452.203-71 Anti-Discrimination and Diversity, Equity, and Inclusion (DEI) Compliance (Dec 2025)
(a) By entering into this contract, the Contractor certifies that:
(1) It is compliant with all applicable Federal anti-discrimination laws and the Equal Protection principles of the U.S. Constitution, and it will remain compliant for the duration of the contract.
(2) Neither it nor any subcontractor or teaming partner operates or funds any program, policy, or initiative that promotes DEI in a manner that violates any applicable Federal anti-discrimination laws, including but not limited to Title VI and VII of the Civil Rights Act of 1964, or the Equal Protection principles of the U.S. Constitution, and the Contractor and any subcontractor or teaming partner will not do so for the duration of the contract.
(b) If the Contractor participates in, facilitates, or funds programs that implicate Title VI of the Civil Rights Act of 1964 or Title IX of the Education Amendments of 1972, as amended, including but not limited to grants to or for schools, colleges, universities, 4-H programs, non-governmental organization (NGO) programs, sports programs, and education-related grants to prisons or other detention facilities, the Contractor certifies that it will remain compliant with those laws, including the requirements set forth in Executive Order 14168, Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government, and Executive Order 14173, Ending Illegal Discrimination and Restoring Merit-Based Opportunity.

452.204–70 Modification for Contract Closeout (Nov 2025)
(a) If unliquidated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (Contracting Officer) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The
Contracting Officer shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.
(b) Upon contract closeout for contracts utilizing SAP: if unliquidated funds of more than $1000 remain on the contract, the Contracting Officer shall issue a bilateral modification for deobligation.
The contractor will receive a copy of the modification and will be required to provide a signature.
(The Contracting Officer may also request a “Contractor Release of Claims” be completed by the contractor, although not required for contracts and orders using SAP.) (c) Upon contract closeout for contracts utilizing anything other than cost reimbursement, if unliquidated funds of more than $1000 remain on the contract, the Contracting Officer shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and a ‘‘Contractor Release of Claims’’ and will be required to provide a signature on both forms. If the bilateral modification and Release of Claims are not returned to the Contracting Officer within 120 days, the Contracting Officer shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.
(End of Clause)
452.236–70 Emergency Response, Fire Suppression and Liability (Sep 2025)
(a) Contractor’s Responsibility for Responding to Emergencies. When directed by the contracting officer, the Contractor shall allow the Government to temporarily use employees and equipment from the work site for emergency work (anticipated to be restricted to firefighting). This is considered to be within the general scope of the contract. A supplemental agreement between both parties, including an exchange of consideration for additional in-scope work, for the temporary use of employees and equipment will be made under the CHANGES clause, FAR 52.243–4.
(b) Contractor’s Responsibility for Fire Fighting. The Contractor, under the provisions of FAR 52.236–9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements, shall immediately extinguish all fires on the work site other than those fires in use as a part of the work. The Contractor may be held liable for all damages and for all costs incurred by the Government for labor, subsistence, equipment, supplies, and transportation deemed necessary to control or suppress a fire set or caused by the Contractor or the Contractor’s agents, subcontractors, or employees subject to the fire classifications listed in subsection (c).
(c) Fire Suppression Costs. The Contractor’s obligations for cost of fire suppression vary according to three classifications of fires as follows:
Operations Fire. An ‘‘operations fire’’ is a fire caused by the Contractor’s operations other than a negligent fire. The Contractor agrees to reimburse the Forest Service for such cost for each operations fire, subject to a maximum dollar amount of [Contracting Officer insert amount]. The cost of the Contractor’s actions, supplies, and equipment expended or used on suppressing any such fire, or otherwise provided at the request of Forest Service, shall be credited toward such maximum. If the Contractor’s actual cost exceeds the contractor’s maximum obligation stated above, the Forest Service shall reimburse the contractor for the excess.
Negligent Fire. A ‘‘negligent fire’’ is a fire caused by the negligence or fault of the Contractor’s operations including, but not limited to, one caused by smoking by persons engaged in the Contractor’s operations during the course of their employment, or during rest or lunch periods; or if the Contractor’s failure to comply with requirements under this contract results in a fire starting or permits a fire to spread. Damages and the cost of suppressing negligent fires shall be borne by the Contractor.
Other Fires on Contract Area. The Forest Service shall pay the Contractor, at firefighting rates common in the area or at prior agreed rates, for equipment or personnel furnished by the Contractor at the request of the Forest Service, on any fire on the contract area other than an operations fire or a negligent fire.
(d) Contractor’s Responsibility for Notification in Case of Fire. The Contractor shall immediately notify the Government of any fires sighted on or in the vicinity of the work site.
(e) Performance by the Contractor. Where the Contractor’s employees, agents, contractors, subcontractors, or their employees or agents perform the Contractor’s operations in connection with fire responsibilities, the Contractor’s obligations shall be the same as if performance was by the Contractor.
(f) State Law. The Contractor shall not be relieved by the terms of this contract of any liability to the United States for fire suppression costs recovered in an action based on State law, except for such costs resulting from operations fires. Amounts due to the Contractor for firefighting expenditures on operations fires shall not be withheld pending settlement of any such claim or action based on State law.

It is anticipated that a firm fixed price contract will be awarded as a result of this synopsis/solicitation.
The Government intends to make one award from this solicitation. Therefore, to be considered responsive, contractors must submit pricing for all items.
Evaluation and Basis for Award
The provision at FAR 52.212-2, Evaluation—Commercial Products and Commercial Services is not applicable to this solicitation. In lieu of this provision, quotes will be evaluated in accordance with FAR 12.203 based on the criteria listed below. Award will be made to the offeror representing the best value to the Government.
Offerors are asked to submit a narrative explaining the Technical Approach they will use to accomplish the work including methods, work plan, specific employees assigned to this contract and their curriculum vitae/resume. In addition, the offer shall contain Relevant Past Performance information for similar work within the last 3 years.
The factors and subfactors below will be used to help determine best value.
1) Technical Approach - Fieldwork Plan Key Personnel
2) Relevant Past Performance – Quality of Work, Business Relations, and Timeliness of
Performance
3) Price
Award Basis
Award will be made to the offeror (1) whose technical approach, past performance and price is the most advantageous and represents the Best Value to the Government. Award may not necessarily be made to the offeror submitting the lowest price, they must meet the technical approach and past performance standards also.
The Government intends to evaluate quotations using a comparative evaluation methodology.
This means quotations will be compared against one another to determine which provides the best value to the Government, based on the evaluation factors outlined in this solicitation.
The Government may consider quotations that exceed minimum requirements and offer additional value or benefits, even if they are not the lowest priced. However, formal tradeoff procedures will not be conducted.
Past performance information utilized may be obtained from past personal experience and knowledge of offerors performance on the part of the Government evaluators may be utilized.
Sources may include CPARS, past performance questionnaires, and other verifiable references.
The Government reserves the right to limit or expand the number of references it decides to contact and to contact references other than those provided by the offeror.
Note: Offerors without relevant past performance will not be rated favorably or unfavorably but will receive a Neutral Confidence rating.
Option Item(s) will be evaluated and considered at the time of award. Option Item(s) shall be awarded based on the availability of funding. Award of Option Item(s) may occur anytime during the period of performance of the call order.
The Government will issue a contract as a result of this solicitation to the responsible offeror whose quote conforms to the solicitation requirements and which offers the best value to the Government, technical approach, relevant past performance, and price all considered.
If a price is found unreasonably low in comparison to the Government Estimate and the competition, that quoter may be asked to review/revise their price and resubmit.
Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition.
The Government may reject any or all offers, issue a contract to other than the lowest price, waive minor informalities or irregularities in offers received, or elect to not award a contract at all. If necessary, the Government may conduct discussions with any or all offerors; therefore, each initial offer should contain the offeror’s best terms and must speak directly to the evaluation factors listed above. Available funding will also determine final award.
The Contractor’s offer, including revisions and amendments made prior to contract award, will be incorporated into this contract upon award.

NOTICE FOR FILING AGENCY PROTESTS
United States Department of Agriculture (USDA) Ombudsman Program
The USDA is committed to issuing solicitations and awarding contracts in a fair and prompt manner.
The Ombudsman Program for Agency Protests (OPAP) was established to address protest issues within the agency, providing an alternative to costly and time-consuming litigation. Operating independently, OPAP offers relief comparable to that granted by the Government Accountability Office (GAO). Interested parties are encouraged to resolve concerns through USDA’s internal Alternative Dispute Resolution (ADR) process before pursuing external forums such as the GAO.
Concerns may be addressed informally or through a formal agency protest filed with either the Contracting Officer or the Ombudsman.
Informal Forum with the Ombudsman
1. Initial Point of Contact: Interested parties who believe a specific USDA procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer.
2. Escalation: If the Contracting Officer is unable to address their concerns, interested parties are encouraged to contact the USDA Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Utilization of the informal forum does not suspend any time requirement for filing a formal protest with the agency or other forums.
3. Required Information: To ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman
1. Effort to Resolve: Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions.
2. Independent Review: If the protester’s concerns remain unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest with either the Contracting Officer or, alternatively, with the Ombudsman under the OPAP program. Contract awards or performance will be suspended during the protest period unless justified in writing for urgent and compelling reasons or determined in writing to be in the best interest of the Government.
3. Resolution Timeline: The agency’s goal is to resolve protests within 35 calendar days from the date of filing.
4. Required Information: Protests shall include the information set forth in FAR 33.104(a)(3).
Failure to submit the required information may result in a delay or dismissal of the protest.
5. Timeliness: Protests must be filed within the timeframes specified in FAR 33.104.
6. Submission: Formal protests under the OPAP program should be submitted electronically to SPE.inquiry@usda.gov and the Contracting Officer.
Election of Forum. By initiating a protest with the USDA, the protester agrees not to pursue the same matter with the Government Accountability Office (GAO) or any other external forum while the agency protest is pending. If a protest is filed externally, the agency protest will be dismissed.

ARCHAEOLOGICAL SURVEY METHODOLOGY
Areas in need of survey will be identified by the Deschutes National Forest (DNF) based on proposed treatment units and areas of high probability for historic properties. Resources that may be encountered include both pre-contact (lithic scatters, habitation sites, etc.) and historic (refuse scatters, railroad logging grades/camps, homesteads, etc.). Approximately 4,469 acres would be surveyed within identified areas as a mandatory item under this contract with up to an additional 4,489 acres available as optional items. Optional items will range based on bid rates, areas will be finalized by the DNF at award of optional items. Areas will be surveyed using transects spaced no greater than intervals of 20 meters. Survey methods and cultural resource documentation must meet Oregon State Historic Preservation Office (SHPO) standards as detailed in this SOW. Due to the nature of surveying total number of sites and or resources to be recorded are unknome. All new sites will be recorded as described in the SOW below. Previously recorded cultural resources will be revisited and revised as directed by DNF archaeologist at the prework meeting.
Work must be completed by archaeologists meeting the Secretary of Interior’s Professional Qualification Standards, available at: https://www.nps.gov/articles/sec-standards-prof-quals.htm.
Please include curriculum vitae for the Principal Investigator and all crew leaders in the Quote.
PROJECT REQUIREMENTS

SOW Page:3
Pre-field Work
• The Forest Service will identify locations to be inventoried within the project boundary.
Survey acreage will be approximately 4,469 with up to an additional 4,489 as optional items (Attachment 05 maps).
• A pre-field meeting will be held virtually with the Deschutes National Forest archaeologists prior to beginning fieldwork. An external collaboration folder will be established by DNF for sharing GIS shapefiles, cultural resource documentation, required forms, and reference materials.
• LiDAR imagery for the survey areas will also be provided by DNF to the contractor for review at the pre-work meeting.
Field Methods
• Survey transects must be spaced at intervals ≤ 20 meters.
• No sub-surface testing or artifact collection will be permitted.
• Previously recorded cultural resources in the identified survey units will be revisited as directed by DNF archaeologists. Site revisits will include an intensive 5-10 meter transect survey of the site area to establish surface boundaries. Updated spatial data must be collected and an updated Deschutes National Forest Site/Isolate/Monitoring Form (included in Attachment 2) completed for each resource as indicated.
• All newly discovered sites will be completely documented, including portions outside the APE if on federal land, using the Deschutes National Forest Site Form (included in Attachment 2). As of July 1, 2023, the Oregon SHPO defines an archaeological site as 2 or more artifacts or 1 or more feature(s). An isolated find is defined as a single artifact.
• Site form must be fully completed with the exception of Section V: NRHP Eligibility which will be completed by the Forest Service. The purpose of the form is to collect required field and location data that will be finalized by the Forest Service. Site forms must include:
o An introductory paragraph including general site type, site size, landscape description (topography, vegetation, soil), ground surface visibility, and total artifact count.
o Assemblage description with artifact composition, artifact density, and a detailed discussion of features or concentrations (if present). Temporally or culturally diagnostic materials and/or notable artifacts, such as precontact tools, must be described.
o A summary containing an interpretation of site function and timeframe of occupation.
o Site overview photographs along with photographs that provide evidence in support of the site narrative (i.e. artifact assemblage and distribution).
Photographs are required for all features, delineated artifact concentrations, pre-contact tools, and unique and/or diagnostic historic items (e.g., items with makers
SOW Page:4 marks, legible lithography and Applied Color Labels). Detailed photographs must include a scale. Aspect must be noted for overview photos.
o Location map at 1:24,000 scale.
o Site sketch map to scale. Artifact concentrations, features, all pre-contact tools, and unique and/or diagnostic historic artifacts (see examples above) must be plotted on the sketch map. Map will include topographic features or LiDAR derived hilshade for context.
o Document must be in Microsoft Word format.
• Isolated finds (defined as a single artifact) must be documented on a Deschutes National
Forest Isolated Find Form (included in Attachment 2). Forms will be fully complete with the exception of an eligibility statement which will be completed by the Forest Service.
Forms must include:
o An overview photograph and at least one photo of the artifact.
o Location map at 1:24,000 scale and additional detail maps (as appropriate).
o Document must be in Microsoft Word format.
• Railroad grade features are present within Mandatory Survey 01 and Optional Surveys 03 and 05 and will be recorded as linear resources.
o Potential grade locations have been identified and are included in the approximate survey acreage.
o Grades will be recorded in predetermined sections within the larger system based on logical physiological breaks and the current use-status of the grade (system road, non-system road, non-road). Each section will be given a unique identifier and will be represented on the site form map.
o Recorded details per section will include length, max width, max height, construction methods (berm, cut/fill, surface), the presence of defining features (ties, spikes, significant berms, other architectural elements), and overall condition.
o One photograph per section is also required to demonstrate the characteristics of the grade.
• Historic resources and associated artifacts will be recorded using the U.S. Customary Measurement System (feet/inches). The Reno 2012 Can Guide (Attachment 4) will be used when recording venthole milk cans. References for other common artifact types will be provided by DNF at the pre-work meeting with the expectation that they are included in all pertinent forms.
• Sites and isolated finds must be documented using a GPS with an accuracy of less than 5-meters. Please specify the type of GPS unit that will be used for data collection in the Quote. The contractor must submit GIS data for relocated previously recorded sites, newly recorded sites, isolated finds, and the boundary of survey areas. Site boundaries greater than 20 m in any direction will be represented as polygons except linear resources (e.g., railroad grades, ditches, stock driveways) which will be represented as polylines.
SOW Page:5
All other resources (i.e., isolated finds and small sites less than 20 m in any direction) will be represented as points.
DELIVERABLES
• Status check-ins via email are required at the end of each field session indicating amount and location of survey completed (with accompanying map), number of resources noted, and any pertinent issues, questions, or comments from the completed session.
• Contractor must provide the DNF archaeologist the opportunity to review and comment on the draft resource forms and associated GIS at the end of each field session to ensure adequate data collection. The Forest Service will provide comments on a subset of the draft resource forms within 1 week of receipt to be incorporated in remaining field sessions.
• Contractor must provide the DNF archaeologist the opportunity to review and comment on all resource documentation and GIS data prior to final submission. The Forest Service will provide feedback within 3 weeks of draft submittal.
• The contractor must submit one digital copy (Microsoft Word only) of the site forms, isolated find forms, and shapefiles or geodatabase for sites (including any data on sketch maps for concentrations, features, etc.), isolated finds, and survey area. Digital copies of all photographs, photo logs, and field notes must also be submitted.
INSPECTION AND ACCEPTANCE
Contractors are asked to proceed with the work item identified in the specifications as soon as possible following the Notice to Proceed (NTP). As part of their responses to this RFQ, contractors are asked to confirm their availability to start the project as soon as the NTP is issued. The contractor will not be considered at fault if the survey cannot occur immediately due to ground snow coverage.
Upon award of the contract and issuance of the NTP, a time will be established for a pre-work meeting to include the Key Personnel such as the contractor, the COR, the CO and any other appropriate parties as…
