This is a Request for Proposals (RFP) document issued by the Salt Lake City Department of Public Utilities (SLCDPU) for design services related to the Lee Drain Culvert Replacements project (Project No. 534701259). The project involves the replacement of four City-owned culverts along the Lee Drain at Gladiola Street, 4800 West, 5070 West, and 5500 West, based on recommendations from the Northwest Canal and Creek Study (NWCCS) published by Salt Lake County Flood Control in April 2022. The consulting team must provide preliminary design, final design (60/90 percent review process), bidding services, and construction-related services. Technical proposals are due by 2:00 PM on Friday, February 20, 2026, through the Utah Public Procurement Place (U3P) website. The RFP anticipates notification of selection or short-listing on February 27, 2026, with possible interviews the week of March 2, 2026, negotiation the week of March 9, 2026, and contract approval by March 19, 2026. Pre-design completion is targeted for June 2026, design completion for October 2026, bidding for November 2026, and first culvert construction completion for April 2027, with remaining culverts constructed over a three-year period contingent on capital funding availability.

The consultant shall submit cost proposals separately from technical proposals, both in PDF format, with the technical proposal not exceeding ten pages (excluding resumes). Selection criteria are weighted as follows: consultant qualifications and experience with similar projects (25 percent), key personnel experience and qualifications (25 percent), responsiveness and availability to SLCDPU staff (25 percent), understanding of project scope (15 percent), and overall quality of RFP response (10 percent). The cost proposal must itemize all services in U.S. dollars and include hourly wages for consultants. Professional liability insurance of $2,000,000 per occurrence and commercial general liability insurance of $1,000,000 per occurrence are required, with Salt Lake City named as an additional insured. All responses shall become property of the City and are subject to disclosure under Utah's Government Records Access and Management Act (GRAMA), with claims of business confidentiality requiring written justification. January 2026

1805 W 500 South Salt Lake City, UT 84104

REQUEST FOR PROPOSALS

Salt Lake City Department of Public Utilities (SLCDPU) is seeking proposals from qualified firms to provide expertise and professional engineering services for the Lee Drain Culvert Replacements (534701259). (Project). The engineering services will include preliminary and final engineering design services, bidding services and services during construction for the proposed Project. The following information is intended to provide additional instructions and information regarding this Request for Proposals (RFP) along with a schedule and other requirements for submitting a proposal.

INTRODUCTION AND BACKGROUND

Salt Lake County Flood Control published the Northwest Canal and Creek Study (NWCCS) in April 2022. This study can be found in Attachment B. The Lee Drain was analyzed as part of the NWCCS. The Salt Lake County portion of the Lee Drain conveyance begins downstream of the pump station located at 2955 Andrew Ave. The Lee Drain is a tributary to the Lee Kay Ponds, which is located at 6000 West and 1300 South. Most of the area tributary to the Lee Drain upstream of the Lee Kay Ponds have already developed with Salt Lake City detention requirements of 0.2 cubic feet per second (cfs) per acre for the 100-year storm event. The 100-year storm event was modeled as part of the NWCCS and it was discovered that flooding is predicted within the existing Lee Drain channel/culvert system. Table EX-1 in the NWCCS details the additional capacity required at the existing Lee Drain culvert locations, and Table EX-2 details the conceptual Lee Drain culvert sizes. Salt Lake City Department of Public Utilities (SLCDPU) is the owner of four culverts within the system – Gladiola Street, 4800 West, 5070 West, and 5500 West. In order to adequately contain and convey the 100-year storm event, SLCDPU will be reconstructing the four City-owned culverts to be sized in accordance with the recommendations set forth in the NWCCS. The consultant shall perform pre-design, final design, bidding, and construction services. All four culverts will be designed together. Construction for the four culverts will happen over a three-year time span, assuming sufficient capital funding for each culvert is obtained.

Coordination with Salt Lake County Flood Control will be required throughout the duration of this project. Salt Lake County Flood Control will verify the total carrying capacity for each culvert.

SCOPE OF WORK

A. Construction Budget. The Construction Cost shall be the total cost or estimated cost to the City of all elements of the Project designed or specified by the Consultant. The parties acknowledge that neither Consultant nor the City has control over the costs of labor, materials or equipment, over the methods of determining bid prices by the Consultants or over competitive bidding, market or negotiating conditions. Accordingly, Consultant cannot and does not warrant or represent that bid or negotiated prices will not vary from the Project budget proposed, or from any cost estimate or evaluation prepared by the Consultant.

2. The provisions of this Subsection E shall not preclude or limit judicial review of any issues or disputes arising under this Agreement.

3. Prior to seeking any judicial review the parties shall endeavor, in good faith, to resolve any disputes arising under this Agreement pursuant to the following procedures:

a. The City Project Manager shall have the initial responsibility to interpret the requirements of this Agreement.

b. Any decision by the City Project Manager interpreting the requirements of this Agreement may be appealed in writing to the Department Head of the City department responsible for the Project.

i. The decision of the Committee shall be a non-binding interpretation of the facts that are the subject of the appeal, subject to any judicial review.

5. Notwithstanding the pendency of any appeal provided above, Consultant shall, if so, ordered by the City, comply with all orders of the City concerning the performance of this Agreement.

6. Any decision of the City to terminate the work under this Agreement shall not be subject to the dispute resolution of this Article.

ARTICLE X. OWNERSHIP OF DOCUMENTS.

A. City Ownership. The data used in compiling, and the results of, any tests, surveys or inspection of the Project site, as well as all photographs, drawings, electronically stored records of work performed, renderings, specifications, schedules, data processing output, computations, studies, audits, reports, models and other items of like kind prepared by Consultant, its employees and consultants, shall be the sole and exclusive property of the City, and the City shall own all intellectual property rights thereto, whether the Project for which they are made is executed or not. Consultant may retain reproducible copies of all of the foregoing documents for information and reference and customary marketing and public relations. The originals of all of the foregoing documents shall be delivered to the City promptly upon completion thereof.

This provision may be enforced by an order of specific performance and is independent of any other provision of this Agreement. Compliance with this paragraph shall be a condition precedent to the City's obligation to make final payment to the Consultant.

This safety requirement shall not relieve any contractor performing work on the Project from complying with the safety requirements of their Agreement, nor shall it make Consultant responsible for the contractor’s compliance with the safety requirements. The City Project Manager or their designee may stop the Consultant’s work if safety laws or safe work practices are not being observed.

ARTICLE XIII. DAMAGE TO PROPERTY.
