SUBJECT: Implementation of the following Executive Orders (E.O.); 1202SC25Q2900
In accordance with United States Department of Agriculture (USDA) memoranda effective March 14, 2025, class deviations have been issued in accordance with Federal Acquisition Regulation (FAR) Subpart 1.404 in order to implement the following Executive Orders (E.O.):
E.O. 14148 “Initial Rescissions of Harmful Executive Orders and Actions”
E.O. 14173 “Ending Illegal Discrimination and Restoring Merit-Based Opportunity”
E.O. 14168 “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government”
E.O. 14208, Section 2, “Ending Procurement and Forced Use of Paper Straws".
Since these updates are to be made immediately to all open or new solicitations, new contracts or orders, and existing contracts or orders, some system updates may lag policy updates. The System for Award Management (SAM.gov) may continue to require entities to complete representations based on provisions that will no longer be included in agency solicitations. Examples include 52.222-25, Affirmative Action Compliance, and paragraph (d) of 52.212-3, Offeror Representations and Certifications—Commercial Products and Commercial Services. Contracting Officers will not consider these representations when making award decisions or enforce requirements. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.gov.
