About this file
This document is Amendment 0001 to Solicitation 1240LP27Q0001, a Total Small Business Set-Aside for a tracked winter UTV with cab conversion for the USDA Forest Service, Intermountain Region (Ogden, UT). The amendment provides government responses to questions received during the solicitation process and clarifies technical and administrative requirements.
The solicitation requires delivery of one new, unused 2026 or 2027 model UTV configured for snow survey work on the Sequoia National Forest, with delivery to the Kern River Ranger District (11380 Kernville Road, Kernville, CA 93238) by December 31, 2026. Key technical requirements include: minimum four-occupant crew cab configuration with factory seating and seat belts; 4WD/AWD drivetrain; overall length not exceeding 188 inches with tracks installed; manufacturer-published curb or dry weight not exceeding 3,000 pounds (excluding cab, accessories, and tracks); factory-integrated GPS/navigation system; rear camera (dealer-installed acceptable); and enclosed winter cab with hard doors, roof, windows, tip-out windshield with wiper and defrost. The Government will install Government-owned Prospector Pro 2.0 tracks (P/N 2890034) and mounting kit (P/N 2889425) on compatible vehicles; contractors offering incompatible vehicles must provide and install a complete compatible track system as a separate line item (CLIN 0002) at zero cost if compatible. Delivery is F.O.B. Destination with inspection and acceptance at the delivery location. The nonmanufacturer rule does not apply; small business resellers may offer Polaris vehicles without NMR waivers and may source through authorized dealers for direct delivery. Quoted prices must include all applicable Federal, State, and local taxes; sales to the Government are exempt from California sales tax. Title transfers to the Government upon acceptance. The offer due date is October 21, 2026, by 1600 MT, and questions were due by October 14, 2026.

Solicitation 1240LP27Q0001 – Winter UTV: Government Response to RFI
Model Year Requirement
• Whether “current model year” allows delivery of a new, unused 2026 model or requires a 2027 model. (Asked by multiple vendors.)
Response: A new, unused 2026 or 2027 model is acceptable. Attachment 1, Item 1 will be clarified by amendment.
Track System Compatibility and Installation Requirements
• Whether the Government or contractor is responsible for installing Government-owned Prospector Pro 2.0 tracks and mounting kit (P/N 2890034 and 2889425).
Related: whether, for a compatible vehicle, the dealer must fit and test the Government-owned tracks before delivery; whether snow tracks must be supplied and fitted or only compatibility is required.
Response: The Government will install the Government-owned tracks and mounting kit on a compatible vehicle; the contractor is not required to fit or test them before delivery. If the offered vehicle is not compatible, the contractor-furnished track system and mounting kit (CLIN 0002) must be installed before delivery, with the vehicle delivered assembled and ready for use (Attachment 1 Item 11).
• If contractor installation is required, how the Government will provide tracks and mounting kit and when they will be available. Related: how the tracks and mount kit will be made available to the dealer.
Response: Not applicable. The contractor will not install the Government-owned tracks, so they will not be provided to the contractor or its dealer.
• Whether a compatible offered vehicle should list CLIN 0002 at $0.00 when Government-owned tracks are used.
Response: Yes. If the offered vehicle is compatible with the Government-owned Prospector Pro 2.0 track system and mounting kit, enter $0.00 for CLIN 0002. If it is not compatible, CLIN 0002 must be priced for a complete compatible track system and mounting kit (Statement of Requirement, Snow tracks; Schedule of Items, CLIN 0002).
• Whether delivery of the UTV on wheels (without tracks installed) satisfies the delivery requirement if the Government installs the tracks. Related: whether, if installation is the contractor’s responsibility, tracks must be installed before delivery or may be installed at the delivery location.
Response: Yes. For a vehicle compatible with the Government-owned tracks, delivery of the UTV on wheels satisfies the delivery requirement; the Government will install the tracks after acceptance. Track installation at the delivery location by the contractor is not required.
• Whether bidders must obtain written compatibility verification for the track system from Polaris or whether Government confirmation will be provided. Related: whether mounting kit P/N 2889425 fits the Crew (six-seat) Ranger XP 1000 or only the two-seat Ranger XP 1000.
Response: Written verification from Polaris is not required. Attachment 1, Item 2 states that the Government-owned system (tracks P/N 2890034, mounting kit P/N 2889425) fits Polaris Ranger XP 1000 models and does not fit Ranger 1500 models. The Government confirms that the mounting kit is compatible with the Ranger Crew XP 1000. The quote must include a statement confirming whether the offered vehicle is compatible, supported by manufacturer specification sheets or descriptive literature sufficient to verify snow track compatibility (Quote Submission; Technical Acceptability).
Overall Length Requirement
• Whether manufacturer or dealer certification of overall length with tracks installed is sufficient to meet the 188-inch requirement. Related: whether the manufacturer’s published vehicle length plus the track manufacturer’s published added length is acceptable instead of a dealer-measured dimension.
Response: Quotes are evaluated on manufacturer specification sheets or descriptive literature sufficient to verify overall length (Technical Acceptability).
Where published manufacturer literature does not state length with tracks installed, a dealer certification of tracked length is acceptable. The manufacturer’s published vehicle length plus the track manufacturer’s published added length is also acceptable. The 188 in. limit is a maximum, intended to ensure the vehicle with tracks installed fits the existing CCSS trailer. Offerors proposing a make other than Polaris should provide documentation sufficient to confirm the overall length with tracks installed.
• Whether a physical measurement is required for compliance verification.
Response: No physical measurement is required to submit a quote; technical acceptability is evaluated on the documentation submitted. The delivered vehicle is subject to Government inspection, and only items conforming to the contract may be tendered for acceptance (FAR 52.212-4, Inspection/Acceptance).
Curb Weight Clarification
• Whether manufacturer-published dry weight is acceptable when curb weight is not published. Related: whether published dry weight plus the listed weight of dealer-installed accessories is acceptable (e.g., Ranger Crew XP 1000 NorthStar Edition, for which Polaris publishes an estimated dry weight). Related: whether a published estimated dry weight (e.g., 2,094 lb) is acceptable; what weight proof will be accepted when makers publish dry weight and accessory weight separately.
Response: Yes. Either the manufacturer-published curb weight or the manufacturer-published dry weight (including an estimated dry weight, e.g., 2,094 lb) may be used to show compliance with the 3,000 lb maximum in Attachment 1 Item 4.
• Whether a manufacturer or dealer statement certifying curb weight satisfies documentation requirements.
Response: Attachment 1, Item 4 requires a manufacturer-published weight (curb or dry weight; see the preceding response). A manufacturer specification sheet or manufacturer-issued statement is acceptable; a dealer statement alone does not meet this requirement.
• Clarification whether the 3,000 lb limit applies before or after installation of the track system. Related: whether the 3,000 lb limit includes the cab, all added equipment, and the tracks.
Response: The 3,000 lb maximum applies to the manufacturer-published curb or dry weight of the vehicle before any installations (Attachment 1, Item 4). The weight of the cab, dealer-installed accessories, and track system is not included.
If available, offerors are encouraged, but not required, to provide the total installed weight.
Vehicle Technical Requirements
• Clarification of required seating capacity, payload, engine/fuel type, drivetrain, and overall dimensions. Related: required passenger capacity.
Response: Seating: minimum four (4) occupants (driver plus three passengers) in a crew cab configuration with factory seating and seat belts; bench-seat configurations rated for fewer than four are not acceptable (Attachment 1 Item 1;
Statement of Requirement, Seating). Drivetrain: 4WD/AWD (Attachment 1 Item 1). Dimensions: overall length with the Government-owned tracks installed may not exceed 188 in. (15 ft 8 in.) (Attachment 1 Item 3); no other dimensional limits are specified. Payload, engine, and fuel type are not specified.
• Clarification of required winter cab components, including heat, defrost, windshield, wipers, doors, and lighting. Related: required winter-cab/heater configuration.
Response: Required: factory- or dealer-installed enclosed winter cab with hard doors, hard roof, windows, and a tip-out windshield with wiper and defrost (Attachment 1 Item 5). A cab heater is not required; a cab with both defrost and heat is preferred but is not evaluated. Road-use lighting such as turn signals is not required (Attachment 1 Item 10).
• Whether specific winter performance/defrost specifications beyond those in Attachment 1 apply.
Response: No. The requirements are those in Attachment 1 and the Statement of Requirement. No additional winter performance or defrost specifications apply.
Documentation Requirements
• Whether manufacturer fitment data and dealer/service statements are acceptable documentation.
Response: Yes, as supporting documentation. Quotes must include manufacturer specification sheets or descriptive literature sufficient to verify each salient characteristic (Technical Acceptability); manufacturer fitment data qualifies. Dealer or service statements may supplement manufacturer literature but do not replace it where Attachment 1 requires a manufacturer-published value (e.g., curb weight, Item 4).
• Whether Polaris manufacturer specification sheets, supplemented by dealer confirmations, meet documentation requirements.
Response: Yes, provided the documentation together verifies each salient characteristic in Attachment 1 and the Statement of Requirement. See the preceding response.
• Whether warranty documentation must be submitted with the quotation.
Response: No. Warranty documentation is not among the items required with the quotation (FAR 52.212-1 addendum, Quote Submission).
GPS / Navigation Requirements
• Whether a dealer-installed OEM-compatible GPS/navigation and rear camera meets the requirement for factory-integrated onboard navigation. Related: whether a dealer-installed OEM navigation system integrated into the vehicle meets the factory-integrated requirement.
Response: GPS/navigation: No. Attachment 1 Item 8 requires a factory-integrated onboard GPS/navigation system; a dealer-installed unit does not meet this requirement. Rear camera: Yes. Attachment 1 Item 9 requires a rear camera installed and operational and does not require factory installation. Dealer-installed accessories must be identified as separate line items on the quote (Attachment 1 Item 11).
Delivery, Acceptance, and Address Confirmation
• Confirmation of the correct delivery ZIP code (93238 vs. 93240) for 11380 Kernville
Road, Kernville, CA. Related: exact delivery address.
Response: 93238. The delivery address is USDA Forest Service, Kern River Ranger District, 11380 Kernville Road, Kernville, CA 93238 (SF-1449 Block 15;
Shipping Instructions; Attachment 1 Item 12). The 93240 ZIP code in the SF- 1449 item description is an error and will be corrected by amendment.
• Confirmation that inspection and acceptance occur at destination.
Response: Yes. Delivery is F.O.B. Destination (FAR 52.247-34), and inspection and acceptance will take place at the Kern River Ranger District delivery address.
• Whether delivery of a fully assembled UTV without tracks installed meets the December 31, 2026 requirement when the Government installs tracks.
Response: Yes. For a vehicle compatible with the Government-owned tracks, delivery of a fully assembled UTV without tracks by December 31, 2026 meets the requirement. The Government will install the tracks after acceptance.
• Clarification of unloading, setup, dealer delivery, and warranty support requirements.
Related: whether any on-site training, installation, or service is mandatory beyond delivery of the complete configured unit.
Response: Delivery is F.O.B. Destination; the contractor is responsible for delivery to the Kern River Ranger District at its expense (FAR 52.247-34). The vehicle must be delivered assembled with all required contractor-furnished items installed and ready for use (Attachment 1 Item 11); Government-owned tracks will be installed by the Government. No operator orientation, on-site training, installation, or dealer service support is required. If the delivery vehicle cannot unload the UTV, the contractor must coordinate unloading assistance with the Kern River Ranger District front desk (760-376-3781) before delivery. No warranty-support requirement beyond the warranty terms of FAR 52.212-4 is specified.
Nonmanufacturer Rule, Buy American, and Small- Business Eligibility
• Whether a small-business nonmanufacturer reseller may offer a Polaris vehicle and whether an NMR waiver applies. Related: whether the estimated value is between the micro-purchase and simplified acquisition thresholds so that the nonmanufacturer rule and limitations on subcontracting do not apply under 13 CFR 121.406(c), given that FAR 52.219-14 and 52.219-33 are not in the solicitation.
Response: Yes. This is a Total Small Business Set-Aside (FAR 52.219-6) with an estimated value below the simplified acquisition threshold. Under 13 CFR 121.406(c), the nonmanufacturer rule does not apply to small business set-aside acquisitions with an estimated value between the micro-purchase threshold and the simplified acquisition threshold, so a small business reseller may offer a vehicle made by a large manufacturer such as Polaris, and no NMR waiver is required. The offeror must be registered in SAM and represent as a small business under NAICS 336999. Buy American—Supplies (FAR 52.225-1) still applies; complete the 52.225-2 and 52.225-18 representations with the quote.
The limitations on subcontracting and ostensible subcontractor rule likewise do not apply under 13 CFR 121.406(c), which is why FAR 52.219-14 and 52.219-33 are not included.
• Whether a small-business reseller delivering through an authorized Polaris dealer is eligible for award. Related: whether a reseller arrangement in which a licensed California dealer installs the accessories and delivers directly to USDA, while the small business pays the dealer, remains responsible for performance, and invoices USDA, is acceptable.
Response: Yes, provided the small business offeror is registered in SAM, represents as small under NAICS 336999, and remains responsible for meeting all contract requirements, including delivery. The offeror may source the vehicle and dealer-installed accessories through an authorized Polaris dealer. This includes direct delivery by the supplying dealer to the Kern River Ranger District.
Tax Exemption and Title Transfer
• Whether the purchase is tax-exempt.
Response: Quoted prices must include all applicable Federal, State, and local taxes (FAR 52.212-4, Taxes). Sales made directly to, and paid directly by, the United States Government are generally exempt from California sales tax (CDTFA Regulation 1614). The purchase order will be issued and paid directly by the USDA Forest Service and can be used to support the exemption. Offerors should consult the California Department of Tax and Fee Administration on their specific tax treatment.
• Whether title to the UTV transfers to the Government upon delivery and acceptance.
Response: Yes. Title passes to the Government upon acceptance (FAR 52.212- 4, Title).
• Whether the contractor must take title prior to resale to the Government, for tax treatment purposes.
Response: The Government does not prescribe how the contractor acquires the vehicle from its supplier. Tax treatment of that transaction is a matter between the contractor, its supplier, and the taxing authority. Because the nonmanufacturer rule does not apply to this acquisition (13 CFR 121.406(c)), the contractor is not required to take ownership or possession of the vehicle for size-eligibility purposes.
Dealer Licensing, Titling, and Registration
• Whether the contractor must hold a California vehicle dealer license, or may perform through a licensed supplying dealer that handles the sale documentation and delivery.
Response: The solicitation does not require the contractor to hold a vehicle dealer license. The offeror is responsible for complying with all applicable federal, state, and local laws in performing the contract. The Government cannot advise offerors on state licensing requirements.
• Whether the reasoning of Leslie Miller, Inc. v. Arkansas, 352 U.S. 187 (1956) (state contractor licensing of federal contractors) applies to the proposed sale to USDA.
Response: The Government does not provide legal advice to offerors. Offerors should consult their own legal counsel. The solicitation does not require a vehicle dealer license.
• Whether the supplying dealer may issue the manufacturer’s certificate of origin and any required ownership documents directly in USDA’s name while the contractor pays the dealer.
Response: Title passes to the Government upon acceptance (FAR 52.212-4, Title). Yes. The manufacturer’s certificate of origin and any ownership documents shall be issued to USFS SQF Kern River RD, 11380 Kernville Road, Kernville, CA 93238, and delivered to the front desk at the same address, Attn: Daniel Wild.
• Whether the awarded vendor will be required to register the UTV with the DMV and, if so, whether it should be registered to 11380 Kernville Road, Kernville, CA 93238.
Response: No. The solicitation does not require the contractor to register the vehicle, and the Government will complete any registration requirements. The vehicle is for off-road use only (Attachment 1, Item 10).
Color Availability
• Whether the Government has a preferred color among available options (Camo, Stealth Gray, Havasu Red Pearl, Army Green).
Response: Any of the listed colors is acceptable. Green is preferred because it aligns with agency colors, but color is not an evaluation factor.
Historical Procurement Information
• Whether the Government has previously purchased a similar UTV and, if so, the prior solicitation/contract number and awarded price.
Response: This information is not available.
• Whether historical acquisition cost data can be released for comparable UTVs and equipment.
Response: This information is not available.
