REQUEST FOR PROPOSALS
RFP #26-125
1. NOTICE AND INTRODUCTION
Weber County (“County”) is seeking proposals from well qualified and experienced contractors (“Proposer”) that can provide all services associated with Construction Management (pre-construction design phase) and
General Contracting for constructing a new Weber County Jail Medical & Mental Health Housing Wing
(“Medical Wing”), and all associated site improvements (“Project”). The site for the Jail is located at 1400
Depot Drive, in Ogden City, Utah. Refer to Attachment A for a Project Vicinity Map.
The County, by means of a CM/GC delivery method, is working with GSBS Architects (GSBS) to carry out this
Project. As conceptually designed, the Medical Wing will provide approximately 42,800 ft2 of gross building area within a main-level footprint of approximately 15,000 ft2. It comprises medical staff space, medical infirmary, clinic, dental operatory, pharmacy, holding, control, male housing with rec. area, female housing with rec. area, and other general storage space and basic amenities found in a correctional facility’s medical and mental health facility. The building design also includes specialized technology, equipment, and systems typically found in a law enforcement facility that provides medical services. This specialized technology and equipment shall be compatible with the existing facility technology and equipment. Refer to Attachment F for concept drawings that illustrate the Project goal. The Budgeted cost of the project is approximately $22
Million (Budget). The goal is to identify a contractor that can deliver high-quality pre-construction phase and construction services while adhering to the Project’s Budget.
Proposers will create and submit a complete proposal package and then possibly present their proposal’s most notable elements to the County. Contractor fees or costs related to the Project cannot be presented or discussed during any presentations. Proposals must include all information listed in Section 11 (Submittal
Content and Organization) of this Request for Proposals (RFP).
The County will evaluate proposals and select a Proposer based on evaluation criteria listed in Section 12
(Evaluation Criteria) of this RFP. The County’s intent is to award the Project and subsequent contract to one
Proposer. Refer to Section 17 (Standard Contract Terms and Conditions) of this RFP and Attachment E for
Weber County Purchasing Department Proposal Terms and Conditions.
This is an RFP only and must not be considered a solicitation or offer to contract for services. Submittals should be concise, comprehensive, and clearly respond to the requirements outlined and described in this
RFP.

b. Narrative (10%): In addition to specific criteria listed in this section, this criterion is used to assess the Proposer’s performance in providing information as requested. Points will be awarded on a comparative basis (to others’ responses) and at a level that is commensurate with the Proposer’s ability to:
i. Account for a relatively high number of years performing the type of work described in this RFP. Preference will be given to Proposers that can include other work experience that shows a variety and depth of experience.
ii. Show a company culture that is characterized by strong core values.
iii. Account for a relatively high number of new-construction type projects where the
Proposer was the (prime) general contractor overseeing the construction of a government building/facility, similar to the facility described and illustrated in this
RFP.
iv. Provide an explanation of its current project workload and available resources that will allow for a early start date.
c. Qualification/Experience (25%): This considers the proposer’s performance on similar prior local projects of similar size. Experience relates to the overall assessment of the proposer’s assigned personnel and previous experience with this type of project. Contractor may need to utilize a knowledge of Federal, State and local design guidelines/regulations.
d. Key Personnel and Project Team (25%): This criterion considers the education, training, and experience level of key personnel identified as the individuals that will perform the work for this project, as well as previous experience working together as a team.
e. Risk Assessment (15%): This criterion is used to assess the Proposer’s experience and knowledge of typical circumstances as well as current industry conditions that can negatively affect the Project. Preference will be given to assessments that are comprehensive and offer innovative and reliable ways to eliminate or mitigate the risks that are identified.
f. Cost Proposal (20%): Cost will be evaluated independently from the rest of the proposal. The
Proposer with the lowest price will receive 100% of the cost points. All other Proposers will receive a proportionate share of the total cost points based on a comparison to the lowest proposed price. Proposers with a price that is more than double the lowest proposed price will receive no cost points. The formula used to determine portioned points is as follows:
Lowest Proposed Price ÷ Other Proposed Price × Total Cost Points. See Attachment D for Cost
Proposal Worksheet Example. See Attachment C (Weber County RFP Evaluation Scoresheet
Example) for point totals and other details.
13. SUBMITTAL OWNERSHIP
All RFP documents, materials, electronic files, and storage devices will become the property of the County at the time of the submittal deadline. Proposers must carefully consider the cost of these items and any intellectual value prior to submittal. Submittals may be reviewed and evaluated by any person, at the discretion of the County. No submittal documents, materials, or electronic storage devices will be returned to the Proposer after the submittal deadline, regardless of the outcome of the selection process.
14. PROTECTED RECORDS
The Government Records Access and Management Act (GRAMA) provides for the protection of certain classified records. It describes that trade secrets, commercial information, or non-individual financial information may generally be protected when records are accompanied by a Claim of Business Confidentiality.
Proposers can refer to Utah Code Ann., §63G-2-305(1) and (2) and §63G-2-309 for more information.
To protect records under a Claim of Business Confidentiality, a Proposer must:
a. Ensure that the records qualify as protected under UCA §63G-2-305(1) or (2); and
b. Submit a written claim of business confidentiality at the time the record (RFP response packet) is submitted to the County, specifying which portions of the RFP response packet are claimed to be protected; and
c. Consistent with UCA §63G-2-309(1), provide a concise statement which includes reasons supporting the claim of business confidentiality; and
d. Submit an electronic “redacted” (excluding/masking protected information) copy of the record/RFP response. This copy must be clearly marked with the words “Redacted Version,” and the redacted portions must match the portions claimed to be protected in the written claim.
A Claim of Business Confidentiality may be appropriate for information such as client lists and non-public financial information statements. Pricing and service elements may not be protected. An entire RFP response packet cannot be characterized as “PROTECTED,” “CONFIDENTIAL,” or “PROPRIETARY.” RFP response packets marked in this way may be considered non-responsive.
15. WITHDRAWAL FROM PROCUREMENT PROCESS
Any request to be considered for the above described Project, demonstrated by voluntarily responding to this
RFP, may be withdrawn without prejudice. Withdrawals must be in writing and must be made prior to the set deadline for receiving submittals. Late withdrawals may affect a Proposer’s scoring in future responses.
16. RESERVATION OF RIGHTS
By responding to this RFP, Proposers acknowledge and agree that Weber County reserves the right to:
a. Reject any and all responses pursuant to this RFP.
b. Waive or modify any irregularities in the responses.
c. Request additional information or modifications to the responses, prior to notifying Proposers of any final selection results, if receiving such information or making such modifications is found to be in the best interest of the County.
d. Use any ideas received through RFP responses, unless they are the subject of a legally established intellectual property right or have proprietary protection. Selection or rejection of RFP responses does not affect this right.
e. Cancel or modify this RFP, other phases of the procurement process, or the Project at any time and for any reason prior to the execution of an agreement.
f. Divide the Project among multiple Proposers if doing so benefits the County.
17. STANDARD CONTRACT TERMS AND CONDITIONS
Any contract resulting from this RFP will include but not be limited to the County’s Standard Terms and
Conditions (See Attachment E). Exceptions and additions are discouraged; however, if any are suggested by the Proposer they must be submitted with the RFP response. Website URLs containing or referencing vendor terms and conditions are prohibited and will not be considered.
The County retains the right to refuse negotiation of exceptions and additions for any reason. In a multiple award scenario, the County reserves the right to give preference to a Proposer based on the least number of exceptions and additions suggested.
