18.1. Buyer reserves the right to reject any or all Bids, including without limitation, nonconforming, non-responsive, unbalanced, or conditional Bids. Buyer further reserves the right to reject the Bid of any Bidder whom it finds, after reasonable inquiry and evaluation, to be non-responsive. Buyer may also reject the Bid of any Bidder if Buyer believes that it would not be in the best interest of the Project to make an award to that Bidder.

18.2. More than one Bid for the same System Work from an individual or entity under the same or different names will not be considered. Reasonable grounds for believing that any Bidder has an interest in more than one Bid for the System Work may be cause for disqualification of that Bidder and the rejection of all Bids in which that Bidder has an interest.

18.3. In evaluating Bids, Buyer will consider whether or not the Bids comply with the prescribed requirements, and such alternatives, unit prices, and other data, as may be requested in the Bid Form or prior to the Notice of Award.

18.4. Buyer may conduct such investigations as Buyer deems necessary to establish the responsibility, qualification and financial ability of Bidders, proposed Subcontractors, Suppliers, individuals, or entities to perform the System Work in accordance with the Contract Documents.

18.5. If the Contract is to be awarded, Buyer will award the Contract to the Bidder whose Bid in the sole discretion of the Buyer is in the best interests of the Project.

18.6. Responsibility Determination:

18.6.1. Award of this Contract will be made to the lowest responsive and responsible Bidder. Submission of the lowest Bid price alone does not entitle a Bidder to award of the Contract. Prior to award, the Town may evaluate the apparent low Bidder's responsibility, including, but not limited to, the Bidder's

experience, technical capability, past performance, financial capacity, integrity, record of contract performance, compliance with applicable laws and regulations, and ability to successfully perform the Work within the required time.

18.6.2. As part of this responsibility determination, Bidders shall provide the references requested in the Bid Forms. The Town may contact any or all references, owners, engineers, or other persons or entities having knowledge of the Bidder's past performance and may consider information obtained from those sources, as well as any other information reasonably available to the Town.

18.6.3. References are requested solely for the purpose of determining Bidder responsibility and are not evaluated as scored criteria. This Invitation for Bids is not a qualifications-based procurement, and no points or qualitative ranking will be assigned to references. However, if the Town determines, based upon the information received, that the apparent low Bidder lacks the experience, capability, capacity, satisfactory performance history, or other qualifications necessary to successfully perform the Contract, the Town may determine that Bidder to be non-responsible and reject the Bid in accordance with applicable Arizona procurement requirements and federal funding requirements.

18.6.4. For Projects funded, in whole or in part, with federal financial assistance, the Town's responsibility determination shall also include compliance with all applicable federal funding requirements. The Town may consider the Bidder's eligibility to receive federal funds, record of integrity and business ethics, satisfactory performance of previous federally assisted contracts, compliance with public policy, financial and technical resources, and any other responsibility factors required by applicable federal laws, regulations, grant conditions, or funding agency requirements. Award will be made only to a responsible Bidder possessing the ability to successfully perform the Contract in accordance with applicable federal procurement requirements.

18.6.5. The Town reserves the right to investigate the qualifications and responsibility of any Bidder, to require additional information necessary to complete its responsibility determination, and to reject the Bid of any Bidder determined to be non-responsible. Failure to provide requested information or references may be grounds for a determination of non-responsibility.

22.2.1.2. 22.2.3. Successful Bidders should make reasonable good faith efforts to subcontract with DBE firms whenever additional subcontracting opportunities arise during the performance of the Contract.

22.3. Failure to comply with the submission of appropriate DBE documentation may result in the determination of Bidder as non-responsive and shall be cause for Bid to be rejected.

22.4. The Project is required to comply with the Davis-Bacon Act.
