Amendment 001

ELK CLARK STEWARDSHIP IRSC

Coconino National Forest - Flagstaff Ranger District - AZ Region 3 Solicitation #

12363N22Q4069

Q1: Will there be any contract term extensions available for market conditions, fire, and weather-related shutdowns, etc.?

If so, what are terms to extend and how long of a wait to extend?

A1: The established period of performance accounts for the standard work progress rate and takes into account fire and weather related shut downs. IRSC contracts’ intents are to treat the landscape for restoration and forest health purposes with Timber harvest being one of the many positive outcomes. Market timing is not something we can accommodate outside the period of performance necessary for the work to be complete.

Q2: Given that forestry and logging is part of the agriculture sector (NAICS code 11; SIC code 01-09), why are SCA wages being used? In timber sales, forestry has always been exempted from Davis-Bacon prevailing and SCA wage requirements. With this in mind, is there any way to remove this requirement from the contract?

A2: IRSCs are Service contracts and the Service Contract Act is a mandatory item in which employees working under our contract must be paid, at a minimum. It is, or should have always been, part of the contract terms and conditions as they are Congressionally mandated.

Q3 Are we able to submit IRSC technical proposals and price proposals specifically through the CO and COR and not through SAM? Or are we doing both?

A3: Proposals should be emailed to Nikki Layton at Nikki.Layton@usda.gov and Shemeka Ricks at

Shemeka.Ricks@usda.gov. This is the only method to respond to the solicitation. Further, we recommend that each document be sent in separate emails and the total document size be under 5MB to help insure successful delivery.

Q4: Did the wildlife biologists make an official determination on any MSO in the former Elk Park 4FRI Phase-1 task order?

If not, when will this survey work occur?

A4: The district has waived timing restrictions on one portion of the MSO timing restricted area that encompasses

Units 4, 12, and 51 for this year (2022).

Q5: Are “Emergency Firefighters” (Section 43; pp 25-27) hired by the Forest Service for fires other than operations and/or negligent fires caused by the Contractor required to be trained in basic wildland firefighting (i.e., S-130/S-190) or be currently red-carded?

A5: The Contractor, under the provisions of FAR clause 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements, shall immediately extinguish all fires on the work site other than those fires in use as a part of the work. The contractor does not require a red-card to extinguish fires on the work site, similar to a member of the public extinguishing their escaping camp fire. However, if a contractor is hired by the Forest Service for fire suppression activities for an extended period of time, that individual will require a red-card and will be ordered to the fire through the appropriate process.

Q6: Can we obtain a copy of the full cruise of record and biomass pile calculation methodology at your earliest convenience?

A6: We have a cruise run available. It will be posted as an additional attachment to the solicitation via amendment and placed in SAM.
