amount paid for that day will be 50% the minimum daily guarantee or mileage rate, whichever is greater.

Exceptions to All Resources:

1. No further payment will accrue during any period that resource under hire is not in a safe or operable condition or it is not available for the assigned shift or portions of the assigned shift. Payment will be based on the hours the resource was operational during the assigned shift, as documented on the shift ticket versus the designated shift, as shown on the Incident Action Plan.

2. If the Contractor withdraws resources prior to being released by the Government, no further payment shall accrue and the Contractor shall bear all costs of returning resources to the point of hire

3. After inspection and acceptance for use, equipment and vehicles that become inoperable and cannot be repaired at the site of work by the Contractor within 24 hours, may be considered as being withdrawn by the Contractor in accordance with exception #2 above with the exception that the Government shall pay return travel. The Government shall calculate travel in accordance with “The vendor will be paid for travel to and from the incident from the equipment City and State they designated in their offer. Vendor must meet date and time needed.” This will be based on a normal release of resource. The Contractor shall bear any additional cost returning resource and/or operator(s) to the point of hire

4. No payment will accrue when the contractor is off shift in compliance with the mandatory "Work/Rest" and "Length of Assignment" provisions.

5. Deductions. Unless specifically stated elsewhere in this contract the cost of any supplies, materials, or services, including commissary, provided for the Contractor by the Government will be deducted from the payment to the Contractor.

6. Reassignment of resources. Vendors being reassigned to a new incident shall close out the use invoice for payment on the current incident PRIOR to the reassignment. The day of closeout and reassignment shall be paid as a Daily Rate applied to the incident the resource is being reassigned to. Upon final release, travel shall be calculated in accordance with the payment section on pages

7. Transport Exception. No further payment will accrue for the transport during any period that the heavy equipment is not in a safe or operable condition or it is not available for the assigned shift or portions of the assigned shift. Payment will be calculated in the same manner as the heavy equipment.

Hotels and Meals-

When the Government cannot provide a campsite, the Government will pay actual lodging expenses or the per diem locality rate published by the U.S. General Services Administration (GSA) web site (www.gsa.gov), whichever is less. Double occupancy of hotel rooms is required. Any associated lodging taxes are reimbursable as documented. Lodging receipts, as well as documentation by incident personnel that a campsite was not provided, shall be submitted as supporting documentation with payment documents.

Reimbursement for meals and incidental expenses (M&IE) is based on per diem locality rates minus any Government-provided meals. The maximum allowable rates are referenced at www.gsa.gov.

Contractors are required to provide sufficient food & drink to support their employee(s) while in travel status and the first shift of the incident. This is not reimbursed by the Government.

After that time, when Government subsistence at incident camps are available, meals for Contractor's operator(s) will be furnished without charge. Government will furnish meals without cost if restaurant subsistence is the approved camp for incident personnel. If on prescribed fire and on the individual task order states that field per diem is authorized due to the government not providing the meals, the contractor will get that rate in lieu of the meals and incidentals rates referenced from www.gsa.gov. Field Per Diem Rates are referenced from FSH 6509.33 Federal Travel Regulations. This allows the contractor to purchase and prepare their own food while on the incident.

PAYMENT

The Forest/District for each incident is responsible for payments.

The time under hire shall start at the time the resource begins traveling to the incident after being ordered by the Government, and end at the estimated time of arrival back to the point of hire after being released, please read the exception to all resources page 47.

Rates of Payments. Payment will be at rates specified in the individual task order that is in effect at the time of the order. (Minimum, Daily, Full, or Maximum)

On-Shift includes time worked, time that resource is held or directed to be in a state of readiness, and compensable travel (resource traveling under its own power) that has a specific start and ending time.

http://www.gsa.gov/

Daily Rate -- Payment will be made on basis of calendar days (0001 - 2400). For fractional days at the beginning and ending of time under hire, payment will be based on the Minimum Daily Rate (50% of the Daily Rate) for periods less than 8 hours.

The vendor will be paid for travel to and from the incident from the equipment City and State they designated in their offer. Vendor must meet date and time needed.

Driver Hour Limitation. The following Driver Hour limitations, as referenced at Interagency Incident Business Management Handbook (FSH 5109.34), shall apply to this agreement:

• No driver will drive more than 10 hours (behind the wheel/actual driving time) within any duty day.

• Multiple drivers in a single vehicle may drive up to the duty-day limitation provided no driver exceeds the individual driving time (behind the wheel/actual driving time) limitation of 10 hours.

• A driver shall drive only if they have had at least 8 consecutive hours off duty before beginning a shift. An exception to the minimum off-duty hour requirement is allowed when essential to:

(1) accomplish immediate and critical suppression objectives, or

(2) address immediate and critical firefighter or public safety issues.

• As stated in the current agency work/rest policy, documentation of mitigation measures used to reduce fatigue is required for personnel who exceed 16 hour work shifts. This is required regardless of whether the driver was still compliant with the 10 hour individual (behind the wheel) driving time limitations.

Method of Payment. Lump-sum payment will normally be processed at the end of the emergency assignment. However, partial payment may be authorized as approved by the incident agency. Payment for each calendar day will be made for actual units ordered and performed under Daily rates.

After each operational period worked, time will be verified and approved by the Government Agent responsible for ordering and/or directing use the resource. Time will be recorded to the nearest quarter hour worked. The Government will verify the Contractor's time on an Emergency Equipment Shift Ticket (OF-297) or a Crew Time Report (OF-288) (Exhibit 15, 18 or 21). The Government and the Contractor representatives will sign the OF-297/OF-288 verifying the hours worked daily. Each operator's name shall be listed on the shift ticket and crew time report.

In the case the prescribed fire converts to a wildfire, the government would convert contracts over to an EERA or a VIPR agreement and this contract would be null and void.

Payments would follow those agreements.

(1) The Contractor will be paid for equipment used at the rates specified in Fire Fighting Equipment Rental Rates agreed upon by various Federal Agencies.

GOVERNMENT-FURNISHED PROPERTY AND SERVICES

All Government furnished equipment and supplies, hereinafter referred to as Government-furnished property, will be picked up by the Contractor at location designated in the task order. The Contractor shall return all Government furnished-property within 24 hours from final acceptance. At time of return, the Contractor shall furnish the COR with an inventory of property being returned. The Contractor shall be responsible for any shortages of Government-furnished property.

Upon request daily to District FMO, Fuels Planner, District Duty Officer, or local Dispatch Center, may identify FS or cooperator resources (such as engines), available as contingency resources required by the burn plan. This establishes that the government will provide contingency resources if available, as required by the burn plan. This does not preclude reimbursement to the government or cooperator if the contingency resources are activated to go to the burn site.

Communication Frequencies Communication Frequency List

List will be provided by the Forest upon contract award to ensure the contractor communicates with the local dispatch center.
