Description -

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Part 12. This announcement constitutes the only solicitation. Quotations are being requested and a separate written solicitation will not be issued.

Solicitation number 1240BE26Q0071 is issued as a Request for Quotation (RFQ) to provide road maintenance to the Middle Fork Ranger District (MFRD) of the Willamette National Forest (WNF).

This acquisition is set-aside for small business concerns. The applicable North American Industry Classification Standard Code is 237310 The small business size standard is $45 mil. This acquisition is a Total Small Business Set-Aside. All responsible sources may submit a quotation which will be considered by the agency.

Statement of Requirement

The purpose of this contract is to maintain roads and manage vegetation growth to ensure safe and productive road conditions. Specifically, to repair damage to road surfaces and drainage structures during suppression of the 2024 Willamette Complex fire.

The Contractor shall furnish all labor, supervision, management, tools, materials, equipment, facilities, transportation, and other items and non-personal services necessary to provide road maintenance services to the WNF road system.

The contractor shall provide services in accordance with (IAW) this Performance Work Statement (PWS), and all applicable federal, state and local laws and regulations.

The work shall be performed throughout the Northern end of the Middle Fork Ranger District of the WNF in Oregon.

(a) By entering into this contract, the contractor certifies that:

(g) Failure on the part of the contractor or its subcontractors to comply with the terms of this clause may be grounds for the Contracting Officer to terminate this contract for default.

452.204–70 Modification for Contract Closeout (Apr 2026)

(a) If unliquidated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (Contracting Officer) may issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but is not required to provide a signature. The Contracting Officer will immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) For commercial contracts not exceeding the simplified acquisition procedure threshold under FAR 12.001(c), if more than $1,000 in unliquidated funds remain at closeout, the Contracting Officer will issue a bilateral deobligation modification. Only the modification requires the contractor’s signature, though a Release of Claims may be requested. If the required documents are not returned within 60 days, the Contracting Officer will issue a unilateral modification and proceed with closeout once performance is complete, acceptance is confirmed, and final payment is made.

(c) For all other non-commercial or non–cost‑reimbursement contracts, if more than $1,000 in unliquidated funds remain at closeout, the Contracting Officer will issue a bilateral deobligation modification and a Release of Claims, both requiring contractor signature. If these documents are not returned within 120 days, the Contracting Officer will issue a unilateral modification u and proceed with closeout upon completion of performance, acceptance, and final payment.

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

1) Relevant Past Performance

a) Provide a list of work you have completed in the past 3-years which directly involves the specifications of the solicitation.

b) Include a brief description of the project, dollar amount, year completed, and project owner contact information (name, phone, and email).

c) Include all contracts for the past 5 years that have been terminated for convenience or cause.

The government may use past performance information from any available source.

2) Technical Proposal – The technical proposal will include:

a) Contractor's General Technical Capability –

i) Provide a brief explanation of your ability to accomplish this work. Include a description of the work you plan to subcontract out. Include the company name and SAM UEI (if applicable) for all Subcontractors.

ii) Include a list of all equipment with specs that will be used to complete the work (owned or rented).

iii) Provide your expected project schedule including sequence of work items and approximate time to complete each item.

iv) The roads featured in this project see a lot of recreational use; traffic control is an important element of this project. Please explain in detail your plan to deal with this issue. Include how you plan to accommodate public users during work hours as well as during non-work hours. Include details of how you will deal with public safety on this project

v) Provide the name of the Quality Control Representative who will be responsible for the contractor’s Quality Control Plan (QCP) to ensure services are performed IAW the PWS. The Quality Control Representative will implement and maintain full compliance with the QCP throughout the contract period.

United States Department of Agriculture (USDA) Protest Procedures

The United States Department of Agriculture (USDA) is committed to fair, transparent, and efficient acquisitions. Interested parties with concerns about this solicitation are encouraged to seek resolution through the following USDA procedures.

Tier 1: Contracting Officer Concern Resolution

Submission: Interested parties with concerns about either the solicitation or subsequent award should first submit their concern directly to the Contracting Officer, providing sufficient detail to allow the Contracting Officer to understand and assess the issue.

Performance Work Statement 2024 Willamette Complex (South) Suppression Repair Road Maintenance Project General Information

1.0 General

This is a non-personal services contract to provide road maintenance to the Middle Fork Ranger District (MFRD) of the Willamette National Forest (WNF). The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government. The Contractor shall visit the project location with or without the COR before bid.

2.0 Purpose

The purpose of this contract is to maintain roads and manage vegetation growth to ensure safe and productive road conditions. Specifically, to repair damage to road surfaces and drainage structures during suppression of the 2024 Willamette Complex fire.

3.0 Description of Services

The Contractor shall furnish all labor, supervision, management, tools, materials, equipment, facilities, transportation, and other items and non-personal services necessary to provide road maintenance services to the WNF road system. The contractor shall provide services in accordance with (IAW) this Performance Work Statement (PWS), and all applicable federal, state and local laws and regulations.

4.0 Place of Performance and Accessibility

The work shall be performed throughout the Northern end of the Middle Fork Ranger District of the WNF in Oregon.

Specific Project Location Maps may be issued with each contract as necessary.

Willamette National Forest – Middle Fork Ranger District Avenza Maps will also be provided

Roads shown on the District MVUM maps for each district may only be a portion of all the roads on the forest; specific roads requiring work are listed on the work list.

Work areas may be reached by Forest roads that are accessible by a standard two-wheel drive pickup equipped with snow tires and chains, if needed, during normal operating seasons, unless otherwise indicated on Project Maps. Vehicles shall not operate off-system roads without prior written approval of the Contracting Officer Representative (COR).

Inaccessibility due to snow, fallen trees, slides or washouts on roads may or may not be corrected at the option of the Government. If road access is blocked, the Government may: (1) provide an alternate access route; (2) delete the inaccessible sub items (s) or; (3) substitute similar sub item(s).

Roads shown on unit maps indicate access to units and do not suggest the roads are open within units or for any further travel.

Use of motorized equipment other than handheld equipment such as power saws and brush cutters will not be permitted off designated roads in the project area without approval of the COR or as hereinafter provided.

No vehicle shall bypass any officially blocked road (barriers, locked gates, posted signs, rock/log/dirt, etc.) without approval of the COR.

5.0 Period of Performance

The period of performance shall be from date of award to October 30, 2026.

6.0 Contract Type

The Government will award a Firm-Fixed Price (FFP), Stand-Alone, Service Contract. Performance shall be made only as authorized by the contract. Contractor shall furnish to the Government all services specified in the Schedule of Items and called for by the contract.

7.0 Government Regular Working Hours

The Government's regular working hours are Monday through Friday from 0700 to 1700, except federal holidays or when the government installation is closed due to local or national emergencies, administrative closings, or similar government directed closings.

8.0 Federal Observed Holidays

When a federal holiday occurs on a Saturday, federal employees are normally granted the previous Friday as the holiday observance. When a federal holiday occurs on a Sunday, federal employees are normally granted the following Monday as the holiday observance. Below is the list of recognized federal holidays:

9.0 Contractor Key Personnel

Contract Manager: The Contractor shall provide a Contract Manager and designated alternate, as applicable, who has full authority to act for the Contractor on all contract matters relating to this contract. The Contract Manager or alternate shall be available during the Government's regular working hours.

Quality Control Representative: The Contractor shall provide a Quality Control Representative who shall be responsible for the Contractor’s Quality Control Plan (QCP) to ensure services are performed IAW the PWS. The Quality Control Representative shall implement and maintain full compliance of the QCP throughout the contract period.

10.0 Government Key Personnel

Contracting Officer (CO): The CO is the only person with the authority to: enter into, administer, and or terminate contracts; make related determinations and findings on behalf of the government; and legally bind the government. The CO shall ensure that the contractor receives impartial, fair, and equitable treatment under this contract. The CO shall determine and document the final assessment of the contractor's performance in the government’s past performance tracking system.

Contracting Officer’s Representative (COR): A COR may be assigned to this contract to monitor all technical aspects and assist in contract administration. The COR may be authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communication with the Contractor concerning technical aspects of the contract;

issue written interpretations of technical requirements (without increasing or decreasing contract scope), including Government drawings designs, and specifications; monitor Contractor's performance and notify both the CO and Contractor of deficiencies; and provide site entry of Contractor personnel. The COR is not authorized to change any of the terms and conditions of the contract.

11.0 Post-Award Conference and Periodic Progress Meetings

The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office IAW Federal Acquisition Regulation (FAR) Subpart 42.5. The CO and/or COR shall meet periodically with the Contractor to review the contractor's performance. At these meetings the CO will appraise the Contractor of how the Government views the contractor's performance and the contractor will appraise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues.

12.0 Changes

The quantities specified in the Schedule of Items are estimates only and are not guaranteed quantities. The government reserves the right to add, remove, or change the items and quantities to be serviced under this contract, as required. Price adjustments for these changes shall be based on the rates specified in the Schedule of Items for identical or similar items.

Changes will only be authorized by a warranted CO.

13.0 Inspection and Acceptance

Any inspection and acceptance will be at the location specified in the contract. The designated COR will act as the representative of the CO for purposes of inspection and acceptance of services to ensure compliance with the terms, conditions, and specifications of the subject contract. The COR has no authority to make any changes to the terms and conditions of the contract.

14.0 Invoicing and Payment

All contractor invoices shall be submitted via the Invoice Processing Platform (IPP) using contract line item numbers (CLINs). The contractor shall be required to establish account(s), access method(s), log-in(s), and necessary training in order to submit invoices through IPP. Invoices not submitted via IPP shall not be accepted or paid.

Note: The contractor shall only invoice for work performed and as authorized by the contract. Payment will be made only for those items listed on the Schedule of Items. All other work is incidental to those pay items.

Security and Safety Requirements

15.0 Security

The contractor shall be responsible for safeguarding all government property provided to the contractor for contractor use under this contract. At the close of each work period, all government property shall be secured.

16.0 Conduct of Contractor Personnel

The CO may require the contractor to remove from the work site any employee working under this contract for reasons of misconduct, security, or found to be or suspected to be under the influence of alcohol, drugs, or other incapacitating agent. Contractor employee shall be subject to dismissal from the premises upon determination by the CO that such action is in the best interests of the government. Such removal from the work site or dismissal from the premises shall not relieve the contractor of the requirement to provide sufficient personnel to perform the services as required by this PWS.

17.0 Safety

Contractor activities shall be conducted in a safe manner that minimizes accidents as well as any impacts on Government operations and members of the public. Contractor shall comply with applicable federal, state, and local codes and standards, including safety and occupational health requirements, as well as any additional specific requirement contained in this PWS.

Technical Requirements

18.0 Specific Tasks

The Contractor shall provide all labor, supervision, management, tools, materials, equipment, facilities, transportation, and other items and non-personal services necessary to provide road surface maintenance to MFRD road systems. The following establishes the required tasks and the minimum acceptable levels of service. See Attachment “MF 26-2 R6 Specifications Packet” for additional information.

Task 1 – (811) Surface Maintenance, Maintenance Level 2 Roads With Roller Compaction:

a. Smooth and shape native or aggregate surfaced roads including traveled way, shoulders, turnouts, and intersections. Reshape or recondition ditches, water bars, and drain dips. Water shall be applied as necessary to prevent segregation and facilitate compaction. When working in a weed infested area, the contractor shall be required to prevent spreading the infestation into un-infested areas by cleaning vehicles and equipment. The contractor shall use wash stations approved by either the CO or designated COR.

b. When roller compaction is required, an 8–10-ton vibratory roller will be operated over the full width of the roadway for a minimum of 3 complete pass and until there is no visible evidence of consolidation. One pass is defined as operating the vibratory roller from the point where blading begins to the point where blading ends.

c. Road surfaces will be considered acceptable when the travel way is logged out, free of washboards, potholes or other irregularities. The surface is smooth, compact, crowned or sloped to drain, without segregation of the surfacing materials. Suitable materials have been recovered and incorporated. Unsuitable materials have been removed. Ditches and road surface drainage structures function efficiently. Unpaved shoulders are shaped to provide a smooth transition from the paved surface and drain efficiently.

Task 2 – (813) Spot Surfacing:

a. Load, haul, and place surface material to repair or stabilize road surfaces.

b. Spot surfacing is complete when the designated quantity, 22,350 cubic yards (CY), of the ordered material has been placed, shaped, and compacted.

c. All material transported onto National Forest System land will be weed-free. Written documentation of methods used to determine the weed-free status of all materials furnished by the contractor will be furnished to the COR and CO before transport of any materials onto National Forest System Lands.

Task 3 – (832) Load Haul and Place Material:

a. Load, haul and place material according to section 19, table 04-832(1) and associated maps.

b. Loading, hauling and placing is complete when no obstruction remains in or adjacent to the roadway or in ditches which would have the potential to interfere with traffic use, block or divert water from structures or channels. This includes relocation, repositioning, stabilization, shaping to drain, leaving accessible for future disposal needs and revegetation as directed by the COR.

Task 4 – (833) Water Bar Installation:

a. Drainage structure installation is complete when water-bars and rolling dips have been installed to the lines and grades specified, and drainage structure removal is complete when designated culverts have been removed and culverts have been properly disposed of.

Task 5 – (834(1)) Clean Ditches and Drainage Structures:

a. Clean and recondition roadway drainage systems including culverts, ditches, inlet and outlet channels, catch basins, and appurtenances.

b. Drainage system maintenance is complete when no obstruction or debris remains on the roadway or in the defined area adjacent to the structure or in ditches which would have the potential to block water from entering the structure, back water into the structure (except for structures designed to function in a back-flooded manner) or divert water outside the defined channel.

c. Equipment operation in live streams or hydraulic flushing of drainage structures is not permitted. Work does not include bridges, drain dips, or water bars. Work activity will be measured along the centerline of the road regardless of the number of lanes.

Task 6 – (834(2)) Clean Ditches:

a. Clean and recondition roadway drainage systems including ditches

b. Drainage system maintenance is complete when no obstruction or debris remains on the roadway or in the defined area adjacent to the structure or in ditches which would have the potential to block water from entering the structure

Task 7 – Install Entrance Berm (834(3):

a. The Contractor shall place berm barricades to completely close off designated roads to vehicle traffic. The barricades shall be placed at locations flagged in the field, or listed on work sheets as shown on Typical Drawing Sheet 1 of Attachment 2. The applicable berm dimensions will be listed on table for the project site designated on the task order.

b. Berms with trenches shall be constructed from material on-site and placed at the beginning of the designated road, unless otherwise directed by the Government.

c. Berm barricade trenches shall be constructed to allow water drainage away from streams and erodible surfaces.

d. When available at the site the Contractor shall place stumps, cull logs, boulders or other vegetation on dirt berm to discourage vehicular negotiation.

Task 8 – Vegetation Treatment/ Haybale (841):

a. Apply vegetative treatments including seed, mulch, fertilizer or other products in designated areas.

b. Treatment is complete when ordered quantities of vegetative treatment products have been applied to designate or Service Provider disturbed soil areas.

Task 9 – Brushing (842):

a. Roadway vegetation maintenance is complete when the vegetation has been removed from the designated treatment area which interferes with traffic, obscures signs, impedes the flow of water or diverts water from drainage structures

b. The treatment area will be SHOWN ON THE PLANS. If plans or supplemental specifications are not included, the treated area includes the road bed measured from center line to bottom of ditch, or defined road edge, plus an additional 6 feet on each side. If there is no defined road edge, or a ditch does not exist, the treated area is 8 feet from both sides of center line of the road. Provide a vertical clearance of 14 feet measured from the road surface elevation.

Task 10 - Logging Out (ML 3-5) (851)

a. Work is complete when hazards have been removed or stabilized and when the road is passable by the intended traffic.

Task 11 – Mobilization (881): This task consists of the following task and limitations.

a. Moving personnel, equipment, material, and incidentals to the project and performing work necessary before beginning work at the project site.

b. Obtaining permits, insurance, and bonds.

c. The contractor shall be responsible for accounting for costs appropriately and for maintaining records, including supporting documentation, adequate to demonstrate that costs claimed have been incurred, are allocable to the contract, and comply with applicable cost principles in FAR subpart 31.2 and agency supplements.

d. The CO may disallow all or part of the claimed cost that is inadequately supported.
