Bond premiums as used in this paragraph and FAR 52.232-5 shall include any Small Business Administration fees paid in connection with SBA guaranteed corporate surety bonds.
SECTION H--SPECIAL CONTRACT REQUIREMENTS
H-1 452.228-71 INSURANCE COVERAGE (NOV 1996)
452.228-71 Insurance Coverage (NOV 1996) Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:
(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.
(b) General Liability. (1) The Contractor shall have bodily injury liability coverage written on a comprehensive form of policy of at least $500,000 per occurrence. (2) The Contractor shall have property damage liability insurance shall be required in the amount of $500,000 per occurrence.
(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.
(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.
H-2 OTHER REQUIREMENTS
USE OF PREMISES
a). Before any camp, storage area, or access is opened or operated on National Forest land, written permission shall be obtained through the Contracting Officer. A camp includes the campsite of any employee working for the Contractor. Such permission, if granted outside the boundaries of a public use facility, will be without charge to the Contractor. The Contractor will follow all rules and regulations specific to the use of the National Forest. Campsite occupancy will be permitted for duration of work plus 14 days mobilization and 7 days cleanup time, as approved.
Provide proposed location(s) for campsites for approval prior to any ground disturbing activities. Camping will not be allowed within an archeological site.
Provide a plan for camp development, occupation, and clean-up and obtain approval prior to any camp development activities. The plan should contain the following information:
1. Layout and location of the proposed camp.
2. Number of users and dates of occupancy.
3. Sewage and waste disposal systems.
4. Layout of cooking, sleeping and common areas.
5. Camp trails layout.
6. Equipment and fuel storage area and Spill Prevention Control and Countermeasure (SPCC) plan.
7. Fire prevention and control plan.
8. Site Restoration plan.
9. Mobilization plan including helicopter and/or boat operations if relevant to camp setup, removal, or use.
The Government shall review the Contractor's plan as submitted for completeness and applicability. Proposed modifications of Contractor's plans will be discussed with the Contractor prior to approval.
b). Sanitation Facilities: Unless provided otherwise, the Contractor shall provide and maintain the following facilities:
1. Potable water supplies for drinking, washing, and cooking shall meet the State of Alaska drinking water regulations 18 AAC 80. Drinking water may not be available at the camp location.
2. Domestic sewerage shall meet the State of Alaska wastewater disposal regulations 18 AAC 72.
3. Solid waste shall be removed and disposed of in Ketchikan or other approved location.
4. Fuel storage shall meet the requirements of 40 CFR 112 (Oil Pollution Prevention).
c). Transportation, Access and Equipment: This project has not been designed to be compatible with land- based motorized equipment such as small-scale excavators and track haulers. Construction methods that rely predominantly upon the use of land-based motorized equipment will require design changes at no cost to the government. Such design changes will delay execution of work at the contractor’s risk.
This trail follows a lagoon and river where the soil is often saturated and overland water flow is frequent.
Maintaining a narrow trail bed is critical to protecting this fragile environment, and so the project was designed for helicopter delivery and placement of construction materials within work areas. Experience has shown that this method of construction minimizes ground disturbance and subsequent erosion, minimizes damage to tree roots from soil compaction, and allows construction of a narrower trail bed with shallower aggregate depths thereby reducing the quantity of rock required. The weight of ground-based hauling and excavation equipment with repeated trips over the same ground tends to damage tree roots which can lead to trail bed destabilization and requires a much wider trail with deeper aggregate in order to accommodate equipment widths and support their weight. Stockpiling materials in sensitive habitats adjacent to the trail with repeated hauls by ground-based equipment is also a concern.
If the contractor feels the above concerns can be mitigated and the use of ground-based motorized equipment, or water-based motor equipment is the best value to the government for this project, a plan may be presented for consideration. An on-site review with the contractor at no cost to the government may be required prior to approval. Provide the following information:
‐ Provide a map showing areas where equipment would be operated, stockpile locations, access routes to/from stockpiles, and any other features related to the operation of equipment. The government will not provide a base map for this submittal.
‐ Proposed equipment model number, size, capacity, empty weight and weight when fully loaded. The government will assume that equipment will be used fully loaded.
‐ Proposed methods to minimize damage to soil, trees designated to remain, and other factors as required. State mitigation measures that will be implemented at stockpile sites and any traveled routes upon completion of trail construction work to naturalize these areas.
‐ Proposed changes to designed aggregate depths and other design elements as necessary to accommodate the equipment, and how these changes will affect project costs.
‐ Contractor’s experience constructing trail with equipment in similar sensitive environments.
‐ Any other site-specific considerations specified by the Government.
The use of helicopters in the project area is allowed. However, do not fly helicopters directly over hikers or over trails open to the public at any location, or allow anticipated sling load trajectory to pose a safety risk to hikers below. Avoid operating aircraft within 1,000 feet of an eagle nest during the breeding season. In Alaska the bald eagle breeding season is February 1 through October 15, although timing restrictions may be adjusted or removed depending on results of nest-monitoring (e.g., nest is not active, or birds fledge early). A map of known eagle nests is available upon request.
e). The area may be visited by black bears. Bears may be attracted by activity and food and become habituated to humans and learn to associate them with food. Do not allow bears or other wildlife access to human food, garbage, or other attractants. Store food in bear-proof containers or hang at least 12 feet above ground if working from a camp. Do not leave food scraps at any time in camp or along the trail.
f). There are eagle nest trees within approximately 1,000 feet of the project area. If such trees are discovered, notify the CO as soon as practicable to avoid disturbance.
“Disturbance” is defined as action which agitates or bothers the eagles to a degree that injures an eagle or substantially interferes with normal breeding, feeding, or sheltering habits and causes, or is likely to cause, a loss of productivity or nest abandonment.
g). Other bird nesting: If other raptors, herons, or migratory birds are found nesting in or near the project area, inform the CO so that a Forest Service wildlife biologist may be notified.
h). TES species: If any Threatened, Endangered, Candidate or Forest Service Sensitive wildlife species are present or observed in the area, inform the CO so that a Forest Service wildlife biologist may be notified.

In accordance with 36 CFR 296.14(c), the Contractor shall bear costs of restoration, provided that such payment shall not relieve the Contractor from civil or criminal remedies otherwise provided by law.
Wheeled or track-laying equipment shall not be operated within such areas, except on roads. Unless agreed otherwise, trees will not be felled into such areas.
ARCHAEOLOGICAL OR HISTORIC SITES (THE FOLLOWING IS IN ADDITION TO AGAR
CLAUSE 452.236- 73 ARCHAEOLOGICAL OR HISTORIC SITES (NOV 1996)
One cultural resource protection area falls within the proposed Naha Creek Trail Reconstruction Project activity area. A Heritage Professional (Archaeologist) is required to be on site for construction of step run stairs at trail log areas 29+56 to 30+46 and 30+64 to 30+89. Please provide 2 weeks’ notice to the Government prior to implementing project activities in the aforementioned trail log areas. If a previously unidentified archaeological or historic site(s) is encountered, the contractor shall discontinue work in the general area of the site(s) and notify the contracting officer immediately.
PROTECTION OF HABITAT OF ENDANGERED, THREATENED AND SENSITIVE SPECIES
Location of areas needing special measures for protection of plants or animals listed as threatened or endangered under the Endangered Species Act of 1973, as amended, or as sensitive by the Regional Forester under authority of FSM 2670, are shown on the Plans and identified on the ground. Measures need to protect such areas have been included elsewhere in this contract or are as follows: NONE If protection measures prove inadequate, if other such areas are discovered, or if new species are listed as federally threatened or endangered, or as sensitive by the Regional Forester, Forest Service may either cancel or unilaterally modify this contract to provide additional protection regardless of when such facts become known. Discovery of such areas by either party shall be promptly reported to the other party.
LANDSCAPE PRESERVATION
a) No foot traffic or movement of materials or equipment is allowed over uncompleted and unprotected portions of the trail. In areas requiring trail abandonment and rehabilitation, workers shall walk away from the abandoned trail centerline, dispersing their travel route, to avoid damage to the protective surface vegetation. When working within trail corridor to be developed, workers shall walk on the centerline of proposed trail so damage will be covered by new trail construction. Rehabilitate and naturalize sites where required to prevent or reverse erosion by regrading the ground contours and spreading organic debris found locally (e.g., punk, and green hemlock boughs) as mulch to protect bare soil from the erosive force of rain to the extent practicable.
b) Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams and rivers.
Pollutants such as raw sewage and other harmful materials shall not be discharged into or near streams and rivers or into natural or manmade channels leading thereto.
Waste motor oil, fuel, lubricant, bitumen and similar hydrocarbons shall be collected and returned to the supplier. They shall not be wasted on the ground or buried.
c) Stockpile aggregate and other materials in approved locations. Thoroughly remove all stockpiled material immediately after the use of that stockpile is complete. Restore stockpile sites to a natural- appearing condition.
d) Erosion Control. Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.). Pollutants such as fuels, lubricants, raw sewage, and other harmful materials shall not be discharged onto the ground, into or near rivers, streams, and impoundments or into natural or manmade channels leading thereto.
Contractor shall submit an Erosion Control Plan identifying the nature of materials to be used and procedures for installing temporary erosion control devices. Install and maintain erosion control devices prior to and throughout construction and until permanent erosion control measures identified in Specifications and on
Drawings are completed.
e) Prevention of Oil Spills. If the Contractor maintains storage facilities for oil products on site, appropriate preventative measures shall be taken to ensure that any spill of such oil or oil products does not enter any streams or other waters of the United States or of any individual states.
Servicing of all equipment shall be done only in the area approved by the CO.
If the total oil or oil products storage exceeds 1,320 gallons or if any single container exceeds a capacity of 660 gallons, the Contractor shall prepare a Spill Prevention Control and Countermeasures (SPCC) Plan. Such a plan shall meet applicable EPA requirements (40 CFR
112) including certification by a registered Engineer.
