Introduction The Draper Fire Department is soliciting proposals from qualified providers to develop and implement a comprehensive Firefighter Wellness and Injury Prevention Program designed specifically to address the unique physical demands of the fire service profession.
Firefighting is a physically demanding occupation requiring personnel to perform strenuous activities under unpredictable and high-stress conditions, including lifting, carrying, climbing, crawling, prolonged equipment use, and emergency operations in hazardous environments. The physical demands placed on firefighters can contribute to occupational injuries, reduced mobility, and long-term health impacts if not proactively addressed through a structured wellness and injury prevention program.
The primary objective of this program is to improve firefighter mobility, flexibility, functional movement, core strength, and overall physical wellness while reducing the frequency and severity of occupational injuries. The program is intended to enhance firefighter longevity, improve quality of life, support injury prevention and recovery efforts, and maintain the operational readiness necessary to safely and effectively serve the community.
The Draper Fire Department seeks a qualified provider with demonstrated experience in occupational wellness, firefighter fitness, injury prevention, and evidence-based health and performance practices. The Selected Provider will be expected to deliver services tailored to the specific needs of fire personnel, incorporating industry best practices and an understanding of the physical requirements associated with emergency response operations.
The City’s goal is to establish a proactive wellness program that supports the long-term health and readiness of its firefighters through education, assessment, coaching, prevention strategies, and ongoing wellness support.
Background The Draper Fire Department provides fire suppression, emergency medical services, technical rescue, and emergency response services to the Draper City community. The Department operates three fire stations and staffs an average of eighteen (19) personnel per platoon, in addition to administrative staff. Personnel work in both shift-based and administrative roles and support a wide range of emergency response and departmental functions. Fire personnel respond to emergency incidents requiring physical strength, endurance, agility, and the ability to perform under demanding conditions.
Fire Department personnel routinely perform physically demanding tasks, including fire suppression activities, equipment transport and operation, patient care and movement, technical rescue operations, and emergency response in hazardous environments. These duties require a high level of physical readiness to safely and effectively perform essential job functions.
The Selected Provider will work with Draper Fire Department personnel to provide wellness and injury prevention services that support the physical demands and operational requirements of the fire service.

Time allowed for cure will not diminish or eliminate Contractor's liability for damages. If the default remains after Contractor has been provided the opportunity to cure, Draper may do one or more of the following: (i) exercise any remedy provided by law or equity; (ii) terminate this Contract; (iii) impose liquidated damages, if liquidated damages are listed in this Contract; (iv) debar/suspend Contractor from receiving future contracts from Draper or the State of Utah; or (v) demand a full refund of any payment that Draper has made to Contractor under this Contract for Services that do not conform to this Contract.

32. PROCUREMENT ETHICS: Contractor understands that a person who is interested in any way in the sale of any supplies, services, construction, or insurance to Draper is violating the law if the person gives or offers to give any compensation, gratuity, contribution, loan, reward, or any promise thereof to any person acting as a procurement officer on behalf of Draper, or to any person in any official capacity participates in the procurement of such supplies, services, construction, or insurance, whether it is given for their own use or for the use or benefit of any other person or organization.
33. DISPUTE RESOLUTION: Prior to either party filing a judicial proceeding, the parties agree to participate in the mediation of any dispute. Draper, after consultation with the Contractor, may appoint an expert or panel of experts to assist in the resolution of a dispute. If Draper appoints such an expert or panel, Draper and Contractor agree to cooperate in good faith in providing information and documents to the expert or panel in an effort to resolve the dispute.
34. SURVIVAL OF TERMS: Termination or expiration of this Contract shall not extinguish or prejudice Draper’s right to enforce this Contract with respect to any default or defect in the Services that has not been cured.
35. SEVERABILITY: The invalidity or unenforceability of any provision, term, or condition of this Contract shall not affect the validity or enforceability of any other provision, term, or condition of this Contract, which shall remain in full force and effect.

ATTACHMENT A:
Insurance Requirements for Most Contracts
Contractor shall procure and maintain for the duration of the contract insurance against claims for injuries to persons or damages to property, which may arise from or in connection with the performance of the work hereunder, and the results of that work by the Contractor, his agents, representatives, employees or subcontractors.
MINIMUM SCOPE AND LIMIT OF INSURANCE
Coverage shall be at least as broad as:
1. Commercial General Liability (CGL): Comprehensible General Liability Insurance on an “occurrence” basis, including products and completed operations, property damage, bodily injury and personal & advertising injury with limits no less than $2,000,000 per occurrence. If a general aggregate limit applies, either the general aggregate limit shall apply separately to this project/location or the general aggregate limit shall be twice the required occurrence limit.
2. Automobile Liability: Auto Liability insurance covering any auto, or if Contractor has no owned autos, hired, and non-owned autos, with limit no less than $1,000,000 per accident for bodily injury and property damage.
3. Workers’ Compensation: Workers’ Compensation insurance with statutory limits as required by the Workers’ Compensation Act of the State of Utah unless a waiver of coverage is allowed and acquired pursuant to Utah law and Employer’s Liability Insurance with limit of no less than $1,000,000 per accident for bodily injury or disease. This requirement does not apply to individuals not employed with a company or other commercial entity.
If the Contractor maintains broader coverage and/or higher limits than the minimums shown above, Draper City requires and shall be entitled to the broader coverage and/or the higher limits maintained by the contractor. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to Draper City.
Other Insurance Provisions The insurance policies are to contain, or be endorsed to contain, the following provisions:
Additional Insured Status Draper City, its officers, officials, employees, and volunteers are to be covered as additional insureds on the CGL policy with respect to liability arising out of work or operations performed by or on behalf of the Contractor including materials, parts, or equipment furnished in connection with such work or operations. General liability coverage shall be provided in the form of an endorsement.
Primary Coverage For any claims related to this contract, the Contractor’s insurance coverage shall be primary coverage as respects Draper City, its officers, officials, employees, and volunteers. Any insurance or self-insurance maintained by Draper city, its officers, officials, employees, or volunteers shall be excess of the Contractor’s insurance and shall not contribute with it.
Notice of Cancellation Each insurance policy required above shall provide that coverage shall not be canceled, except with notice to Draper City.
Waiver of Subrogation Contractor hereby grants to Draper City a waiver of any right to subrogation, which any insurer of said Contractor may acquire against Draper City by virtue of the payment of any loss under such insurance. Contractor agrees to obtain any endorsement that may be necessary to affect this waiver of subrogation, but this provision applies regardless of whether or not Draper City has received a waiver of subrogation endorsement from the insurer.
Self-Insured Retentions Self-insured retentions must be declared to and approved by Draper City. Draper City may require the Contractor to purchase coverage with a lower retention or provide proof of ability to pay losses and related investigations, claim administration, and defense expenses within the retention. The policy language shall provide, or be endorsed to provide, that the self-insured retention may be satisfied by either the named insured or Entity.
Acceptability of Insurers Insurance is to be placed with insurers authorized to conduct business in the state with a current A.M. Best’s rating of no less than A:VII, unless otherwise acceptable to Draper City.
Claims Made Policies If any of the required policies provide claims-made coverage:
1. The Retroactive Date must be shown, and must be before the date of the contract or the beginning of contract work.
2. Insurance must be maintained and evidence of insurance must be provided for at least five (5) years after completion of the contract of work.
3. If coverage is canceled or non-renewed, and not replaced with another claims-made policy form with a Retroactive Date prior to the contract effective date, the Contractor must purchase “extended reporting” coverage for a minimum of five (5) years after completion of work.
Verification of Coverage Contractor shall furnish Draper City with original Certificates of Insurance including all required amendatory endorsements (or copies of the applicable policy language effecting coverage required by this clause) and a copy of the Declarations and Endorsement Page of the CGL policy listing all policy endorsements to Draper City before work begins. However, failure to obtain the required documents prior to the work beginning shall not waive the Contractor’s obligation to provide them. Draper City reserves the right to require complete, certified copies of all required insurance policies, including endorsements required by these specifications, at any time.
Special Risks or Circumstances Draper City reserves the right to modify these requirements, including limits, based on the nature of the risk, prior experience, insurer, coverage, or other special circumstances.
Notice of Incident or Accident Contractor shall agree to disclose to Draper City, all incidents or occurrences of accident, injury, and/or property damage covered by the insurance policy or policies.
Indemnification Contractor shall indemnify, defend and hold harmless Draper City, its elected officials, officers, agents, employees and volunteers from all damages, costs or expenses in law or equity, including attorney’s fees, that may at any time arise or be set up because of damages to property, bodily injury or personal injury received by reason of or in the course of providing goods and services provided to Draper City which may be occasioned by any willful, negligent or wrongful act or omission of that contracting party, any of their employees or any subcontractors.
