11.3 Stage 3 — Interview / Demonstration
Proposers who meet the seventy-point threshold in Stage 2 will be invited to interview with the evaluation committee.
A maximum of fifty (50) interview points is available. Proposers will be given a maximum of twenty (20) minutes to present their response to the Technical Proposal, followed by committee questions. The committee will evaluate each presentation on how well it demonstrates the Proposer’s ability to deliver the security upgrades described in this RFP without disrupting 24/7 public-safety operations, and on the quality and availability of the proposed key personnel.
Demonstrations will be held either virtually or in person at City Hall, 460 East Main Street, Green River, UT 84525.
The City will notify all qualified Proposers of the exact date and time.
11.4 Stage 4 — Cost Analysis
A maximum of fifty (50) cost points is available. The Proposer with the lowest total Base Cost (excluding alternates) will receive fifty (50) points. All other Proposers will receive a portion of the available cost points using the formula:
Cost Points = 50 × (Lowest Base Cost / Proposer’s Base Cost).
The Cost Analysis is calculated separately from the Technical and Interview scores; the evaluation committee does not see the Proposers’ cost bids until after Stages 2 and 3 are complete.
12. Proposal Acceptance and Award
12.1 Contract Award
The Proposer with the highest combined score (Technical + Interview + Cost), as justified by the Utah Procurement Code, will be recommended for award. The award is subject to City Council approval, and the selected Proposer must be approved before the award is made. After the meeting where the award is approved, all responders will receive an email notification of the result. Attendance at the public City Council meeting is permitted.
12.2 Firm Proposals
Proposals must be signed by an authorized official with authority to bind the Proposer to a contract. Proposals shall remain valid for ninety (90) days from the proposal due date.
12.3 Cancellation
The City reserves the right to cancel the procurement process, in whole or in part, at any time, without liability. All proposals become the property of the City. Proposal information may be subject to disclosure as a public record under the
Utah Government Records Access and Management Act (GRAMA). Proposers must clearly mark any portion claimed as a trade secret or confidential commercial information.
13.4 Interpretation of the RFP
The Proposer must carefully examine and understand all requirements, specifications, and conditions stated in this RFP. If a Proposer finds discrepancies in or omissions from the RFP, or is in doubt as to the meaning of any provision, a written request for interpretation or correction must be submitted through U3P during the question-and-answer period. Any changes to the RFP will be made only by a written addendum posted on U3P. The City is not responsible for any other explanations or interpretations. If any provision of the resulting agreement is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions will continue in full force without being impaired or invalidated.
13. General Terms and Conditions
RFP Costs. All costs of preparing and submitting a proposal are the sole responsibility of the Proposer.
Conflicts of Interest. Proposers shall disclose any potential conflict of interest with the City.
Modification or Cancellation. The City reserves the right to modify, suspend, or cancel this RFP at any time, in whole or in part, without liability.
Governing Law. Any contract resulting from this RFP shall be governed by the laws of the State of Utah, with venue in the appropriate Utah courts.
No Obligation. Issuance of this RFP creates no obligation to award a contract or to pay any cost incurred by
Proposers in preparation of a proposal.
Severability. If any provision of this RFP or the resulting contract is held to be unenforceable, the remaining provisions shall continue in full force and effect.
