About this file

This attachment to a Colorado Department of Corrections (CDOC) contract establishes Prison Rape Elimination Act (PREA) compliance requirements that the contractor must adopt and maintain throughout the contract term. The contractor is required to comply with 42 U.S.C. 15601, CDOC Administrative Regulations 100-40 and 100-07, and implement a zero-tolerance policy regarding sexual assault, rape, and sexual misconduct. Key operational requirements include designating a PREA Manager to coordinate compliance, ensuring all staff, volunteers, and contract personnel receive PREA training through CDOC's instructor training program, and providing specialized training to first-line responders, shift commanders, investigators, and clinical services nurses. The contractor must provide orientation materials to offenders regarding PREA during facility orientation and annually thereafter, with accommodations for limited English proficient, deaf, and disabled individuals to report incidents through interpretive technology or non-offender interpreters.

The contractor is responsible for separately reporting all incidents of sexual misconduct, sexual assault, sexual abuse, and sexual harassment to the Colorado Office of the Inspector General (OIG) within required timeframes, including monthly summary reports within ten working days of month-end and investigation conclusions within thirty calendar days. Additionally, the contractor must provide sexual assault victims with access to Sexual Assault Nurse Examiner (SANE) programs at hospitals, bear all associated costs for forensic examinations, provide mental health treatment and counseling to victims, and ensure effective separation of alleged perpetrators and victims. The contractor must obtain a U.S. Department of Justice PREA audit conducted by an accredited auditor every three years, bearing all audit costs and demonstrating compliance with PREA standards. Non-compliance with PREA standards will result in the assessment of liquidated damages as specified in the contract.
