About this file

This document provides an amendment to a solicitation for scaling services on Road 19 following the Holiday Farm Fire. The amendment clarifies that scaling hours will be measured and paid by crew, with Item 1a/2a covering a 4-person crew and Item 1b/2b covering a 6-person crew. It explains that danger tree removal under Items 1b and 2b refers to work within designated limits on the project plans. The amendment also addresses questions from three contractors confirming scaling crew composition and responsibilities for identifying danger trees to fell. The related solicitation seeks scaling and debris removal services along a 2.04 mile section of Road 19 between MP 54.32 and MP 56.32. The selected contractor will assess and remove imminent hazards from above cut slopes and rock outcrops, including danger trees, loose rock, and downed wood, and clear the roadway each day.

Road 19 Holiday Farm Fire Scaling - Amendment No. 002

ATTACHMENT TO STANDARD FORM 30, (BLOCK 14 CONTINUED)

This amendment provides the following questions and answers received by three Contractors.

Contractor 1

1) Could you please clarify how scaling hours will be measured? Under the bid items (page 2 of 57) item number 1a shows 70-hours at a 4-person crew, then on page 29 of 57 (g) Measurement states "Slope Scaling will be measured by the scaler hour". Our question specifically is will the hours be measured per 4-man crew or by each man?

Items are to be paid by the crew hour. Items 1a/2a for a 4 person crew, and 1b/2b for 6 person crew.

2) Could you please further explain "Danger Tree Removal with Scaler Support"? Are we to assist tree falling operations above the slope scaling area depicted in the plans (page 3 of 3) or are we to assist during all tree falling operations including outside of the scaling limits?

The intent of items 1b and 2b is for the 6 person scaling crew to perform the danger tree removal work within the identified limits. Shown on sheet 2 (for item 1a) and sheet 3 (item 2b) of the plans.

Contractor 2

1. It is unclear to me if the bid is referring to 280 crew hours or 280 combined man-hours?

Items are to be paid by the crew hour. Items 1a/2a for a 4 person crew, and 1b/2b for 6 person crew.

2. What are you considering the makeup of the six-man crew? Does it include a scaler, ground guy, or a foreman or are you wanting 6 fallers and I should take into account any support staff?

Sheet 29, part (g) Measurement of Section 1a - “The Scaling Supervisor is incidental to the work, and no additional measurement will be made for the Scaling Supervisor.”

The intention for a six person crew would be 5 scalers on the hillside and one ground personnel.

3. The area of hazard tree removal is pretty broad as are the specifications. Will there be someone who will be selecting the individual trees to be removed or will the fallers be responsible for selecting the trees to be downed?

The scalers/fallers are responsible to identify danger trees meeting the specifications on sheet 30 to be felled.

Contractor 3

1. Rocks will hit the roadway surface and may cause Damage. Is it expected for the contractor to repair damaged asphalt?

Page 7 of 57, LANDSCAPE PRESERVATION, states that the Contractor “shall take care to maintain natural surroundings undamaged”. The Contractor will not be liable for damages to the road that were caused accidentally.

However, the Contractor may be liable for damages to the road, if damages were caused by negligence, or direct intention to damage a road (e.g. pushing a boulder directly into a road with excessive force).

If question 1 is a YES.

2. Will the government consider adding road repair into the awarded contractors contract? Once the road is surveyed it can be determined how much road repair will be needed and the awarded contractor and the government can negotiate approved rates to complete asphalt repair/repaving.

Regardless of the damages to the road, the Contractor will not be allowed to repair the road on this contract. Repair work like this would be considered new work, which means price competition is needed. Also, depending on the amount of road repair done, the additional work may be considered construction work. This is currently a service contract with no construction clauses included.
