Dear Ms. Garcia, On July 24, 2019 Sunrise Environmental, Inc. performed a site visit of the Burke-Martin Mine Mill building site and collected bulk samples of suspect building materials identified in the mill building debris. Asbestos-containing cementitious paneling and roofing tar was identified in the Mill building debris pile.

On September 29, 2020 another site visit was performed, and Colorado Department of Public Health & Environment (CDPHE) representatives Mr. Curtis Burns and Mr. Jeffrey Wolfe were also met at the site to discuss if the mill building debris pile met the criteria for a major asbestos spill or a minor asbestos spill. It was determined by Mr. Curtis Burns and Mr. Jeffrey Wolfe that the mill debris pile was a minor asbestos spill since less than trigger levels of asbestos-containing building materials were observed.

Bulk samples of two (2) additional suspect materials were collected by Sunrise Environmental, Inc. on October 24, 2020, both of which were found to contain greater than 1% asbestos. All of the asbestos-containing building materials identified in the debris pile were observed to be less than trigger levels of less than 160 sq. ft. or less than the equivalent of a 55-gallon drum.

Since the mill debris pile was determined to be a minor asbestos spill, the following steps must be taken:

1. The asbestos-containing cementitious paneling, the asbestos-containing white fibrous paneling and the asbestos-containing wire insulation identified in the Mill Building debris pile must be removed and properly disposed by personnel trained and certified to remove and dispose of asbestos-containing materials. (The non-friable asbestos-containing roofing tar on non-ACM green sheet roofing may remain).

2. A visual inspection must be performed by a CDPHE certified Air Monitoring Specialist after all of the asbestos-containing cementitious paneling, the asbestos-containing white fibrous insulation and the asbestos-containing wire insulation identified in the debris pile have been removed and properly disposed.

3. Following passage of the visual inspection, (after all of the asbestos-containing cementitious paneling, the asbestos-containing white fibrous paneling and the asbestos-containing wire insulation identified in the Mill building debris pile has been removed and properly disposed) a CDPHE certified Asbestos Building Inspector must the sign the required CDPHE Demolition Permit Application prior to removal of the Mill building debris pile.

4. Because non-friable roofing tar will exist in the debris, the Mill building debris will not be accepted at the Summit County landfill as the Summit County landfill will not accept any asbestos (friable or non-friable). All of the Mill building debris must go to a landfill that will accept construction debris with non-friable asbestos-containing roofing tar.

5. If large sections of timber can be segregated, the timber may be sent to the Summit County landfill provided no amount of non-friable roofing tar is included. The Summit County landfill may require a separate visual inspection of the segregated timber to ensure that none of the non-friable roofing tar has been included in the timber waste stream.

Dear Mr. Scott Sanders:

The bulk samples submitted to FRS Geotech, Inc. have been analyzed by polarized light microscopy (PLM), the EPA-recommended method for determination of fibrous constituents in building materials. The percent of asbestos contained in the samples is a visual estimation based upon comparisons with published charts. The results of these analyses are summarized in the enclosed table. This report relates only to the items received and tested by our laboratory. According to requirements set by the National Institute of Standards and Technology/NVLAP, this report must not be used by the client to claim certification, approval, or endorsement by NVLAP, NIST, or any agency of the Federal Government. Also, NVLAP guidelines specify that this report should not be reproduced, except in full, without the written approval of FRS.

A copy of your Chain of Custody is attached for your convenience. This report is considered highly confidential. Results will not be discussed with any person not associated with you.
