QUESTIONS ASKED / ANSWERS GIVEN

Verlot Road Access: The road is accessible at this time.

Septic Tank Location for Building #1000: The location was pointed out on site. There was discussion that the tank could be between 500 – 100 gal.

Performance Bond: As detailed in the Request for Quotation (RFQ) a Performance Bond is required.

Bid Bond/Bid Guarantee: Not required since this project is estimated to be lower than the simplified acquisition threshold (SAT) of $250,000.00.

Invoicing Frequency: The contracting officer (CO) will work with the awardee concerning payment frequency. Because this is a service contract the Federal Acquisition Regulation (FAR) allows an invoice once a month that will be paid by the FS disbursing office within 30 calendar days after the date an acceptable invoice is received by the CO. The CO is willing to accept an invoice every two weeks vice once a month; the key is cash flow for the contractor as well as not inundating the disbursing office with multiple invoices a month under one contract.

Restoration/Backfilling/Seeding: As required in the RFQ.

Start Date: The start date is stated in the contract as March 2019, but due to the government shutdown, potential snow, etc. this date is negotiable.

Operating Hours: These hours are negotiable, but as detailed in the RFQ the awardee must submit a request to the CO for review/approval.

Salvage: No materials are being salvaged by the government. It is the awardees responsibility to remove all debris off of forest lands.

Permit Requirements: The USDA Forest Service will be contracting with a demolition contractor that has the expertise to obtain all required permits for all elements of the scope of work. The cost of these permits shall be included in the quoted price. Failure to obtain all required permits is grounds for termination by default. FAR 52.236-7 Permits and Responsibilities is provided by reference on page 18 of 134, but is provided in full text here for your convenience:

“The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any Federal, State, and municipal laws, codes, and regulations applicable to the performance of the work. The Contractor shall also be responsible for all damages to persons or property that occur as a result of the Contractor’s fault or negligence. The Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract.”

Danger Tree Removal: If a danger tree is discovered contact Thomas Warter, Contracting Officer’s Representative (COR), immediately for direction on how the USDA Forest Service desires it to be handled. No work can be performed without a signed modification or a verbal notice to proceed from the CO.

Handling / Disposal of Hazardous Materials: The FS is hiring a demolition contractor that is expected to have a clear understanding of all federal and state rules, regulations, and laws concerning the handling, removal, and disposal of all hazardous materials, e.g. petroleum products, lead paint, asbestos, etc. The contractor assumes all liability and risk associated with hazardous materials and is expected to turn over all disposal records to the CO/COR.

As-Built Drawings: There are no known as-builts for these buildings. If they are discovered they will be distributed via an amendment to the Federal Business Opportunities (FBO) website.

Darrington Seed Orchard Building #2376 Dimensions and Location: The contractors are required to visit each project location and take dimensions in order to prepare accurate pricing.

The location of this building is provided on page 27 of 134 of the RFQ and a photo is provided on page 36 of 134 of the RFQ.

Additional Questions Received During the Government Shutdown Period

• Adrianna Yugovich, 3 Kings Environmental, Inc., E-mail Question Received 1/8/2019: Is a bid bond needed for this project?

o Answer: See above.

• Kendahl Relaford, Carman’s Construction, E-mail Question Received 1/7/2019: I am wondering if you have an exact address for the Seed Orchard Building or special directions/landmarks to help navigate there?

o Answer: See above. If the details on the map are insufficient please contact the CO / COR directly.

• Jennifer Neal, Mechanical Mind, E-mail Question Received 1/4/2019: For the Underground Storage Tank do you need the site assessment to be a Phase 1 or a Phase 2 assessment?

o Answer: The underground storage tank assessment is called out in spec section “3.05 SITE ASSESSMENT” on page 53 of 134. If these details are not sufficient for the level of assessment expected please notify the CO/COR. The FS’s goal is to expend as little funding as possible for this section while complying with all federal and state rules, regulations, and laws.

o Amendment 02 revises the Schedule of Items and revises the language in the Underground Storage Tank Decommissioning specification.

Additional CO Comment: The eventual awardee of this contract is reminded that under no circumstance will changes in contract price, time, terms or conditions be considered without first discussing them directly with the CO and having a bilateral modification in place before the additional, in-scope work is performed. Under urgent situations the CO is authorized to issue a verbal notice to proceed to the contractor for modification work prior to having a signed, bi-lateral modification in the spirit of maintaining the demolition schedule, maximizing equipment rental times, etc.
