B.2 SCHEDULE NOTES
GENERAL INFORMATION:
All Contractors must be actively registered in the System for Award Management (SAM) at https://SAM.gov to be eligible for award under this solicitation. Registration in SAM is a free service – you do not need to pay to register in this system. If your registration is not active, you will not be considered for award.
PRICING INFORMATION: These schedules are for pricing/payment purposes. Refer to Section L, Instructions to Offerors for business proposal requirements. Evaluation criteria used by the Forest Service for proposals is in Section M of this solicitation.
Price Proposals MUST be provided on ALL Items in ALL Schedules: Mandatory Work Activities, Optional Work Activities, and Timber or Other Products Removal Price Schedules.
All timber products designated for removal have been determined to be deficit by the FS after deducting the costs to cut, yard, process, and haul products from the estimated delivered value;
therefore, this work has been priced as a service item. A per ton offer amount (flat) that equals or exceeds the minimum acceptable offer and a total offer shall be provided within the Timber/Product Removal Price Schedule. Road maintenance and road reconstruction costs are considered separately as priced service items.
**Offerors shall provide cost data associated with Mandatory Item 1 and Optional Item 9. This data shall be used for government review purposes only, is considered proprietary and will not be made public and will not be incorporated into the awarded contract as a material term/condition.
For Item 7, the unit of measurement is a Lump Sum, however partial payments may be made by a rough percentage of fish logs and woody debris delivered. Final payment for this Item shall not be approved until all 525 logs greater than 8-inch DBH and 350 CY of woody debris less than 8-inch DBH are delivered.
Wet Operational Rock: In order to operate heavy equipment or haul logs over Forest roads outside of the dry season (May 15 – October 15), placement of operational rock is required.
Even with rock installed, if heavy rainfall occurred, road use would need to be suspended to protect water quality and road condition. To allow for year-round work while economizing and reducing construction costs, the Forest has identified roads (haul routes) that may be treated with operational rock under Mandatory and Optional road reconstruction pay items. Please note that the estimated quantities are just that, estimates. Locations requiring rock placement would be determined by the CO based on specific road conditions.
Hazard trees within Units accessed by roads not identified for operational rock could be hand fallen and small fuels could be treated but no road use for log haul or heavy equipment operation

FAC 2024-05 May 22, 2024 would be allowed between October 16 – May 14 unless the contractor met the requirements detailed in Appendix B, C5.12# for conditional use; generally speaking, rock would be laid at the contractor’s expense.
Award of Optional Work: Optional Items and corresponding timber removal may be awarded at time of contract award or by modification. If funding dictates and it is in the best interest of the government, optional work items may be awarded by Unit or Road and for amounts less than the total estimates based on the unit prices quoted. Unit prices prevail.
The lump sum prices for road reconstruction Items 14(a) Mobilization, 14(b) Soil Erosion and Pollution Control and 14(g) Temporary Traffic Control shall be awarded based on the percentage Item 14(e) Road Reconditioning miles awarded. Award quantities shall be based on expected need for Items 15(a) Subbase, 15(b) Surface Course and 16 Fall and Leave Individual Hazard Trees with NTE quantities and payment based on the actual quantity of work performed.
Quantities listed in Timber/Product removal schedules are estimates only. Refer to solicitation G.13, Timber Product Volume Estimation for the methodology used.
The following apply to Road Reconstruction work items only:
A. The construction work required within Mandatory Items 6(a-u) and Optional Items 14(a-
g) and 15(a-b) is subject the the Construction Wage Rate Requirements (see Wage Decision in Section J) and related regulations, formerly referred to as Davis-Bacon (i.e.
certified payroll submission).
B. A bid Guarantee is required in an amount equal to 20% of the total price offered for the Mandatory and Optional Construction Items only. Forestry services for fuels reduction and road maintenance work is not subject to bonding requirements. BID BONDS MUST BE PROVIDED WITH THE INITIAL OFFER. See FAR 52.228-1 Bid Guarantee (SEP 1996) (DEVIATION MAY 2020) in Section I.
C. Payment and Performance Bonds shall be required in an amount equal to 100% of the awarded value of road reconstruction work. See Section I. FAR 52.228-15 Performance and Payment Bonds -- Construction (JUN 2020) (DEVIATION APR 2020). Bonding costs shall be included the prices quoted for Mobilization. No separate payment for bond premiums shall be made.
D. Service Contract Act minimum wages applies to all fuels management work and road maintenance work. See Wage Determination in Section J.
***A Draft Small Business Subcontracting Plan is required with any proposal from a large business. Refer to FAR 52.219-9 Small Business Subcontracting Plan for requirements. USFS small business goals shall be supplied in the final solicitation.***
B.3 LAND MANAGEMENT ACTIVITIES
The Forest Service is executing this procurement under the stewardship contracting authority
FAC 2024-05 May 22, 2024 provided under Section 8205 of Public Law 113-79, the Agricultural Act of 2014 as amended under Section 204 & 207 of the Consolidated Appropriations Act (Omnibus Bill 2018).
Stewardship authority grants the Forest Service the authority to aggregate stewardship work activity requirements and solicit those requirements utilizing full and open competition.
Performance of land management activities shall be in accordance with the Project Description and Work Specifications. Payment for Land Management Work Activities in Schedule of Items will be made in Stewardship Credits and Appropriated Funds.
All Base Work Activities (Mandatory) shall be performed. Optional activities are listed in order of planned priority. Award may be made for optional items in any order that the Contracting Officer determines is in the best interest of the Government.

SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
C.1 SCOPE OF CONTRACT
The objectives of this project are to reduce the risks of hazardous fuels that have fallen across or remain standing along important access routes of the 2020 fire-affected road system so that access to and through the burned area can be restored. Fire severity varied across the treatment areas; burn severity maps and tables are included for planning purposes.
Activities include performing mitigation of risk along road from fire killed/damaged trees, reduction of roadside fuel accumulation and essential maintenance and reconstruction of roads.
This will be done by accomplishing the following:
• Cut and remove fire killed timber within 100 feet of roads from the Contract Area.
Hazard trees to be cut are Designated by Prescription.
• Fall and leave non-commercial hazard trees within Special Measure Areas (SMAs).
SMAs may include Riparian Reserves, cultural resource areas, wildlife habitat protection areas or other areas that requires special protections. This work is located within 100 feet of the road. SMAs do not overlap acres that require the cutting and removal of fire killed trees.
• Within unit polygons, fall and leave hazard trees that can strike the road outside of the 100-foot fuels removal area.
• Perform small fuels treatment within 30 feet of roads.
• Perform road reconstruction within the Contract Area during the dry season (May 15-
October 15).
• Perform pre-haul, during-haul and post-haul road maintenance within the Contract
Area.
• Yard and deliver non-commercial fish logs to specified deck locations.
• Remove hazardous fuels greater than 16” from Unit LH-62 that are within 100 feet of the road.
• Fall and leave individual hazard trees that are outside of units but within striking distance of the road.
Ground based hazard tree work shall be permitted year-round and must comply with required protections for wet season operations and Industrial Fire Precaution Level (IFPL). Mechanized equipment may be used for harvesting in units with slopes less than 30% during the dry season.
Any resultant contract will be a construction contract with service requirements and requirements for timber removal. Under this contract, “Contractor’s Operations” shall include activities of or use of equipment of Contractor, Contractor’s employees, agents, Subcontractors, or their employees or agents, acting in the course of their employment in operations hereunder on National Forest lands or within Forest Service protection boundary (unless acting under the immediate supervision of Forest Service). Contractor’s Operations shall be conducted in a workmanlike and orderly manner. The timing of required Forest Service designation of work on
Project Name: BCLH Stewardship IRSC Phase 1 the ground and the performance of other Forest Service work shall not be such as to cause unnecessary delay to Contractor.
C.2 PROJECT LOCATION
The BCLH Stewardship IRSC Phase 1 project is located approximately 2 to 12 miles east of Detroit, OR within the burn scars of the Beachie Creek Fire and Lionshead Fire, both of which occurred in 2020. The total project area is within the Detroit Ranger District of the Willamette National Forest. This Contract Area of 1,612 acres is located approximately in Sec 31-36, T09S, R06E; Sec 3, 4, 8-10,15-17,19,36 T09S, R06E; Sec 20,22-29, T10S, R06E; Sec 1-11, T10S, R07E; Sec 18,19, 1-5,19 T10S, R08E; Willamette Meridian, Surveyed & Unsurveyed, Marion County, Oregon. See maps included as attachments to the solicitation
C.3 MAGNITUDE OF CONSTRUCTION PROJECT
For Road Reconstruction work requirements, the total estimated price for all Mandatory Items is between $5,000,000-$10,000,000. The total estimated price for all Optional Items is between $500,000-$1,000,000.
C.4 TECHNICAL SPECIFICATIONS
General specifications for each Contract Activity individually described by an item number in the Schedule of Service Items can be found in Appendix A. Specifications for timber removal can be found in Appendix B and associated road maintenance specifications in Appendix C for Stewardship related projects.
Standard Specifications for Construction and Bridges on Federal Highway Projects, FP-14, U.S.
Customary Units apply to the road reconstruction work and are included in this solicitation by reference only. The requirements contained in these Specifications are hereby made a part of the solicitation and any resultant contract. Copies of the Specifications are available by performing an internet search for the FP-14. Road reconstruction drawings, exhibits, worklists and Forest Service Supplemental Specifications (to tailor the FP-14 standard specifications) can be found in Appendix D.
AGAR 452.211-72 Statement of Work/Specifications (FEB 1988)
The Contractor shall furnish the necessary personnel, material, equipment, services and facilities (except as otherwise specified), to perform the Statement of Work/Specifications referenced in Section J.

C.5 CONTRACT AREA MAP
The boundaries of restoration activities identified in Appendices A, B, C, and D as well as Subdivisions or Payment Units and any cutting units thereof, are as shown on the attached "Contract Area Map’s," which is made a part hereof, and were, before solicitation, designated on the ground by Forest Service to meet the anticipated needs of the parties. The location of the Restoration Activities including Subdivisions or Payment Units and their approximate acreage are stated in Division A/. Subdivisions or Payment Units may be revised and additional ones may be established only by written agreement of both parties. Where applicable, the following are also identified on Contract Area Map:
(a) Identified claims limiting Contractor's rights
(b) Boundaries of cutting units
(c) Areas where leave trees are marked to be left uncut
(d) Roads listed
(e) Sources of base course, rock riprap and surface rock
(f) Roads where log hauling is prohibited or restricted
(g) Roads and trails to be kept open
(h) Improvements to be protected
(i) Locations of known historical sites
(j) Maximum stump heights when more than one height is listed by areas
(k) Skidding or yarding methods specified
(l) Streamcourses to be protected
(m) Other features required by Appendix B; and
(n) Boundaries of stewardship work activities.
C.6 GOVERNMENT FURNISHED PROPERTY
The Government will provide the following item(s) of Government property to the Contractor for use in the performance of this contract. This property shall be used and maintained by the Contractor in accordance with the provisions of the "Government Property" FAR clause(s) contained in Section I of the contract.
The following property shall be supplied for use without charge:
• FSSS 30109 – Subbase, Grading A, Compaction Method (b), McCoy Pit (44.69266N, 122.03350W on 2233-605). This aggregate shall be available for use no later than 8/15/2025.
• FSSS 30115A and 30115B - Aggregate Surfacing, Grading F, Compaction Method (b), location: McCoy Pit (44.69266N, 122.03350W on 2233-605). This aggregate shall be available for use no later than 8/15/2025.
C.7 OPERATING PLAN AND SCHEDULE
The Contractor will provide, as part of the technical proposal, a detailed timeline of when the contract requirements will be accomplished while conforming to the requirements within Section F.5. The operating plan should indicate the sequence of activities that will take place to accomplish the tasks described within the solicitation, Appendix A, Appendix B, Appendix C, and Appendix D including proposed start and completion dates.

C.8 SUSTAINABLE ACQUISITIONS
The Contractor shall comply with the Agricultural Act of 2014; the Food, Conservation and Energy Act of 2008 (FCEA), 7 U.S.C. 8102; the Farm Security and Rural Investment Act of 2002 (FSRIA), 7 U.S.C.
8102; the Federal Acquisition Regulation; Executive Order (EO) 13514, “Federal Leadership in Environmental, Energy and Economic Performance,” dated October 5, 2009; EO 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” dated January 24, 2007; and Presidential Memorandum, “Driving Innovation and Creating Jobs in Rural America through Biobased and Sustainable Product Procurement,” dated February, 2012 to provide biobased products.
In compliance with FAR Part 23.4 through performance of this contract, the Contractor shall make maximum use of EPA designated and USDA designated biobased in accordance with FAR clause 52.223- 2 Affirmative Procurement of Biobased Products under Service and Construction Contracts and 52.223- 17 Affirmative Procurement of EPA-designated Items in Service and Construction Contracts
The Contractor shall utilize products and material made from biobased materials (e.g. biobased greases, biobased hydraulic fluids, biobased absorbents) to the maximum extent possible in the performance of this contract without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. Information about this requirement and a catalog of products are available at the Bio-Preferred Web Site.
The Contractor shall utilize products and material to the maximum extent possible in the performance of this contract from EPA’s list of designated products and the accompanying recommendations for post-consumer content and recovered materials content in the following eight categories: Construction products, Landscaping products, Non-paper Office Products, Paper and Paper Products, Park and Recreation products, Transportation Products, Vehicular Products, and Miscellaneous Products.
Compliance with the USDA Biobased requirements requires Contractors to report the purchase of biobased products during the previous Government fiscal year, between October 1 and September 30 under service and construction contracts through the System for Award Management at https://sam.gov/content/home and provide a copy of the report to the Contracting Officer no later than October 31 of each year during contract performance and at the end of contract performance.
7.1 Sustainable products identified for this solicitation:
The following is a list of categories for bio-preferred products and EPA products that that may be used in the performance of this contract. The list is not all inclusive; the Contractor shall research for available products.
7.1.1 Bio Preferred Products:
a Diesel Fuel Additives
(1) Any substance, other than one composed solely of carbon and/or hydrogen, that is intentionally added to diesel fuel (including any added to a motor vehicle's fuel system) and that is not intentionally removed prior to sale or use.
(2) Neat biodiesel, also referred to as B100, when used as an additive. Diesel fuel additive does not mean neat biodiesel when used as a fuel or blended biodiesel fuel (e.g., B20). 90% - Minimum Biobased Content.
b Hydraulic Fluids - Mobile Equipment Hydraulic fluids formulated for general use in nonstationary equipment, such as tractors, end loaders, or backhoes. 44% - Minimum Biobased Content.

d Greases - Truck Lubricants composed of oils thickened to a semisolid or solid consistency using soaps, polymers or other solids, or other thickeners. Lubricants that are designed for use on the fifth wheel of tractor trailer trucks onto which the semi-trailer rests and pivots. 71% - Minimum Biobased Content.
e Gear Lubricants Products, such as greases or oils, that are designed to reduce friction when applied to a toothed machine part (such as a wheel or cylinder) that meshes with another toothed part to transmit motion or to change speed or direction. 58% - Minimum Biobased Content.
f Fuel Conditioners Products formulated to improve the performance and efficiency of engines by providing benefits such as removing accumulated deposits, increasing lubricity, removing moisture, increasing the cetane number, and/or preventing microbial growths within the fuel system. 64% - Minimum Biobased Content.
h Erosion Control Woven or non-woven fiber materials manufactured for use on construction, demolition, or other sites to prevent wind or water erosion of loose earth surfaces, which may be combined with seed and/or fertilizer to promote growth. 77% - Minimum Biobased Content.
g 2-Cycle Engine Oils Lubricants designed for use in 2-cycle engines to provide lubrication, decreased spark plug fouling, reduced deposit formation, and/or reduced engine wear. 34% - Minimum Biobased Content.
7.1.2 EPA Designated Products:
Plastic trash bags, printer ribbons, toner cartridges, print & writing papers, Traffic Barricades, Traffic Cones, Engine Coolants, Rebuilt Vehicular Parts, Re-refined lubricating oils, retread tires, manual grade strapping, signage, sorbents.
C.9 DEFINITIONS
Acceptable Quality Level: The allowable leeway or variance from a standard before the government will reject the specific service. As long as the percent of defective performance does not exceed the AQL, the service will not be rejected by the government. The contractor, however, must re-perform the defective service when possible.
Biobased Products: See Sustainable Acquisitions Contracting Officer (CO): Individual with authority to bind the government with their signature on the contract.
Contracting Officer Representative (COR): Individual(s) designated to act on the behalf of the CO within the delegation given them in writing.
Period of performance (also Performance period or Contract time): All calendar days allowed for completion of contract work. Includes all days of the week including weekends and holidays.
Quality Assurance: Those actions taken by the government to check goods or services to determine that they meet the requirements of the Statement of Work (SOW).
Quality Assurance Surveillance Plan (QASP): An organized written document used for quality assurance surveillance. The document contains information about how the government will assess performance, checklists, and may contain decision tables.

The increased development, purchase, and use of biobased products reduce our nation's reliance on petroleum, increase the use of renewable agricultural resources, and contribute to reducing adverse environmental and health impacts. SECTION H--SPECIAL CONTRACT REQUIREMENTS
H.1 CLAUSES
AGAR 452.228-71 Insurance Coverage (NOV 1996)- Alternate I (NOV 1996)
Pursuant to FAR clause FAR 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:
(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.
(b) General Liability. (1) The Contractor shall have bodily injury liability coverage written on a comprehensive form of policy of at least $500,000 per occurrence. (2) The Contractor shall have property damage liability insurance shall be required in the amount of ____*___ per occurrence.
(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.
(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.
