About this file

This Limited Sources Justification document details a Department of State procurement for ArcGIS software and related services. The requirement includes 115 software subscriptions and licenses across multiple product types, such as Enterprise Creator User Type, Enterprise Contributor User Type, Enterprise Mobile Worker User Type, ArcGIS Desktop Standard and Advanced Single Use Maintenance, ArcGIS Developer Bundle, and ArcGIS Enterprise Standard maintenance. The procurement also includes ArcGIS Support Services labor.

The document justifies sole-source procurement from Environmental Systems Research Institute (ESRI) under FAR 8.405-6, as market research conducted through NASA SEWP and GSA eBuy revealed no small businesses could fulfill all required items. The contract period runs from 03/30/2025 to 10/11/2025, with the order type being Firm-Fixed-Price. The government will use this procurement to support the Diplomatic Security Service Directorate's geospatial database, which provides geospatial information for DS Directorates and other Department of State Bureaus. The estimated contract value is redacted in the document.

SECTION 4: AUTHORITY AND SUPPORTING RATIONALE

This acquisition is conducted under the authority of the Multiple-Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501), as implemented in FAR 8.405.6 by the following:

☒ FAR 8.405-6(a)(1)(i)(B) - Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

While some resellers may sell up to a few Environmental Systems Research Institute (ESRI) products and services, only ESRI can supply all the products and services needed for this requirement because they are the Original Equipment Manufacturer (OEM).

SECTION 5: DETERMINATION BY THE ORDERING ACTIVITY CONTRACTING OFFICER THAT THE

CONTRACT ACTION REPRESENTS THE BEST VALUE CONSISTENT WITH FAR 8.404(D)

The Contracting Officer has determined the anticipated contract action will represent the best value based on the Contracting Officer’s plan to follow the procedures in FAR 8.405. Although approval is requested to contract with one source, the Contracting Officer will not award the planned contract action unless the Contracting Officer evaluates and determines that the resultant price is reasonable.

SECTION 6. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE

HOLDERS AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS

NOT CONDUCTED

Market research was conducted using the Market Research Tools in NASA SEWP and GSA eBuy.

NASA SEWP:

In Step 1, Find Providers, of SEWP’s Market Research Tool, Environmental Systems Research Institute, Inc was searched and produced four (4) small businesses in Group A (NAICS 334111), eight (8) other than small businesses (OTS) in Groups B, C, and D (NAICS 541519), and 27 small businesses in Groups B, C, and D (NAICS 541519). From this point on, only small business resellers will be discussed for NASA SEWP.

Of those results, only one (1) reseller in Group A and eight (8) resellers total in Groups B, C, and D were considered approved resellers.

In Step 2, Find Products, each part number needed for the requirement was input to find at least two (2) small businesses who could fulfill the requirement. None of the approved, small business resellers had all the required items in their IDIQ contracts, as shown in the table below.

For GSA FSS/MAS:

A search using GSA eLibrary was conducted in category 511210, Software Licenses. This produced a list of 1,097 MAS contractors – 829 small businesses and 268 OTS. A search for each part number was conducted within the list of 1,097 contractors. Only one (1) contractor, an OTS, had most (8 of 9) part numbers in their schedule. No other contractor, small or OTS, came close to the same number of items in their schedule, see table below.

Based on these results, the Government’s needs cannot be met by any small businesses and can only be fulfilled by ESRI. The remaining item not on ESRI’s GSA MAS will be an open market item in the order.

The market research for the software described above took place in September 2024, is meaningful, and was conducted well within the allowable timeframe IAW FAR 10.002(b)(1).

This requirement, in addition to the software, includes labor and cannot be separated, therefore, the software market research still applies to a requirement that also includes labor.

SECTION 7. STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR

OVERCOME ANY BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION BEFORE ANY

SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE

The Government will continue to monitor the market and conduct market research to identify any emerging solutions that may satisfy future similar requirements. Should such solutions become available during the lifecycle of the current requirement, the Government will consider whether switching to and installing new systems is in the Government’s best interest, and regarding future similar requirements, seek competition to the maximum extent practicable.
