About this file

This is an attachment to a Colorado Department of Corrections (CDOC) contract outlining Prison Rape Elimination Act (PREA) compliance requirements for contractors operating correctional facilities. The contractor must adopt and comply with PREA standards as defined in 42 U.S.C. 15601, CDOC Administrative Regulations 100-40 and 100-07, and establish a zero tolerance policy for sexual assault, rape, and sexual misconduct. Key operational requirements include designating a PREA Manager, ensuring all staff, volunteers, and contract personnel complete CDOC basic PREA training with specialized training for first-line responders, shift commanders, investigators, and clinical services nurses. The contractor must provide annual PREA orientation materials to offenders and ensure accessibility for limited English proficient, deaf, and disabled individuals. Additionally, the contractor must conduct triennial U.S. Department of Justice PREA audits using accredited auditors, maintain confidential offender communication channels with auditors, and facilitate CDOC's compliance monitoring throughout the contract term.

The contractor bears full responsibility for demonstrating PREA compliance and funding all associated audit costs. All incidents of sexual misconduct, assault, abuse, and harassment—including staff-offender relationships and related grievances—must be reported separately to the Office of the Inspector General (OIG) with monthly summary reports submitted within ten working days of month-end, including offender and staff demographics. Investigations and staff administrative dispositions must be completed within thirty calendar days of conclusion. The contractor must reimburse CDOC for sexual assault forensic examinations conducted at hospitals with Sexual Assault Nurse Examiner programs, provide mental health treatment to affected offenders, and ensure effective separation of alleged perpetrators and victims. Non-compliance with PREA standards results in assessment of liquidated damages, and the contractor cannot hire current Colorado state employees to conduct required audits.
