About this file
This is a Standards of Conduct Declaration form (AG-010) required by the State of Hawaii for contractor compliance with the state's Code of Ethics under Hawaii Revised Statutes Chapter 84. The declaration applies to the Judiciary, Second Circuit procurement for maintenance, inspections, and diagnostics of Air Conditioning and Ventilation Systems at Hoapili Hale (IFB J27219). The contractor must certify through this form that it is not a legislator or employee, nor does it have a controlling interest held by a legislator or employee; that it has not been personally represented or assisted by any former agency employee from the past two years who participated in the contract matter; that it has not retained a legislator or employee for compensation to obtain or perform the contract if that person was involved in contract development or award; and that it has not been represented by any individual who was an agency employee or legislator within the past twelve months who participated in contract-related matters.
The form requires the contractor's authorized representative to sign and declare under penalty of perjury that all statements are true and complete. The State of Hawaii reserves the right to void any contract that violates the Code of Ethics provisions and may recover any fees, compensation, gifts, or profits received as a result of such violations. If the contractor indicates it is a legislator or employee with a controlling interest and the contract value exceeds $10,000, the award must be made through competitive sealed bidding or competitive sealed proposal procedures, or the agency must post a notice of intent to award and file it with the State Ethics Commission.
