About this file

This is an Authorization & Certification form template (Template 24.11.24) for the City of Long Beach used in Request for Proposals (RFP) submissions. The form establishes the authorization requirements for proposers to submit bids on behalf of their organizations and certifies compliance with City policies and federal requirements. Proposers must demonstrate proper authorization based on their business structure: sole proprietors (owner signature only), partnerships (general partner signature), corporations (two officer signatures or one officer/authorized person with certified corporate resolution), or limited liability companies (member or manager signature). All proposals must remain valid and open for 90 days from the submission deadline, and proposers certify they have submitted all required documents as specified in section 4.2, properly uploaded and labeled all attachments in the Long Beach Buys system, and reviewed the City of Long Beach Vendor Code of Conduct.

The form includes comprehensive federal compliance certifications required under Executive Order No. 12549 and Title 2 CFR Part 180 Subpart C for any firm potentially receiving federal grant funds through its business relationship with the City. Proposers must certify under penalty of perjury that neither they nor their principals have been suspended, debarred, or excluded from federal funding; have not been suspended or debarred within three years preceding the proposal; have no proposed debarment proceedings pending; have not been indicted, convicted, or had civil judgments rendered involving fraud or official misconduct within three years; and have not had public transactions terminated for cause or default within three years. Additionally, proposers must certify the proposal is genuine and not collusive, and that no conflicts of interest, real or apparent, exist in the selection, award, or administration of any subcontract. The form provides a section for proposers to document any exceptions to terms and conditions, though the City notes exceptions are uncommon and not encouraged, and any award is contingent upon successful negotiation of final contract terms.

Exceptions to Terms & Conditions

EXCEPTIONS TO TERMS AND CONDITIONS (IF APPLICABLE)

Exceptions to terms and conditions are uncommon, and Proposers are not encouraged to take exception to terms and conditions. However, in the event there are terms that should be reviewed as part of potential negotiation of a final contract, they should be listed here. The City of Long Beach has no obligation to accept any exceptions to terms and conditions. Any award is contingent upon the successful negotiation of final contract terms. If contract negotiations cannot be concluded successfully, the City reserves the right to negotiate a contract with another Contractor or withdraw the RFP.
