About this file

This is a Drug-Free Workplace Affidavit required by Letcher County Fiscal Court, Kentucky, for its Invitation for Bid regarding asbestos abatement services at residential and commercial properties acquired through a voluntary property buyout grant program. The affidavit mandates that responding contractors certify they have implemented comprehensive drug-free workplace policies, including publishing statements prohibiting unlawful controlled substance manufacture, distribution, dispensing, possession, or use in the workplace; informing employees of drug abuse dangers and available counseling and rehabilitation programs; distributing the drug-free workplace statement to all employees engaged in the proposed work; requiring employees to notify employers of any controlled substance law convictions or guilty pleas within five days of occurrence; and imposing sanctions or requiring participation in drug abuse assistance programs for violations.

The affidavit requires contractors to make good faith efforts to maintain a drug-free workplace through ongoing implementation of these provisions. This document serves as a compliance certification mechanism for contractors bidding on asbestos abatement and removal services, which require contractors to be licensed by the Kentucky Division of Air Quality and state-accredited. All responding firms must execute this affidavit as part of their bid submission for the contract opportunity.
